AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING CHAPTER 140, MOBILE HOMES, OF THE CODE
OF ORDINANCES, CITY OF CLEARWATER, PROVIDING
FOR APPOINTMENT AND REMOVAL OF BOARD MEMBERS
BY THE CITY COMMISSION; PROVIDING THAT BOARD
CAN ACCEPT COMPLAINTS ABOUT RENTS AND MAKE
NON-BINDING RECOMMENDATIONS; PROVIDING THAT
BOARD SHALL MAKE FINDING REGARDING NECESSITY
FOR BINDING ARBITRATION PRIOR TO ITS TAKING
PLACE; PROVIDING FOR THE SEPARABILITY OF THE
PROVISIONS HEREOF; PROVIDING FOR THE REPEAL OF
ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR PROPER NOTICE OF PROPOSED
ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE
OF THIS ORDINANCE.
Section 1. That subsection (b), Composition, of Section 140. 22,
'Mobile Home Park Board, of Chapter 140, Mobile Homes, of the Code of
Ordinances, City of Clearwater, is hereby amended to read as follows:
(b) Composition. The membership of the Board shall
consist of seven (7) members, all of whom shall be
residents of the City of Clearwater. The membership
of the Board shall consist of two (2) mobile home park
owners, and two (2) mobile home park residents and
three (3) members at large to be appointed to the Board
by a majority vote of the City Commission. In the event

Section 2. That subparagraphs (3) and (4) of Subsection (d), Purposes,
duties and responsibilities, of Section 140.22, Mobile Home Park Board, of
Chapter 140, Mobile Homes, of the Code of Ordinances, City of Clearwater,
are hereby amended to read as follows;
(3) To review upon request the annual leases offered to
tenants by mobile home park owners as to the reason-
ableness of the terms of such leases and to determine .
the availability to the individual residents of an opportunity
to bargain with the park owner regarding the resident's
desires and the presence or absence of meaningful
negotiations between park owners `and park residents.
Rent or service charge disputes shall not be subject
to binding arbitration. However, the Board_ shall- accept.
written complaints _concerning rents or service charges, gather
information concerning the complaint, make findings of fact
and provide recommendations to the appropriate parties.
The acceptance of complaints and gathering of information
shall not confer power on the Board to control rent within
the mobile home parks`
(4) To _conduct hearings to resolve disputes between park
owners and park residents upon the written request of
either party. The Board shall&;I_ther information
_concerning the complaint(s), make findings of fact and
render a decision as to the necessity of binding arbitration
on the issue(s). If a decision is reached for binding
arbitration the Board shall submit in writing to the ark
owner and park resident outlining the issue(s), which shall
be subject to binding arbitration. Upon the decision of the
Board that binding arbitration is warranted, the arbitration
proceedings will be conducted using the Florida Arbitration
Code as set forth in Chapter 682 of the Florida Statutes. Appeal
by either party from the arbitration proceedings shall be that
provided in Section 682.20, Florida Statutes.
Section 33. Should any section, paragraph, sentence or word of this
ordinance be declared for any reason ti, be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the part
declared to be invalid.
Section 4. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section S. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
