AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
REPEALING SECTIONS 131. 112 THROUG14 131. 117, OF DIVISION
16, RMH, MOBILE HOME PARK DISTRICT, OF ARTICLE III,
DISTRICT REGULATIONS, OF CHAPTER 131, ZONING, OF
TITLE XI, BUILDING AND ZONING REGULATIONS, OF THE
CODE OF ORDINANCES, CITY OF CLEARWATER, AND
ENACTING NEW SECTIONS 131. 112 THROUGH 131.116
TO ESTABLISH NEW ZONING CODE REGULATIONS FOR
NEW, EXPANDING OR EXISTING MOBILE HOME PARES;
PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING FOR THE REPEAL OF ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH;
PROVIDING FOR PROPER NOTICE OF PROPOSED
ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF. THIS ORDINANCE.
WHEREAS, on October 15, 1981, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the Zoning Ordinance of the City of Clearwater in
accordance with procedure as established; and
WHEREAS, the City Commission hae fully considered the
recommendations and report of the Planning and Zoning Board relative to
the certain propused cbiknges to the Zoning Ordinance; and
WHEREAS, certain of the proposed changes and amendments to the
Zoning Ordinance were approved by the City Commission after its evaluation
of all evidence presented at the said public hearing; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments thereto
' related to an adopted comprehensive plan or element thereof be reviewed by
the Local Planning Agency (LPA) for conformance with plans adopted
pursuant to LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the PCPC
has adopted guidelines with reference to such required referral process; and
WHEREAS, this Ordinance has been referred to and considered by
the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY

Section 1. Sections 131.112 through 131. 117, of Division 16,
RMH, Mobile Home Park District, of Article III, District Regulations, of
Chapter 131, Zoning, of Title XI, Building and Zoning Regulations, of the
Code of Ordinances, City of Clearwater, are hereby repealed in their
entirety.
Section 2. Division 16, RMH, Mobile Home Park District, of
Article III, District Regulations, of Chapter 131, Zoning, of Title XI, Building
and Zoning Regulations, of the Code of Ordinances, City of Clearwater, is
hereby amended by enacting the following new Sections 131. 112 through
131. 116, to read as follows:
Division 16. RMH Mobile Home Park District
Section 131. 112, General Description.
An RMH district is created in order to provide an area
reserved exclusively for mobile home park and related
accessory uses in recognition of the need to provide for
the unique requirements of this residential use. It is
further the intent of this district to establish standards
that will recognize and distinguish between the creation
of new or expanded mobile home parks and those mobile
home parks now in existence so as to provide a fair and
equitable basis for the creation of new parks and the.con-
tinuation of existing parks in a manner that is both conducive
to a satisfactory residential environment and realistic
relative to the investment and physical constraints of
existing mobile home parka.
Section 131. 113. Permitted Uses and Structures.
In an RMH district all land and buildings shall be used only
for one or more of the following purposes:
(A) Mobile home units;
(B) Accessory mobile home park use including management
office, laundry and related service buildings for the
exclusive use of park residents, storage and maintenance
buildings for park equipment, ax. , recreation facilities
for park residents.
Section 131. 113. 1 Special Exception.
A single family dwelling may be permitted as a Special
Exception use in the RMH District when used exclusively
as the residence of the mobile home park owner or
operator, including any accompanying mobile home park
office use that may be situated in such dwelling unit.

Section 131. 114. New or Expanded Mobile Home Parka.
The following process and standards shall apply to the
creation or establishment of any mobile home park or
expansion thereof from the effective date of this ordinance:
(A) Application for zoning or rezoning to establish an RMH
District shall be made consistent with the otherwise
applicable procedures for such zoning action under the
provisions of Section 131.013, Code of Ordinances, City
of Clearwater.
(B) Application for establishment of a mobile home park
within an RMH zoning district shall follow and be
consistent with the otherwise applicable procedures for
site plan submission and review as set forth in Section
131.225, Code of Ordinances, City of Clearwater.
(C) Park development standards for any new or expanded
mobile home park shall be as follows:
(1) Minimum park area--ten (10) acres, unless
established on an existing nonconforming lot of
record or involving expansion of existing park;
(2) Minimum park width--two hundred (200) feet;
(3) Maximum park density--ten (10) mobile home units per
net acre;
(4) Maximum lot coverage--building coverage forty per cent
(4076), impermeable surface coverage sixty per cent (60%);
(5) Internal street easements of access and improved
travel surfaces shall be of adequate width to accom-
modate anticipated traffic, but in no case less than
the following:
(a) One-way traffic access easement--twenty (20) feet;
travel surface--twelve (12) feet;

(b) Two-way traffic access easement--thirty-two (32)
feet; travel surface--twenty-four (24) feet.
All roadways shall be constructed according to standards
established by the City Department of Public Works.
(6) There shall be a minimum of three (3) off-street parking
spaces in the mobile home park for each two (2) mobile
home unit sites. Off-street parking spaces may be
provided in common parking areas or on individual
mobile home lots, but in no case within the designated
access easement. No common parking spaces shall be
for less than four (4) unit sites nor more than three hundred
(300) feet from any unit site designated to be served by
such parking;
(7) Recreation area--A minimum ten per cent (10%) of the
total mobile home park area shall be reserved, designed
and improved for the exclusive recreational use of the
mobile home park residents;

