, r 0 ORDINANCE NO. 2430-81 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING ORDINANCE NO. 2019, RELATING TO THE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN, TO CHANGE THE LAND USE DESIGNATION FOR CERTAIN REAL PROPERTY WITHIN THE CITY OF CLEARWATER; PROVIDING FOR REPEAL OF CONFLICT]NG ORDINANCES; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PRO- VIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to the LGCPA; and WHEREAS, the Pinellas County Planning Council (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to such required referral process; and WHEREAS, this Ordinance has been referred to and considered by the PCPC under said process; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Pursuant to the provisions of the Local Government Comprehensive Planning Act, 1975, as amended, and pursuant to all applicable provisions of law, Section 1 of Ordinance No. 2019 is amended by placing the hereinafter described property in the land use category as follows: Pro er (L. U. P. 80-71) The SE 1/4 of the NE i/4 of Section 17, Township 29 South, Range 16 Fast, LESS the West 447 feet, South 330 feet, the South 20 feet of the East 363 feet and the East 33 feet of the remaining parcel for Bay- view'Avenue right-of-way, further described as follows: Commence at the SE corner of the SE 1/4 of the NE 1 /4 of the said Section 17 and run thence S 89°46'01.4" W, 33.00 feet; thence along the westerly right-of-way line of Bay-view Avenue N 00 a 37102.611. Z, 350.04 feet for a P. O. B. ; thence run S 89 °46'01.4" W, 330. 04 feet; thence S 00°37'02.6'1 W, 20.00 feet; thence S 89°46101.4" W, 570. 12 feet; thence N 00°08115.7" E, 994.97 feet; thence S 89° 57125. 511 E, 908.44 feet to the westerly Land Use Category From; Low Density Residential To: Commercial/ Tourist Facility ORDINANCE ... ` 3..-.gr, ...... 9-1 a right-of-way line of Bayview Avenue; thence along the said right-of-way line, S 00'371 02.6" W, 970. 69 feet to the P. O. B., together with abutting streets. Section 2,:- The City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in conformance with the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. Section 3. All ordinances or parts of ordinances in conflict herewith are to the extent. of such conflict hereby repealed. Section 4. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section S. The provisions of this ordinance shall take effect immediately upon its passage.
