BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That Section 31.01, Defined, of Chapter 31, Candidates, of Title III, Elections, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended and supplemented to read as follows: Sec. 31.01. Defined. As used in this chapter and in this title the term "candidate" shall be defined as follows: (1) Any person who seeks to qualify for nomination or election by means of the petitioning process and who appoints a treasurer and designates a primary depository; (2) Any person who files qualification papers and subscribes to a candidate's oath as required by law, receives contributions or makes expenditures or gives consent for any other person to receive contributions or make expenditures, with a view to bringing about his nomination, election or retention to public office_ Any person who seeks to qualifv as a write-in candidate J? ursuant to Section 31.05. No contributions may be accepted and no expenditures made until a candidate has appeinkd-a-eampa-ign-tx-ea-s ?-deeigrtatod-a-oampa-ign depesito-ryr-and qualified for office. Section 6. That subparagraph (d) of Section 33, 03, Disposition of funds, of Chapter 33, Campaign Financing, of Title III, Elections, of the Code of Ordinances, City of Ciearwa ter, be and the .same is hereby amended to read as follows: (d) Final disposition. Any candidate required to dispose of funds pursuant to this section shall either return the funds pro rata to each contributor, donate the funds to a charitable organization(s) which meets the qualifications of 501 c 3 of the Internal Revenue Code, or deposit the funds in the general fund of the City. Section 7. That subparagraph (a) of Section 33. 04, Reports, certification and filing, of Chapter 33, Campaign Financing, of Title III, Elections, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended to read as follows: (a) Each campaign treasurer designated by a candidate pursuant to Section 33. 01 shall file regular. reports of all contributions received and all expenditures made by or on behalf of such candidate. Reports shall be filed on the first Mo-a"y6 Friday of each calendar quarter from the time the earnpaign-kitei-sei-ei-.is-a'ppoin'ted-candidate qualifies for office. Following the last day of qualifying for office, the reports shall be filed on the firs •aqid-third, and fifth Fridays of each month and the Manday Friday immediately preceding the election for a candidate who is opposed in seeking ner*inatiEan"o-r'-election to the office of Mayor- Commissioner and or City Commissioner. Section 8. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 9. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 10. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. -3- Section 11. The provisions of this ordinance shall take effect immediately upon its passage.
