2347-81:t 0 CQ ORDINANCE NO. 2347-81 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING ORDINANCE NO. 2019, RELATING TO THE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN, TO CHANGE THE LAND USE DESIGNATION FOR CERTAIN REAL PROPERTY WITHIN THE CITY OF CLEARWATER; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PRO- VIDING FOR THE EFFECTIVE DATE OF T141S ORDINANCE. WHEREAS, the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to the LGCPA; and WHEREAS, the Pinellas County Planning Council (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to such required referral process; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Pursuant to the provisions of the Local Government Comprehensive Planning Act, 1975, as amended, and pursuant to all applicable provisions of law, Section 1 of Ordinance No. 2019 is amended by placing the hereinafter described property in the land use category as follows: Property (L. U. P. 80-66) NE 1/4 of the NW 1 /4 of SE 1/4 of Section 14, Township 29 South, Range 15 East, subject to ease- ment for the following streets bounding said property: Gulf to Bay Boulevard on the North,' Keystone Avenue on the West, Turner Street on the South and Dtincan'Avenue on the East, more particularly described as: Begin at the NW corner of the NE 1/4 of the NW 1/4 of the SE 1/4 of Section 14, Township 29 South, Range 15 East, and `run thence S 88 °47' 0611 E along the 1 /4 section line, 17.25 feet; thence S 00° 02;2911 E, 50.0 feet to the South line of Gulf to Bay Boulevard and the Easterly line of Keystone Avenue for P. O. B.; ,thence continue S 00 ° 02' 29" E, along the East line of Keystone Avenue 584.95 feet to the North line of Turner Street; thence S 88°50116" E, 626.92 feet along the North line of Turner Street to the Weet line of Duncan'Avenue; thence N 01° 11146" W, 584.75. feet along the West -1- Ord #2347-81 Land Use Category From: Residential Office To: Commercial/ Tourist Facilities 4/2181 0 - a line of Duncan Avenue to the South line of Gulf to Bay Boulevard; thence N 88°47'06" W, 615. 15 feet along the South line of Gulf to Bay Boulevard, to the P. 0. B. LESS that portion of the above already designated Commercial/ Tourist Facilities. Section Z. The City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in conformance with the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. Section 3. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 4. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 5. The provisions of this ordinance shall take effect immediately upon its passage.
