ORDINANCE NO. 2515-81
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING SECTION 131, 015, NONCONFORMING USES, OF
ARTICLE II, ADMINISTRATION AND ENFORCEMENT, OF
THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER,
BY PROVIDING A PROCEDURE WHEREBY NONCONFORMING
DENSITY LOST THROUGH FIRE OR OTHER NATURAL CAUSES
MAY BE RESTORED; PROVIDING FOR THE REPEAL OF
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR THE SEPARABILITY OF THE
PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE
OF PROPOSED ENACTMENT; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, it is the desire of the City Commission to provide a vehicle
whereby a nonconforming density may be preserved where it is lost by
virtue of a storm, fire or other similar loss; and
WHEREAS, this conceptual approach has been reviewed by the
Attorney General's office and not found to be in direct conflict with Section
163.3194 (1), Florida Statutes, the Local Government Comprehensive
Planning Act;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARW ATER, FLORIDA:
Section 1. That subparagraph (e), Other Nonconformities, of
Section 131.015, Nonconforming Uses, of Chapter 131, Zoning, of Article
II, Administration and Enforcement, of the Code of Ordinances, City of
Clearwater, be and the same is hereby amended to read as follows:
(•e-)- (f) Other Nonconformities -- Other nonconforming
features of a premises including density-,-parking,
• fencing, landscaping and open space may be continued
subject to the following:
(1) No such nonconforming feature will be expanded,
altered, increased, decreased or otherwise
changed so as to increase the extent or degree of
nonconformity; and

eliminated shall thereafter be re-established and
no such feature replaced or altered so as to conform
will thereafter be altered except in conformity with
the current applicable provisions of the Zoning Ordinance.

Section 2. That Section 131.015, Nonconforming Uses, of Chapter 131,
Zoning, of Article 11, Administration and Enforcement, of the Code of
Ordinances, City of Clearwater, be and the same is hereby amended and
supplemented by the addition of a new subparagraph (e) to read as follows:

(e) Nonconforming Density - A Permitted or Special
Exception u_se nonconforming as to density which is
damaged or destroyed by natural causes in excess of
er cent 50o of the replacement cost may be
fifty.p
reconstructed or replaced so as to provide the same
density that existed prior to such damage or destruction
according to the following
(I)_ All such reconstruction or replacement and all
requirements incidental thereto shall otherwise be
in compliance with all other applicable provisions
of the Zoning Ordinance and the City Code of Ordinances;
2 Density for the ur ose of applying this provision shall
be measured by dwelling units for'residential uses,
individual hotel/motel units for transient accommodations
and gross leasable floor area for commercial and
industrial uses;
3) Damage_or destruction by natural causes for the ouroose
of applying. this provision shall mean fire, flood, wind,
tidal surge or combination thereof not intentionally
perpetrated or induced b man; but where the damage or
destruction is caused by arson and such arson was procured
by or participated in by the owner of such property, then,
such damage or destruction shall be considered as
intentional) caused or induced;
4)_ It shall be a prerequisite to entitlement under this
provision that documentation of the pre-existing density
be on record with the CitX Building Department, on a
form to be provided by the Building Department, to enable
this Department to verify same prior to the release of any
permit for reconstruction or replacement under this provision.
Upon this subparagraph becoming effective, the Ci!X Clerk.
shall publish in a newspaper of general circulation a notice
of the amendment which notice shall provide all existing
nonconforming buildings ninety 90) days in which to register
their density with the City Building Department. Further,
any building rendered nonconforming as to density as a result
of a subsequent zoning action in furtherance of the comprehensive
plan shall be allowed ninety ?(90) days within which to re ister
such nonconforming density with the City Building Department; and
(5) Any reconstruction or replacement initiated under this
provision shall obtain the requisite permit within one (1)
year of the date of damage or destruction.
Section 3. All ordinances or parts of ordinances in conflict herewith
or inconsistent with the provisions of this ordinance are hereby repealed

Section 4. Should any section, paragraph, sentence, phrase,
clause, or other part or provision of this ordinance be declared by any
court to be invalid, the same shall not affect the validity of the ordinance
as a whole, or any part thereof, other than the part declared to be invalid.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166. 041, Florida Statutes,
Section 6. The provisions of this ordinance shall take effect
immediately upon its passage.
