ORDINANCE NO. 2370-81
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING CERTAIN RIGHTS-OF-WAY ABUTTING BLOCK A,
WESTOVER SUBDIVISION, PINELLAS COUNTY, FLORIDA;
PROVIDING FOR PROPER NOTICE OF PROPOSED ENACT-
MENT; AND PROVIDING FOR THE EFFECTIVE DATE OF
THIS ORDINANCE.
WHEREAS, it has been requested by Morton F. Plant Hospital,
owner of certain real property in Westover Subdivision, in the City of
Clearwater, Florida, that the City of Clearwater, Florida, vacate certain
rights-of-way; and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said rights-of-way are not necessary nor
required for municipal use and it is deemed to be to the best interest and
advantage of the City and the general public that the same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the following:
That portion of Watkins Road lying within the City of
Clearwater abutting Block A, Westover Subdivision,
according to the map or plat thereof as recorded in
Plat Book 18, page 25' of the Public Records of Pinellas
County, Florida;
and
That portion of Sheridan Avenue lying East of Block A,
Westover Subdivision, according to the map or plat thereof
as recorded in Plat Book 18, page 2.'5 of the Public Records
of Pinellas County, Florida;
be and the same is hereby vacated, closed and released, and the City of
Clearwater hereby quit claims and releases all of its right, title and
interest thereto to the persons, firms or corporations entitled thereto by
law, excepting as follows:
1 (a) that the City of Clearwater retain a twenty foot (201)
temporary utility easements on, over and below said
rights-of-way, ten feet (101) of either side where
j . the same now exist, for as long as said City of
Clearwater public utilities and utility lines exist,
or until such time as the owner of Lots 1 through
" 22, Block A, Westover Subdivision, as recorded
in Plat Book 18, page 25, of the Public Records
of Pinellas County, Florida, provides other easements
to the City of Clearwater incident to development of
such property, whereupon said temporary easement
shall'be cancelled and all rights therein shall revert
to the owners of the properties contiguous thereto; and

(b) That the City of Clearwater retains emergency vehicle
access over the Sheridan Avenue right-o£-way until such
time as the owner of Lots 1 through 22, Block A, Westover
Subdivision, as recorded in Plat Book 18, page 25, of
the Public Records of Pinellas County, Florida, provides
other emergency vehicle access incident-- to the development
of such property, whcreupon said temporary easement
shall be cancelled and all rights therein shall revert to
the owners of the properties contiguous thereto.
Section Z. That the City Clerk is hereby directed to record this
ordinance in the Public Records of Pinellas County, Florida.
Section 3. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
Section 4. This ordinance shall become effective immediately
upon its passage.
