AN ORDINANCE OF THE CITY OF CLEAR WATER,
FLORIDA, REPEALING THE PROVISIONS OF SECTION
42, 05 OF CHAPTER 42, PURCHASING OF THE CODE
OF ORDINANCES, CITY OF CLEARWATER, AND
ENACTING A NEW SECTION 42. 05 TO CHANGE THE
PROCEDURE WHEREBY REQUESTS ARE MADE TO
PURCHASE COMMODITIES; PROVIDING FOR THE
SEPARABILITY OF THE PROVISIONS HEREOF; PRO-
VIDING FOR PROPER NOTICE OF PROPOSED ENACT-
MENT; AND PROVIDING FOR THE EFFECTIVE DATE
OF THIS ORDINANCE.
WHEREAS, it is necessary to amend the purchasing code of the
City of Clearwater to provide a new procedure for the submittal of
requisitions;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA;
Section 1. That the provisions presently contained in Section 42. 05,
Submittal of requisitions; department directors' signatures, of Article I,
In General, of Chapter 42, Purchasing, of the Code of Ordinances,. City
' of Clearwater, be and the same are hereby repealed.
Section Z. That new Section 42. 05, Submittal of Requests to
Purchase Commodities of Article I, In General, of Chapter 42, Purchasing,
of the Code of Ordinances, City of Clearwater, be and the same is hereby
enacted to read as follows;
"Section 42.05. Submittal of Requests to Purchase
Commodities.
Departments shall submit requests to purchase commodities
to the purchasing agent, or his representative, on purchase
requisition forms or by other means as may be prescribed
by the purchasing office. The Department D'irector's
signature, or the signature of his designated representative,
on the requisition indicates that funds are available for the purchase;
that the requisition has been coordinated and approved within
that department or other department(s) as necessary; that the
quantities, item descriptions and specifications described the
minimum needs of that department; and that the purchasing
agent, or his representative, is authorized to acquire the
commodities. The final voucher authorizing the expenditure
of funds shall be signed by the purchasing agent or his
representative. "

Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid. "
Section 4. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166. 041, Florida Statutes.
Section 5r The provisions of this ordinance shall take effect
immediately, upon its passage.