(8) Minimum setback requirements:
(a) From the park property lines:
1. Adjoining residential zone--ten (10) feet;
2. Adjoining non-residential zone--twenty-five (25) feet;
3. Adjoining any street right-of-way--thirty-five (35) feet.
(b) From individual mobile home lot lines:
1. Front--seven and one-half (7-1/2) feet;
2. Side and Rear--six (6) feet.
(9) Minimum unit lot area--three thousand five hundred (3, 500)
square feet;
(10) Minimum unit lot width--thirty-five (35) feet;
(11) Street light and sidewalk requirements within the park
shall be as required by the City based upon the size
and location of the park and its internal circulation system;
(12) Landscaping and screening shall be required by the City
as is appropriate based on the location and design of the
park relative to its adjoining uses;
(13) Sewer, water and drainage shall be required by the City
consistent with the requirements of the Utilities and
Public Works Departments. Electrical, building and
other requirements of the Building Code shall be as
specified by the Building Department.
(14) Mobile home lots may not be sold or otherwise conveyed

has been compliance with the subdivision regulations

(15) All electrical, utility, telephone, intercom call and
other wiring shall be underground, except where the
utility company requires overhead primary distribution
on the perimeter of the mobile home park.
Section 131. 115. Existing Mobile Home Parks.
Existing mobile home parks and the individual mobile home
units located therein within the areas designated for such on
the Land Use Plan and zoned RMH on the effective date of this
ordinance are nonconforming in a number of respects with the
standards set forth under Section 131. 114 above. No expansion,
addition, rearrangement or other change within isuch existing
nonconforming mobile home park shall be permitted except in
compliance with the following:
(A) Any existing recreational vehicle located in a mobile home
park, once removed or relocated, shall not be replaced except
by a mobile home in accord with the provisions of this section.
No new, additional, substitute or relocated recreational vehicle
shall be permitted to be located in a mobile home park.

(B) A mobile home unit in replacement of an existing mobile
home unit or to be located on an established vacant mobile
home lot shall be permitted provided that:
(1) The total number of mobile home units in the park
does not exceed the number for which the park was
approved on the effective date of this ordinance for the
park or portion thereof zoned RMH, Mobile Home Park;

(2) The following lot setbacks or separation distances are met:
(a) Front yard--in line with the average setback of the
two (2) adjoining mobile home units but in no case
closer than five (5) feet to the edge of the existing
road travel surface;
(b) Side and rear yards--five (5) feet from designated
lot lines, or ten (10) feet from the adjoining mobile
home unit, including any non-habitable carport or
storage building; such option to be at the discretion
of the applicant and based upon the reference information
supplied as provided in paragraph (3) below; a4xi-
(4}{c, The purpose and intent of these setbacks are is to
moire increase open space between mobile homes
for an improved standard of living. If a hardship
occurs in meeting the setback requirements, the Board
of Adjustment and Appeal on Zoning will hear each

to scale locating and identifying y the lot on which the mobile
home unit is proposed to be located: including all pertinent
dimensions with respect to the size of the unit, its lacement
on the lot and its proximity to adjoining_unita and appurtenant
structures, in a form acceptable to the Building Department.
Further, where such mobile home unit-is, proposed to be
located with re erence to a lot line, such individual lot line s)
shall be located on the property b means of ermanent
markers designed and installed in a manner acceptable to the
Building Department.
Section 131.116. Definitions.
Definitions applicable to this section shall include mobile home,
mobile home lot, mobile home lot lines, mobile home park,

Mobile Homc--A transportable, single family dwelling unit suitable
for year-round occupancy, which is manufactured on a chassis or
undercarriage and is an integral part thereof, together with porches,
cabanas or other enclosed habitable attachments thereto.
Mobile Home Lot--A parcel of land in a mobile home park designated
for the accommodation of one mobile home and its accessory uses
for the exclusive use of the occupants of the mobile home.
Mobile Home Lot Lines--The boundaries of mobile home lots
which have been either staked out with permanent markers
approved by the Building Department or illustrated on a plot
plan which has been prepared by and bears the seal of a land
surveyor licensed by the State of Florida.
Mobile Home Park--A parcel of land devoted to mobile home
development, including individual mobile home lots and common
facilities for maintenance, service and recreation.
Mobile Home Park Prope_r_ ty Lines--The boundaries of the mobile
home park.
Recreational Vehicle--Temporary living quarters for recreational,
camping or travel use which either have their own motor power or
are mounted on.or drawn by another vehicle.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 4. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
Section 6. The Planning Director is directed to include and set out
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendments as hereinabove set out.
Section 7. The provisions of this ordinance shall take effect
immediately upon its passage.
