ORDINANCE NO. 2573-81 AN ORDINANCE AMENDING THE ZONING ATLAS OF THE CITY OF CLEARWATER, FLORIDA, 1981, AS AMENDED, BY ZONING CERTAIN PROPERTY RECENTLY ANNEXED INTO TLE CITY OF CLEARWATER, AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, on November 19, 1981, the City Commission of the City of Clearwater, after proper public notice, held a public hearing for the determination and establishment of zoning classifications for certain property annexed into the City of Clearwater in accordance with procedure as established; and WHEREAS, certain of the amendments to the zoning atlas for establishing zoning for such newly annexed real property were approved by the City Commission after its evaluation of all evidence presented at the said public hearing; and WHEREAS, the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to LGCPA; and WHEREAS, the Pinellas County Planning Council (PCPC) has been designated the Local Planning Agency for Pinellas County and the PC PC has adopted guidelines with reference to such,regnired referral process; and WHEREAS, this Ordinance has been referred to and considered by the PCPC under said process; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA; -I- SEE ORDINANCE 2718/82 p D Section 1. The following described property in Clearwater, Florida, is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas of the City of Clearwater, Florida of 19811, as amended, is amended to indicate that fact as hereinafter act out: Zoned P - Public Land District The East 40 feet of the following described parcel: From the SF. corner of Section 8, Township 29 South, Range 16 East, for a P. 0. B., go N 89°37'03" W, along the South line of said Section 8, 740. 28 feet; thence N 0°54'07" E, 668.42 feet; thence S 89°37'06" E, 732.56 feet, to a point on the East line of said Section 8; thence S 0*14'Z5" W, along said East line, 668.41 feet to the P. O. B. AND The West 40 feet of the following described parcel: From the SW corner of Section 9, Township 29 South, Range 16 East, for a P.O. B., go N 0°14'25" E, along the West line of said Section 9, qZZ. 6Z feet; thence S 89*22 140" E, 1337.67 feet, to a point on the East line of, the SW 1/4 of the SW 1/4 of said Section 9; thence S 0°11'02" W, along said East line, 920. 52 feet, to the SE corner of the SW 1/4 of the SW 1/4 of said Section 9; thence N 89°28'34" W along the South line of said Section 9,. 1338, 50 feet to the P. O. B., Leaa and except that portion already in the corporate limits of the City of Clearwater. Section 2. The City of Clearwater does hereby certify that the ,I. measures contained in this ordinance are consistent-and in conformance with the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. Section 3. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 4. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect . the validity of the ordinance as a whole, or any part thereof other than the part.declared to be invalid. Section 5. Notice of the proposed enactment of thin ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166, 041, Florida Statutes. 2/18/82 Section 6. The Planning Director is directed to include and act out and show upon the official zoning atlas of the City of Clearwater the foregoing amendment'as hereinabove set out. , i Section 7.
