2388-81ORDINANCE NO. 2388-8I AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING ORDINANCE NO. 2387-81 AS TO SECTION 5 THEREOF TO CORRECT THE FINE SCHEDULE CONTAINED THEREIN; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; DECLARING THAT A PUBLIC EMERGENCY EXISTS AFFECTING THE HEALTH AND WELFARE OF THE CITIZENS OF THE CITY OF CLEARWATER; AND PROVIDING FOR TI3E EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the City Commission of the City of Clearwater passed Ordinance No. 2387-81 on May 27, 1981, as an emergency ordinance, finding that a water shortage exists because a water shortage or water shortage emergency has been declared by the Southwest Florida Water Management District which includes the City of Clearwater; and WHEREAS, it is necessary to correct the fine schedule contained in Ordinance No. 2387-81 to be the same as the County Court fine schedule as set forth for all municipalities; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That Section 5, Penalties, of Ordinance No, 2387-81 which was passed by the City Commission on May 27, 1981, be amended to read as follows: "Section 5. Penalties. Violation of any provision of this ordinance shall be subject to the following penalties: First violation $25,99 27.00 Second'vio-la-titer and Subsequent 5 Violations $69r99 Mandatory Court. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 3. In the event that any section or provision of this ordinance < or any portion thereof, any paragraph, sentence, or word be declared by a SEE ORDINANCE ?.................. Ord- #2388-81 611/81 court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 4. This ordinance is adopted as an emergency ordinance pursuant to Section 166. 041, Florida Statutes, and the Clearwater City Charter. Section 5. It is hereby found, determined and declared that this ordinance is necessary and urgently needed for the preservation of the welfare of the citizens and inhabitants of the City of Clearwater, Florida, in that passage of this ordinance is required in order to completely implement the declaration by the Southwest Florida Water Management District of a water shortage or water shortage emergency which orders the curtailment or restriction of certain uses of water; by reason of such fact an emergency is hereby declared; and that this ordinance shall be in full force and effect immediately upon its passage. This ordinance shall automatically expire ninety (90) days from-the date of its passage unless the ordinance is submitted during such time for consideration as a non-emergency ordinance.
