ORDINANCE NO. 2446-81 0 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING THE CAPITAL IMPROVEMENT PROGRAM REPORT AND BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER I, 1980 AND ENDING SEPTEMBER 30, 1981, TO REFLECT AN EXPENDITURE INCREASE OF $1,051,351 TO EXPAND THE SCOPE OF PROJECTS IN THE FUNCTIONAL CATEGORIES OF STORM DRAINAGE, RECREATION, MARINE FACILITIES, GENERAL PUBLIC BUILDINGS, AND SEWER SYSTEM; TO REFLECT A REDUCTION OF BUDGETED EXPENDITURES OF $104,166 RETURNING THE FUNDS TO THE ORIGINAL FUND SOURCE; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the Capital Improvement Program Report and Budget for the fiscal year beginning October I, 1980 and ending September 30, 1981 was adopted in accordance with Chapter 41 of the Clearwater Code and Federal Revenue Sharing, by Ordinance No. 2206 and amended by Ordinance 2384-81; WHEREAS, unanticipated needs necessitate an increase in expenditures of the following: Storm Drainage $261,916; Recreation $55,000; Marine $546,435; General Public Buildings $55,379; Sewer System $30,000; and WHEREAS, funds of $1,051,351are available to finance these needs through use of Bridge Revenues, Gas Revenues, Utility System Renewal and Replacement Fund, Special Development Fund, Special Program Fund, and contributions from property owners; and WHEREAS, Section 41-08 of the Clearwater Code authorizes the City Commission to provide for the expenditures of moneys for proper purposes not , contained in the budget as originally adopted due to unforeseen circumstances or emergencies arising during the fiscal year; t NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER: Section I. That Section of Ordinance No. 2384-81 is hereby amended to read as follows: That the Third Quarter amended Capital Improvement Program Report and Estimated Budget for the fiscal year beginning October I, 1980 and ending September 30, 1981, a copy of which is an file with the City Clerk, Is hereby received. Pursuant to that report, the City Commission hereby adopts a Third Quarter amended budget for capital improvements for the City of Clearwater, a copy of which is herewith attached and marked Exhibit A." Ord-12446-02- 9]17J81 Section 2. Should any section, paragraph, sentence, phrase, clause or other part or provision of this ordinance be declared by any Court to be irivalid, the some shall not affect the validity of the ordinance as a whole or any part thereof, other than the part declared to be invalid. Section 3. All ordinances or parts of ordinances in conflict herewith or inconsistent with the provisions of this ordinance are hereby repealed to the extent of their conflict. Section 4. Notice of the proposed enactment of this ordinance has been properly advertised In a newspaper of general circulation in accordance with Section 166.441, Florida Statutes. Section S.'
