ORDINANCE NO. 2367-81
AN ORDINANCE AMENDING THE ZONING ATLAS OF THE
CITY OF CLEARWATER, FLORIDA, 1981, AS AMENDED,
BY RECLASSIFYING AND ZONING CERTAIN PROPERTY
AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ORDINANCES OF PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO-
VIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING FOR PROPER NOTICE OF PRO-
POSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on April 2, 1981, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning atlas of the City of Clearwater in accordance
with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to the
zoning atlas were approved by the City Commission after its evaluation of
all evidence presented at the said public hearing; and
WHERE1 S. the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments thereto
related to an adopted comprehensive plan or element thereof be reviewed
by the Local Planning Ageny (LPA) for conformance with plans adopted
pursuant to the LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the PCPC
has adopted guidelines with reference to each required referral process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA;
Section 1. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and "The Zoning
Atlas of the City of Clearwater, Florida of 198111, as amended, is amended
to indicate that fact as hereinafter set out:
Zoned as RPD-8 - Residential Planned Development with
Maximum of 8 Units Per Acre
That certain piece, parcel, or tract of land lying in and
being a part of the Northeast Quarter of Section 1, Township
29 South, Range 15 East, Pinellas County, Florida, and
being more particularly described as follows:

From the center of said Section 1, S 89`06151" E, and
along the South line of said NE 1/4, said linr, also being
the centerline of Sunset Point Road and/or State Road 588,
a distance of 1271.40 feet; thence run N 00.54' 10" E, a
distance of 50.07 feet to the North right-of-way of said road
and a P. O. B. ; thence continue N 00'54110 " E, and along
an Easterly boundary of Woodlake 1, a condominium, as
recorded in Condominium Plat Book 19, page 38, of the
Public Records of Pinellas County, Florida, a distance of
50. 06 feet; thence S 89'02' 33" E, and along a South boundary
of said Woodlake I, a distance of 132. 01 feet; thence N 00'
54133" E, and along an Easterly boundary of said Woodlake 1,
a distance of-260.03 feet; thence N 66'3615311 W, and along an
Easterly boundary of said Woodlake I, a distance of 70.95 feet;
thence N 12°22'19" E, and along an Easterly boundary of said
Woodlake I, a distance of 286.92 feet; thence S 89°17'5711 E,
a distance of 269.45 feet; thence S 00'30'2011 E, a distance of
619. 30 feet to the North right-of-way of aforementioned road;
thence N 89°06'54" W, and along said North right-of-way, a
distance of 408.21 feet to the P. O. B.
Section 2. The City of Clearwater does hereby certify that the
measures contained in this ordinance are consistent and in conformance
with the City's Comprehensive Plan and individual elements thereof adopted
pursuant to the LGCPA and directs that same be forwarded to the LPA for
their receipt and appropriate action.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part ther eof other than the
part declared to be invalid.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
Section 6. The Planning Director is directed to include and set out
and show upon the official zoning atlas of the City of Clearwater the foregoing

amendments as hereinabove set out.

Section 7. The provisions of this ordinance shall take effect
immediately upon its passage.
