2582-81S 1 ORDINANCE NO. 2582-81 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, ANNEXING POR'T'IONS OF SECTION 32, TOWNSHIP 28 SOUTH, RANGE lb EAST, PINELI,AS COUNTY, FLORIDA, INTO THE CORPORATE LIMITS OF THE CITY OF,CLEARWATER, FLORIDA, AND REDEFINING THE BOUNDARY LINES OF THE CITY TO INCLUDE SAID ADDITION ACCORDING TO THE PROVISIONS OF THE CHARTER OF THE CITY OF CLEARWATER, FLORIDA, AND THE LAWS OF FLORIDA; AFTER PROPER PUBLIC NOTICE AND PUBLIC HEARING THEREON, ESTABLISHING THE FIRE DISTRICT CLASSI- FICATION FOR SAID PROPERTY; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the City Commission of the City of Clearwater, Florida, received a sworn petition from Arbor Advertising Corporation; John Turnbull, as Trustee; Henry Dingus, Jr., Gulf Coast Acres, Inc. ; O. K. Marks, W. E. Currie III and H. E. Currie, Tr.; and Capstone Group requesting the City to annex-certain parcels of real estate described hereinafter, owned by them, 'into the corporate limits of the City of Clearwater, Florida, and 't WHEREAS, the City Commission; after due consideration of said request for annexation, at a regular meeting held on October 15, 1981, voted unanimously to accept said request and authorized the proper officials to set up 'a public hearing thereon for the determination and establishing of fire with the provisions of Chapter 171, Florida Statutes; and WHEREAS, on November 19, 1981, the City Commission of the City of Clearwater, after proper public notice, held a public hearing for the determination and establishment of fire district classifications for said real property; and WHEREAS, the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto district classifications and to prepare an ordinance to annex aid parcels of real estate into the corporate limits of the City of Clearwater in accordance i . . related to an adopted comprehensive plan or element thereof be reviewed by f the Local Planning Agency (LPA) for conformance with plans adopted pursuant to the LGCPA; and -1- . Ordinance 2582-82 °?' 2/4/82 r D WHEREAS, the Pinellas County Planning Council (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to such required referral process; and WHEREAS, thin Ordinance has .been referred to and considered by the PCPC under said process; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. After its evaluation of all evidence presented at a proper public hearing, the City of Clearwater, acting by and through its City Commission, by the authority and under the provisions of Section 171. 044, Florida Statutes, hereby annexes into the corporate limits of the City of Clearwater, Florida, and redefines the boundary lines of said City so as to include the following described real property in Pinellas County, Florida, and establishes fire district classification therefor: Commence at the West 1/4 corner of Section 32, Township 28 South, Range 16 East, Pinellas County, Florida, and run S 89°34'5011 E, 100.00 feet to a point on the Easterly right-of- way line of U. S. Highway 19 North for a P. O. B.; thence by a curve to the left having a radius of 2964. 91 feet, a chord bearing N 03°04134" W, 296.75 feet, an arc distance of 296. 88 feet to a point on the Northerly right-of-way line of First Avenue North, according to the plat of Section "A", Unit No. 1, Chautauqua, as recorded in Plat Book 9, page 52, of the Public Records of Pinellas County, Florida; thence S 89°34'50" E, 552. 10 feet along said Northerly right-of-way to a point on the Westerly right-of-way line of Main Street according to the aforementioned plat; thence S 00°01150" E, 1093.45 feet along said Westerly right-of-way line to a point on the Northerly right-of-way line of Third Avenue South of the aforementioned plat; thence N 89°57'07" W, 185.04 feet along said Northerly right-of-way line; thence S 00'0I15011 E, 163.94 feet; thence S 89 ° 57 1 0711 E, 90. 02 feet; thence N 00 ° 01' 50" W, 103.94 feet to a point on the Southerly right-of-way line of the aforementioned Third Avenue South; thence S 89°57'07" E, 95.02 feet to a point on the Westerly right-of-way line of Main Street according to the aforementioned plat of Section "A", Unit 1, Chautauqua; thence S 00"0115011 E, 207. 88 feet along said Westerly right-of-way line to a point on the Northerly right-of- way line of Fourth Avenue South according to the aforementioned plat; thence ' N 89 ° 57' 07" W, 39. 10 feet; thence S 00 °01 1 501? E, 440.00 feet along the Westerly right-of-way line of Main Street according to the plat of Section "A", Unit 5, Chautauqua, as recorded in Plat Book 18, page 61, of the Public Records of Pinellas County, Florida; thence N 89°57'07" W 498.45 feet to a point on the Easterly right-of-`way. line of U. S. Highway 19 North; thence along said Easterly right-of-way line N 00°0015811 E, 1508.60 feet to the P.O. B., together with abutting right-of-way. Highway 19 North as deeded in O. R. Bo1ak 4440, pages 1741 and 1742, of the Public Records of Pinellas County, Florida, said point being the P. O. The City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in conformance with the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. t Section 3. The City Commission hereby formally and according to law, accepts the dedication of all easements, streets, parks, plazas, places, rights-of-'way"and other dedications to the public which have heretofore been made,.by plat, deed or user within the areas so annexed. The City Engineer, the City Clerk and the Planning Director are directed to include and set out and'show upon the official maps and records of the City of Clearwater the foregoing property and the Are district classification therefor.
