AN ORDINANCE OF THE CITY OF CLEARWATER. FLORIDA,
AMENDING TITLE II, ADMINISTRATION, OF THE CODE
OF ORDINANCES, CITY OF CLEARWATER, -BY AMENDING
SECTION 22. 59, POWERS AND DUTIES OF THE AIRPORT
AUTHORITY, TO CLARIFY THAT THE AUTHORITY IS TO
MONITOR THE LEASE AS IT APPLIES AND GOVERNS BOTH
PARTIES; PROVIDING FOR THE SEPARABILITY OF THE
PROVISIONS HEREOF; PROVIDING FOR THE REPEAL OF
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR PROPER NOTICE OF PRO-
POSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, it was the intent of the City Commission in passing
Ordinance No. 2306-81 that the Authority created would monitor the entire
lease arrangement presently in existence; and
WHEREAS, that intent is stated in Section 22.59 (a) of the Code
of Ordinances; however, it is felt that such section needs clarification;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Section 22. 59, Powers and Duties of the Airport
Authority, of Article V, Airport Authority, of Title II, Administration,
of the Code of Ordinances, City of Clearwater, is hereby amended and
supplemented to read as follows:
Section 22. 59. Powers and Duties of the Airport Authority.
(a) The Airport Authority shall- have the power and duty to
monitor the lease operation of the Clearwater Executive
Airport, on behalf of the City of Clearwater, to ensure
compliance with all terms of the lease, as such terms
a 1 to either Lessor or Lessee.
(b) The Airport Authority shall be directly responsible to
the City Commission, particularly for recommending
appropriate City action regarding the following paragraphs
of the Lease Agreement:
Paragraph 10 Additional Improvements
Paragraph 11 Maintenance
Paragraph 13 Use of Premises
Paragraph 14 Nondiscrimination Use ?
Paragraph 15 Manner of Operation.
Paragraph 16 Prices
Paragraph 20 Operation of Facilities
(c). In monitoring the Lessee's Air Park operation, the
Airport Authority shall:
(1) Ensure that the airport is operated and maintained
in a safe and professional manner that is consistent
with the needs of the entire community;

(2) Ensure that the City Commission and staff is current
on all matters pertaining to the airport's operation
and development;
(3) Ensure that reasonable rules pertaining to the operation
,of the airport are developed, implemented and enforced;
(4) Hold public meetings between the aviation community
and the local residents in an effort to resolve matters
of mutual interest;
(5) Hold Authority meetings, at least one per month, to
conduct Authority business. These meetings shall be
open to the public with a period of time at the end of
each meeting set aside for public input.
(6) Make requests to the City Commission for City assistance,
whether financial, legal, or from other City Departments,
necessary to achieve the above described objectives.
9d) In monitoring the Lessor's obligations, the Airport Authority
shall prepare a written report containing its findin eland
recommendations resulting from such monitoring and
submit the same to the City Commission.
Section 2.' Should any part or provision of this ordinance be
declared by a court of competent jurisdiction to be invalid, the same shall
not affect the validity of the ordinance as a whole, or any part thereof
other than the part declared to be invalid.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 4. Notice of the proposed enactment of'this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
Section 5. This ordinance shall become effective immediately
upon its passage.
