r ORDINANCE NO. 2434-81 AN ORDINANCE AMENDING THE ZONING ATLAS OF THE CITY OF CLEARWATER, FLORIDA, 1981, AS AMENDED, BY RECLASSIFYING AND ZONING CERTAIN PROPERTY AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO- VIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PRO- POSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, on June 18, 1981, the City Commission of the City of Clearwater, after proper public notice, held a public hearing on certain proposed changes to the zoning atlas of the City of Clearwater in accordance with procedure as established; and WHEREAS, certain of the proposed changes and amendments to the zoning atlas were approved by the City Commission after its evaluation of all evidence presented at the said public hearing; and WHEREAS, the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency•(LPA) for conformance with plars adopted pursuant to the LGCPA; and WHEREAS, the Pinellas County Planning Council (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC , has adopted guidelines with reference to each required referral process; and WHEREAS, this Ordinance has been referred to and considered by the PCPC under said process. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: f Section 1. The following described property in Clearwater, Florida, is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas of the City of Clearwater, Florida of 198111, as amended, is amended to.indicate that fact as her einafter set out: i'i• Zoned CP - Parkway Business District A tract of land lying in the NE 1/4 of Section 19, Township 28 South, Range 16 East, Pinellas County, Florida, and being more particularly described as follows; Commence at.the North 1/4 corner of said Section 19; thence S 0°00'4911 E along the North-South centerline of said Section 19, also being the centerline of U, S. Highway No, 19 (S. R. 55), for 1360.98 feet; thence N 89°56'33" E for 100.00 feet to the P. O. B. , said point being on the Easterly right-of-way line of said U. S. Highway No. 19, said right-of-way being 200. 00 feet in width; thence N 0°00149" W along said right-of-way line, for 894. 26 feet, to the point of curvature of a curve concave to the Southeast; thence Northeasterly along the arc of said curve having a radius of 25. 00 feet and a central angle of 90°38'56" for 39. 55 feet, to the point of compound curvature of a curve concave to the Southwest, said point being on the Southerly right-of-way line of Northside Drive, as recorded in Plat Book 78, pages 11 and 12, of the Public Records of Pinellas County, Florida, said right-of-way being 100. 00 feet in width; thence Southeasterly along the arc of said curve having a radius of 2232. 64 feet and a central angle of 11 °21153", for 442. 85 feet, to the point of tangency; thence continue along said right-of-way line of Northside Drive S 78°00'0011 E for 36.08 feet; thence S 0°00'4911 E for 862.61 feet; thence S 89°56'33" W, for 500. 00. feet to the P. O. B. Section 2. The City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in conformance with the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. Section 3. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 4. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance: as a whole, or any part thereof other than the part declared to be invalid. Section 5. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance .with Section 166.041, Florida Statutes. Section 6. The Planning Director is directed to include and set out and show upon the official zoning atlas of the City of Clearwater the foregoing amendments as hereinabove set out. Section 7. The provisions of this ordinance shall take effect immediately upon its passage.
