AN ORDINANCE OF THE CITY OF CLEAR WATER, FLORIDA,
ANNEXING LOT 10, SUBANIS SUBDIVISION, PINELLAS
COUNTY, FLORIDA, INTO THE CORPORATE LIMITS OF
THE CITY OF CLEA.RWATER, FLORIDA, AND REDEFINING

E' NOTICE AND PUBLIC HEARING THEREON, ESTABLISHING
THE FIRE DISTRICT CLASSIFICATION FOR SAID PROPERTY;
°'. PROVIDING FOR PROPER NOTICE OF PROPOSED ENACT-
F MENT; AND PROVIDING FOR THE EFFECTIVE DATE OF
THIS ORDINANCE.
WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from David B. Drake and Patricia Drake, his wife,
requesting the City to annex a certain parcel of real estate described here-
inafter, owned by them, into the corporate limits of the City of Clearwater,
Florida; and
WHEREAS, the City Commission, after due consideration of said
request for annexation, at a regular meeting held on June 18, 1981, voted
unanimously to accept said request and authorized the proper officials to set
up a public hearing thereon for the determination and establishing of fire
district classifications and to prepare an ordinance to annex said parcel of
Rs.Ri"
real estate into the corporate limits of the City of Clearwater in accordance
with the provisions of Chapter 171, Florida Statutes; and
WHEREAS, on July 16, 1961, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing for the
determination and establishment of fire district classification for said real
property; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments thereto
related to an adopted comprehensive plan or element thereof be reviewed by the

Section 6. This ordinance shall become effective immediately upon
its passage and enrollmeht..in the City of Clearwater Ordinance Book and
a copy thereof being filed in the office of the Clerk of the Circuit Court of
Pinellas County, Florida. In accordance with Section 171. 091, and Section
171. 044, Florida Statutes, a certified copy shall be filed with the Department
of State of the State of Florida.

WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from David B, Drake and Patricia Drake, his wife,
requesting the City to annex•a certain parcel of real estate described here-
inafter, owned by there, into the corporate limits of the City of Clearwater,
Florida; and
WHEREAS, the City Commission, after due consideration of said
request for annexation, at a regular meeting held on June 18, 1981, voted
unanimously to accept said request and authorized the proper officials to set
up a public hearing thereon for the determination and establishing of fire
district classificationa and to prepare an ordinance to annex said parcel, of
real estate into the corporate limits of the City of Clearwater its accordance
vvith the provisions of Chapter 171, Florida Statutes; and
WHEREAS, on July 16, 1981, the City Commission of the City of
Clearwater., after proper public notice, held a public hearing for the
determination and establishment of fire district classification for said real
property; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments thereto
related to an adapted comprehensive plan or element thereof be reviewed by t.'se
Local Planning Agency (LPA) for conformance with plans adopted pursuant
to the LGCPA; and

designated the Local Planning Agency for Pinellas County and the PCPC has
adopted guidelines with reference to such required referral process; and
WHEREAS, this Ordinance has been referred to and considered by
the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION- OF THE CITY OF CLEARWA TER, FLORIDA:

Florida Statutes, hereby annexes into the corporate limits of the City of
Clearwater, Florida, and redefines the boundary lines of said City so as
to include the followb;g described real property in Pinellas County, Florida,
and establishes fire district classification therefor;
Lot 10, Suban's Subdivision, according to the map or
plat thereof as rY.corded in Plat Book 40, page 32, of
the Public Recnrds of Pinellas County, Florida.
The above described property is hereby designated
Fire District No. 2.
Section 2. ' The City of Clearwater does hereby certify that the
measures contained in this ordinance are consistent and in conformance with
the Ciiy's Coraprehensive Plasx ,and individual elements thereof adopted pursuant
to the LGCPA and directs that same be forwarded to the LPA for their receipt
and appropriate action.
Section 3. The City Commission hereby formally and according to
law, accepts the dedication of all easernents, streets, parks, plazas, places,
rights-of'-way and other dedications to the public which have heretafore beerl
made by plat, deed or user within the areas so annexed.
Section 4. The City Engineer, the City Clerk and the Planning
Director are directed to include and set out and show upon the official maps
and records of the City of Clearwater the foregoing property and the fire
district classification therefor.
