2387-81 ORDINANCE NO. 2387-81 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, RESTRICTING ArM CURTAILING'CERTAIN NONESSENTLA.L USES OF WATER AND CONSERVING AVAILABLE WATER RESOURCES DURING A DECLARED WATER SHORTAGE AND WATER SHORTAGE EMERGENCY; DEFINING THE TERMS PERTAINING THERETO; PROVIDING FOR APPLI- CATION OF ORDINANCE; PROVIDING FOR ENFORCEMENT AND PENALTIES; PROVIDING FOR EXCEPTIONS AND APPEAL PROCEDURE; PROVIDING FOR THE SEPARA- BILITY OF THE PROVISIONS HEREOF; DECLARING THAT A PUBLIC EMERGENCY EXISTS AFFECTING THE HEALTH AND WELFARE OF THE CITIZENS OF THE CITY OF CLEARWATER; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, a water shortage or water shortage emergency has been declared by the Southwest Florida Water Management District; and WHEREAS, during said times of water shortage the level of water shortage and groundwater supplying the City may become perilously low; and WHEREAS, water shortage conditions may contribute to the, impact of saline water intrusion; and WHEREAS, the existence of said conditions make it imperative to the public well being that certain nonessential uses of water be restricted or curtailed and that available water resources be conserved; and WHEREAS, the Southwest Florida Water Management District, a public corporation of the State of Florida, charged with the responsibility of the protection of the water resources within the District, so as to realize their full beneficial use, has declared a water shortage or water shortage emergency and has ordered the curtailment or restriction of certain uses of water; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Definitions. For the purpose of this ordinance the following terms, phrases, words and their derivations shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the SEM ?0=1NANCL .. .. # ?r.'...:.4.;..??1 ..................s .. The word "shall' is always mandatory and not merely directory. (a) "City" is the City of Clearwater, Florida. (b) "Water Shortage" or "Water Shortage Emergency" is the declaration of such by the Governing Board of the Southwest Florida Water Management District Pursuant to Chapter 173, Fla. Statutes. (c) "Water" is water taken from any groundwater system, well, surface water system or public water supply. Section 2. Application. _ The provisions of this ordinance shall apply to all customers of' the City, of Clearwater system, including persons both within the corporate limits and those outside the corporate limits but within the service district. Section 3. Implementation. (a) Authority to Implement. The City finds that a water shortage exists because a water shortage or water shortage emergency has been declared by the Southwest Florida Water Management District which includes the City of Clearwater, Florida. (b) Restriction or Curtailment of Water Uses. The following nonessential uses of water shall be restricted or curtailed during the existence of a water shortage or water shortage emergency: 1. Sprinkling, .watering or irrigating of shrubbery, trees, lawns, grass ground covers, plants, vines and gardens shall be prohibited during the hours of 8;00A. M. to 8:00 P.M. At other.hours, sprinkling, watering or irrigating shall be permitted only: a. For property having an odd-numbered street address, only after 8:00 P.M. on odd-numbered days and then from mid- night to 8:00 A. M. on the next day. b. For property having an even-numbered street address, only after 8:00 P.M. on even-numbered days and then from mid- night to 8;00 A. M. on the next day. Ord #2387-81 -2- 5/27/81 ' . r W 0 2. The escape of water ,hrough defective plumbing, which means to knowingly allow water to escape through a system that is in disrepair, shall be prohibited. 3. The washing of sidewalks, driveways, porches, exterior of homes, apartments or other outdoor surfaces shall be limited to use of water from pails, buckets or other containers. 4. The washing of business or industrial equipment and machinery, except as required for public health or to avoid direct damage to such equipment or machinery, shall.be prohibited. 5. The operation of any outdoor ornamental fountain or other structure using water with or without a recirculating system shall be discontinued. 6.. The filling of swimming pools and wading pools not using a filter and recirculating system is prohibited. 7. There shall be no washing of automobiles, trucks, trailers, railroad cars, mobile homes, campers, boats or any other type of mobile equipment, except by a business duly licensed for such purpose. 8. Water shall not be used for dust control, except as required for public health. Section 4. Enforcement. Every police officer of the City shall in connection with all other duties imposed by law, diligently enforce the provisions of this law. Section S. Penalties. Violation of any provision of this ordinance shall be subject to the following penalties. First violation $25.00 Second violation $50.00 Third violation and subsequent violations $500.00 for each offense as provided in Section 1. 08 of the Code of Ordinances -3- Ord #2387-81- 5/27/81 , , ."? . a Section 6. Exceptions and A peals. The City shall have authority to permit exceptions, to maintain adequate health and sanitation standards and to grant relief from extraordinary hardship, The Utilities Director is hereby delegated authority to grant exceptions, but no exception shall be granted unless the Utilities Director'is persuaded that the applicant is suffering extreme hardship, different in kind as well as degree from the hardship suffered by other persons. In the event that any applicant can demonstrate that crops, trees, or other valuable vegetation or other valuable prpperty are uniquely threatened by the provisions of this ordinance, the Utilities Director is empowered to grant an exception; provided, however, that the exception will still restrict the applicant to conserve water to the maximum practical constraint; and provided further that in the event the Utilities Director finds that the granting of such an exception would endanger the health, safety, or welfare of other citizens, no such exception may be granted. Any person aggrieved by the decision of the Utilities Director may appeal his decision to the City Commission, whale decision will be final; however, the decision of the Utilities- Director will not be overturned absent a finding of abuse of discretion. Section 7. An ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 8. In the event that any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect ., the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 9._ This ordinance is adopted as an emergency ordinance pursuant to Section 166. 041, Florida Statutes, and the Clearwater City : Charter. -4- 5/27/.81 Section 10. No water service shall be furnished to any person in the City unless the person agrees to accept all the provisions contained in this ordinance. The acceptance of water service shall be in itself the acceptance of the provisions herein. Section 11. It is hereby found, determined and declared that this ordinance is necessary and urgently needed for the preservation of the welfare of the citizens and inhabitants of the City of Clearwater, Florida, in that passage of this ordinance is required in order to implement the declaration by the Southwest Florida Water Management District of a 'Water shortage or water shortage emergency which orders the curtailment or restriction of certain uses of water; by reason of such fact an emergency is hereby declared; and that this ordinance shall be in full force and effect immediately upon its passage. This ordinance shall automatically expire ninety (90) days from the date of its passage unless the ordinance is submitted during such time for consideration as a non-emergency ordinance.
