ORDINANCE NO. 421-81
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING TITLE V, UTILITIES, OF THE CODE OF ORDINANCES,
CITY OF CLEARWATER, TO INCREASE THE WATER RATE,PRO-
VIDE FOR A PASS THROUGH OF INCREASED COSTS OF WHOLE-
SALE WATER, AND TO ADJUST THE NONRESIDENTIAL-SEWER
RATE SUCH THAT NO INCREASE WILL OCCUR DUE TO THE WATER
RATE INCREASE; PROVIDING FOR THE SEPARABILITY OF THE
PROVISIONS HEREOF; PROVIDING FOR THE REPEAL OF ORDI-
NANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH;
PROVIDING FOR NOTICE OF PROPOSED ENACTMENT; AND PRO-
VIDING FOR AN EFFECTIVE DATE FOR THIS ORDINANCE.
WHEREAS, the current water rate has been effective since
October 21, 1974; and
WHEREAS, the wholesale rate for water has increased 48%
since the current rate was established, and a further 17% increase
in the wholesale rate is proposed; and
WHEREAS, an increase in the City's water rates will also
increase the nonresidential sewer rate, which is not intended
at this time;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That subparagraph 1 of subsection e, Rates, of
Section 50.05, Deposit, fees, service charges and rate schedule,
of Chapter 50, in General, of Title V, Utilities, of the Code
of Ordinances of the City of?Clearwater, is hereby amended to .
read as follows:
(1) Water rates for all water furnished by the city utilities
department,u.nder the different schedules shall be as
-' follows:
a. Domestic (stores, offices, hotels, motels, multiple
and single-family residential premises and general
business establishments) rates shall be the following
based on monthly consumption:
1. Consumption charge: First four hundred (400)
cubic feet or less, a minimum of Uwe-dollars
aael-seveat-use-eeae-{??,.??}- three dollars
and forty-one cents _(53.41) per month. All
over allowance, sy-hae-?iuad?edtt?s-?AT?3}
seventy-eic_rht hundredths (0.78) per one hundred
(100) cubic feet.
2. Minimum bills. For each customer billed under
the domestic rate schedule there shall be a monthly
minimum charge based on the size of the meter,
which minimum charge will allow and include the
use of certain quantities of water as listed
hereunder, but for the consumption of water in
excess of said allowance the customer shall be
filled for the excess at the domestic consumption
charge listed above.

b. Industrial Rates, applying to customers using water in their
normal activities for production or processing such as groves,
laundries, mills, factories, ice plants, refrigeration plants,
and similar establishments from past records or future ex-
perience and information that the average monthly consumption
of the industrial rate customers have or will exceed three
thousand (3,000) cubic feet per month over any three (3) month
period, shall be as follows, based on monthly consumption:
1. Consumption charge: S#xty-thee-eet?s-4A,68} SeventV_-
eight cents (50.78 per one hundred (100) cubic feet for
all water used over allowance.
2. Minimum bill. For each customer billed under the industrial
rate schedule there shall be a monthly minimum charge
based on the size of the meter, which minimum charge will
allow and•include the use of certain quanities of water as
listed hereunder, but for the consumption of water in ex-
cess of the allowance the customer shall be billed for the
excess at the industrial consumption charge listed above:

c. Lawn water meters. Lawn water meters already in service
shall be charged the regular domestic rate for water used for
irrigation purposes in accordance with the ordinances of the
city. When combined with the domestic meter on the same bill,
the rate shall be at sly-thee-Bents--48,63 Seventy-eight
cents ($0.78) per one hundred (100) cubic feet. When on a
separate bill, the rate will be charged the regular domestic
rate depending on the size of the meter.
d. Service out of municipal limits: Accounts outside of the
corporate limits of the city shall be subject to a surcharge
equal to twenty-five (25) per cent of the monthly water bill
charges as set forth in subsections a and b above.
e. A charge of the "monthly minimum" for a one-and-one half (1')
inch water meter is required for a "deduct" meter for air
conditioning cooling water and similar purposes. (This is to
omit the sanitary seWer'6hazge for this consumption.) This is
only where a separate irrigation meter cannot be set in the
right-of-way or easement and the meter reader must physically
read and•deduct consumption for billing purposes,

,section 2. That paragraphs (a) (1) and (a) (2) of sub-
paragraph (3), Sewer rates, of Subsection (e), Rates, of Section
50.05, Deposit, Fees, Service Charges and Rate Schedule, of Chapter
50, In General, of Title V, Utilities, of the Code of Ordinances,
City of Clearwater, be and the same is hereby amended to read as
follows t
1. Residential: Single-family residences, duplexes,
multi-family residences, apartments, mobile home
parks and condominiums: A monthly faxed charge of
four dollars twenty-five cents ($4.25) per unit per
month, plus a charge of twenty-five cents ($0.25)
per one hundred (100) cubic feet of water used.
Hotels, motels.and travel trailer parks shall be
billed at eAe-i??ta?ed-sixty-?6A} One hundred and
twenty-nine.(129) per cent of the domestic monthly
water charge, with a minimum fixed charge of four
dollars twenty-five cents ($4:25).
2. Nonresidential (including commercial, office buildings
and industrial buildings): The basic charge for all
accounts shall be equal to gAe-hunded»$iKy-{?b0}
per-een% One hundred twenty-nine 129 er cent of
the monthly water bill in effect for that size meter.
However., the minimum fixed charge for nonresidential
accounts shall be four dollars twenty-five cents ($4.25).
Section 3. Should any section, paragraph, sentence or word
of this ordinance be declared for any reason to be invalid, the same
shall not affect the validity of the ordinance as a whole, or any
part thereof other than the part declared to be valid.
Section 4. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.
Section 5. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation in
accordance with Section 166.041, Florida Statutes.
Section 6. This ordinance shall become effective immediately
upon its passage.
