ORDINANCE NO. 2424-81
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING
TITLE V, UTILITIES, OF THE CODE OF ORDINANCES, CITY OF
CLEARWATER, TO INCREASE THE RATES FOR THE COLLECTION OF
GARBAGE AND TRASH; PROVIDING FOR THE SEPARABILITY OF THE
PROVISIONS HEREOF; PROVIDING FOR THE REPEAL OF ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR
NOTICE OF THE PROPOSED ENACTMENT; AND PROVIDING FOR AN
EFFECTIVE DATE FOR THIS ORDINANCE.
WHEREAS, the current sanitation rates have been effective since'
August 21, 1980; and
WHEREAS, the Commission has anproved substantial transfers
from the water division to subsidize the deficits of the sanita-
tion division operation and;
WHEREAS, projected cost increases in the sanitation division
as well as in the water division are causing a rate deficiency
in the water division,'
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That subparagraph 4, Garbage and Trash Rates
of subsection (e), Rats, of Section 50.05, Deposit fees, Service
charges and Rate schedule, of Chapter 50, General, of Title V,
Utilities, of the Code of Ordinances City of Clearwater, is
hereby amended to read as follows:
(4). Garbage and Trash Rates.
a. Monthly charges for twice weekly collection of
garbage and/or trash in prescribed containers:
1. For duplex dwellings and single-family?dewl-
lings including one additional apartment or
living unit as part of or detached from the
single-family building and under one owner-
ship:
i. Curbside pickup:. Five-doZlaFS-a?ad-#.£t
Gents-445,50)-Six dollars and ninety cents
6.90 minimum for each living unit with
no limit on the number of garage recep-
tacles permitted per unit.
ii. Side or rear building collection: Eleven
4e11aFs-4411,.003. Thirteen dollars and eighty
cents ($13'.80) minimum for each living unit
with a limit of two (2) garbage receptacles
permitted per.unit. A fee of three-dallaFs

and sixty-cents ( 4.60) each will be charged
for each additional twenty (20) gallon can or
equivalent.

2. For multiple family dwelling consisting of three
(3) or more living units, which units may be a
part of or detached from the main building; all
garbage receptacles serving the premises to be
centrally located at one collection point:
i. Curbside pickup:
First unit $6,50 6.90 minimum
Next nine (9) units 2-r67. 3.22 per unit
All over ten (10) units 2,A2 3.00 per unit
ii. Side or rear building collection:

iii. Commercial containers: In accordance with
schedule in subsection 3 _Ue (4) b.4 of this section.
Apartment houses and trailer courts or parks containing
thre-e (3) or more living units shall be classed as
multiple family dwellings.
3. For-motels, apartment motels, or apartments renting
by day or week:
All garbage receptacles serving the premises to be
centrally located at one collection point.
i. Curbside pickup:

5. For commercial buildings of all types such as stores,
hotels, factories, filling stations, service establish-
ments and the like with separate water metering; for
twice weekly collection:
i. Curbside pickup: $5,50 $6-90 minimum
ii. Side or rear building collection:
One or two (2) cans ?I,AA 1380 minimum

6. ,For each building containing four (4) or-more separate
• offices and one common water meter for physicians,
'. dentists, dental repair facilities,lawyers, real estate

other similar or related businesses, the owner of the
premises served shall be responsible to the city for a
monthly garbage collection charge of.:

Special fees: Any hydraulically or otherwise compacted
garbage, trash, etc. collected by the City sanitation
department shall be paid fcr at a rate four (4) times
the amount listed on the fee sheet for regular collection.
c. Fees for collecting contents from any rubbish or trash
. bin or storage room shall be set by the sanitation super-
intendent at triple the rate charged for the cubic yard
' container nearest, but not smaller than, the size of the

charge for collecting such loose trash, other than
that placed for curbside collection, shall be at the

Section 2. Should any section, paragraph, sentence or word of this
i ordinance be declared for any reason to be invalid, the same shall not
affect the validity of the ordinance as a whole, or any part thereof
other than the part to be declared to be invalid.
Section 3. All ordinances or parts of ordinances in conflict herewith
are-to the extent of such conflict hereby repealed.
Section 4. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
Section 5. This ordinance shall become effective immediately upon
its passage.

twice weekly collection:

offices and one common water meter for physicians,

other similar or related businesses, the owner of the
premises served shall be responsible to the city for a
monthly garbage collection charge of:

the amount listed on the fee sheet for regular collection.
c. Fees for collecting contents from any rubbish or trash

intendent at triple the rate charged for the cubic yard
container nearest, but not smaller than, the size of the

Where neither containers nor bins are used, the

Section 2. Should any section, paragraph, sentence or''word of this
ordinance be declared for any reason to be invalid, the same shall not
affect the validity of the ordinance as a whole, or any part thereof
other than the part to be declared to be invalid.
Section 3. All ordinances or parts of ordinances in conflict herewith
are-to the extent of such conflict hereby repealed.
Section 4. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
Section S. This ordinance shall become effective immediately upon
