2415-81`W) 031 ORDINANCE NO. 2415-81 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING ORDINANCE NO. 2387-81, CHANGING THE HOURS WHEN THE RESTRICTION RELATING TO WATER USAGE WILL APPLY AND CHANGING THE ACTIVITIES TO WHICH THE RESTRICTION ON THE USES OF WATER WILL APPLY; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; DECLARING THAT A PUBLIC EMERGENCY EXISTS AFFECTING THE HEALTH AND WELFARE OF THE CITIZENS OF THE CITY OF CLEARWATER; AND PRO- VIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, on May 27, 1981, the City Commission of the City of Clearwater, Florida, passed Ordinance No. 2387-81 placing in effect certain restrictions on the use of water; and WHEREAS, the Southwest Florida Water Management District has now further considered the restriction on the usage of water and the original cutback in the use of water has been reduced to fifteen (15) percent; and WHEREAS, because of the change in restriction by the Southwest Florida Water Management District, the City Commission can now further change the restrictions it has placed on the usage of water; and WHEREAS, an emergency exists within the City cf Clearwater in that it is necessary to amend these previously enacted restrictions and t. thereby make available to the general public the use of water on a more liberalized basis thereby preserving the health, safety and welfare of the citizens of the City of Clearwater; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The following nonessential uses of water shall be restricted or curtailed during the existence of a water shortage or water shortage emergency: 1. Sprinkling, watering or irrigating of shrubbery, trees, lawns, grass ground covers, plants, vines and gardens shall be prohibited during the hours of 8:00 A. M. to B.-()O . The washing of sidewalks, driveways, porches, exterior of homes, apartments or other outdoor surfaces shall be limited to use of water from pails, buckets or other containers. ;4. The washing of business or industrial equipmext and machinery, except as required for public health onto avoid direct- damage to such equipment or machinery, shall be prohibited. 5. The operation 'of any outdoor ornamental fountain or other structure using water with or without a recirculating system shall be discontinued. 6. The filling of swimming pools and wading pools not using a filter and recirculating system is prohibited. Water shall not be used for dust control, except as required for public health. Section 2. All ordinances or parts of ordinances in conflict herewith s herewith are to the extent of such conflict hereby repealed. Section 3. In the event that any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 4. This ordinance is adopted as an emergency ordinance pursuant to Section 166. 041, Florida Statutes, and the Clearwater City Charter. Section 5. No water service shall be furnished to any person in the City unless the person agrees to accept all the provisions 'contained in this ordinance. The acceptance of water service shall be in itself the acceptance of the provisions herein. Section 6. It is hereby found, determined and declared that this ordinance is necessary and urgently needed for the preservation of the welfare of the citizens and inhabitants of the City of Clearwater, Florida, in that passage of this ordinance is required in order to implement the revised declaration by the Southwest Florida Water Management District of a water shortage or water shortage emergency which orders the cur- tailment or restriction of certain uses of water; by reason of such fact an emergency is hereby declared; and that this ordinance shall be in full -3- Ord #2415-81 7/2/81 force and effect immediately upon its passage.. This ordinance shall automatically expire ninety (90) days from the date of its passage unless the ordinance. Is submitted during such time for consideration as a non-emergency ordinance.
