AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING SECTION 40. 01, ADDITIONAL COURT COSTS ASSESSED FOR POLICE TRAINING, OF CHAPTER 40, IN GENERAL, OF TITLE IV, FINANCE AND TAXATION, OF THE CODE OF ORDINANCES, CITY OF CLEARWATER, TO PROVIDE FOR THE ASSESSMENT OF AN ADDITIONAL TWO (2) DOLLARS OF COURT COSTS UPON CONVICTION OF A STATE PENAL OR CRIMINAL STATUTE OR VIOLATION OF A MUNICIPAL OR COUNTY ORDINANCE, EXCEPT .CONVICTIONS RELATING TO PARKING, TO BE USED FOR CRIMINAL JUSTICE TRAINING PURPOSES; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDI- NANCES IN CONFLICT HEREWITH; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the State Legislature during its recent session, passed Senate Bill No. 103, which among other items amended Section 943. 25, Florida Statutes, to permit Cities to assess $2.00 as Court costs against parties convicted of violating municipal ordinances, except violations relating to parking of vehicles, for the purpose of police training; and WHEREAS, the City Commission wishes to bring its Code into compliance with Senate Bill No. 103; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section I. That Section 40. 01, Additional Court Costs Assessed for Police Training, of Chapter 40, In General, of Title IV, Finance and Taxation, of the Code of Ordinances; City of Clearwater, be and the same is hereby amended to read as follows: Sec. 40. 01. Additional court costs assessed for police training. Tht re is hereby assessed by the city, in compliance with F. S. § : 25 (5), (8), an additional eae-"14ar-(-$4,404 two dollars, (12.00) as court cost against every person convicted for violation of a state penal or criminal statute or a municipal or county ordinance in any proceedings, except for violations relating to parking of vehicles. Further, exe-"1-1ar-(44,4M two dollars 2. 00 shall be deducted from every bond estreature or forfeited bail bond related to such penal statutes or penal ordinances for any offense, except that relating to parking of vehicles. Such funds as levied and assessed as additional court r costs or taken from the bonds shall be used exclusively for Saw. en""e gent criminal justice education and trainingr including basic training, expenditures for members of the police department of the city, including law enforcement officers art time law enforcement officers, auxiliary officers and support ptrs_onnel. The use and expenditure of such funds shall be in accordance with training and education programs for such police personnel as established by the chief of police with the approval of the city manager. Section 2. All ordinances or parts of ordinances In conflict herewith or inconsistent with the provisions of this ordinance are hereby repealed to the extent of their conflict. Section 3. Should any section, paragraph, sentence, phrase, clause, or other part or provision of this ordinance be declared by any court to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof, other than the part declared to be invalid. Section 4.
