AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING ARTICLE I, GENERALLY, OF CHAPTER 79,
SECONDHAND GOODS, OF TITLE VII, BUSINESSES AND
BUSINESS REGULATIONS, OF THE CODE OF ORDINANCES,
CITY OF CLEARWATER, TO CLARIFY THE DEFINITION OF
SECONDHAND DEALER; TO EXPAND THE REQUIREMENTS
AS TO THE RE LISTER TO BE KEPT BY SECONDHAND
DEALERS;. PROVIDING FOR THE REPEAL OF ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH;
PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED
ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA:

Section 1. That Section 79. 01, Definitions, of Article I, Generally,
of Chapter 79, Secondhand Goods, of Title VII, Businesses and Business
Regulations, of the Code of Ordinances, City of Clearwater, is amended by
amending the definition for "Secondhand dealer" to read as follows:
Secondhand dealer shall mean any person engaged in
the business of purchasing axWor•-selling, -tradkriL-or`
reeeiNi`ng-en-oonaigxxxent bartering and/or consigning
goods of any kind or description having once been used
or transferred from the manufacturer to the dealer and
then received into the possession of third parties whether
same consists of clothes, carpets, clothing, rags, iron
or other metals, furniture or articles of household utensils,
or articles of personal use, or male or female wearing
apparel, or of jewelry of any kind or description or of old
gold and silver.
Section Z. That Section 79. OZ, Register-- To be kept; information
to be shown; inspection by police, of Article I, Generally, of Chapter 79,
Secondhand Goods, of Title VII, Businesses and Business Regulations, of
the Code of Ordinances, City of Clearwater, is hereby amended to read
as follows:
Sec. 79.02. Register--To be kept; information to be
shown; inspection by police.
Any person conducting an auction house or engaged in
busint'ss as a pawnbroker, junk dealer or secondhand
dealer shall keep a register in connection with such
business, and at the close of business on each day or
not later than 8:00 A. M. of the succeeding day, shall
enter or cause to be entered therein, by printing or typing
an accurate description of the person from whom any
article of'personal property is purchased or received, or

to wham any loan is made upon personal property, and shall
include in such description the name, age, sex, color,
nationality and place of residence and driver's license number
of such person, and in st-A register shall also be entered an
accurate description of any article of personal property so
purchased or received, or upon which a loan is made, and
such description shall contain any mark, number, brand,
monogram, words or letters blown, stamped, etched or
otherwise perm:.nently marked upon such article, and all
articles so purchased or received shall be so arranged in
stock as to enable the same to be inspected by the police
department or any other person in authority; and the register
shall at all times be kept open for the inspection and examination
of the chief of police or any person authorized by the chief of
police'to inspect the same.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.

Section 4. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
j the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section S. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166. 041, Florida Statutes.
Section"6. The provisions of this ordinance shall take effect
immediately upon its passage.
