2335-81 ORDINANCE NO. 2335-81 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING CHAPTER 131, ZONING, OF THE CODE OF ORDINANCES, CITY OF CLEARWATER, TO DELETE TRAVEL PARKS AS A SPECIAL EXCEPTION IN THE RM_ H DISTRICT AND TO PROVIDE TRAVEL PARKS AS A SPECIAL EXCEPTION IN THE CTF-24, CTF»28 AND CP DISTRICTS; TO REDUCE THE MINIMUM SIZE OF A TRAVEL PARK TO FIVE ACRES; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, on January 22, 1981, the City Commission of the City. of Clearwater, after proper public notice, held a public hearing on certain proposed changes to the Zoning Ordinance of the City of Clearwater in accordance with procedure as established; and WHEREAS, the City Commission has fully considered the recommendations and report of the Planning and Zoning Board relative to ' the certain proposed changes to the Zoning Ordinance; and WHEREAS, certain of the proposed changes and amendments to the Zoning Ordinance were approved by the City Commission after its evaluation of all evidence presented at the said public hearing; and WHEREAS, the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to the LGCPA; and WHEREAS, the Pinellas County Planning Council (PCPC) has been designated tixe Local Planning Agency for Pinellas County and the PCPC f. has adopted guidelines with reference to such required referral pracess; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA; SEE Onr,rk t erg ? r Ord 31233541 f 3119/81 e c Section 1. Section 131.099, Special exceptions, of Division 14, CTF-28, High Density Commercial-Tourist Facilities Use District, of Article III, District Regulations, of Chapter 131, Zoning, of the Code of Ordinances, City of Clearwater, is amended by enacting a new subsection (8) to read as follows: 8 Travel 12arks, see Article IV. Division 16, RMH, Mobile Home Park District, of Article III, District Regulations, of Chapter 131, Zoning, of the Code of Ordinances, City of Clearwater, is amended by amending Section 131. 112 and repealing Section 131.114 as follows: Section 131.112. General description. An RMH district is created in order to provide a restrictive area for mobile home parks, tpa?ve17-parks -and their related complimentary uses. Minimum park areas are established in order to guarantee spot zoning will not occur and that the park will be of adequate size to provide the park dweller with an identity similar to a residential neighborhood. The overnight type is usually located on or near major highways where the public can stop for one or two nights while enroute to some more distant destination. The destination type is usually located at or near a scenic, historic, or outdoor recreation area where the public is attracted for extended stays of several days or weeks; the destination type having more extensive facilities. JbL4d}A travel park meeting the required design and locational standards shall accommodate the traveling public for a defined maximum time period associated with the specialized vacation-recreation-transient characteristic of such development as contrasted to the more permanent and extended stay characteristics of a mobile home park. (2) Environmental requirements. E . ?a) General--condition of soil, groundwater level, drainage and topography shall not create hazards to the property or to the health and safety of the occupatns. (b) Soil and ground cover requirements and drainage re- quirements shall be in accordance to standards established by the office of the city engineer. (a) The minimum size of the eati4%e-r*ohAe4hon -L travel park shall be -fifteen-(444r.o4-whieh-not bas's-.than five'(5) acres ni&y4o-a-t44we-1-p&A. (b) The minimum width of the tit park shall be one hundred (100) feet at the front building setback line. (c) The minimum depth of the trait-park shall be two hundred (200) feet. (d) Front yard depth shall be at least forty (40) feet measured from a right-of-way line to the front of any structure or vehicle. (e) Side and rear yard depths shall be a minimum setback of fifteen (15) feet of any structure or vehicle. (f) With the exception of one hundred (100) feet for -entrances and exits on the major arteries, there shali'be provided along the entire periphery of the travel park a continuous visual buffer, a minimum he4it of six (6) feet, which shall be a compact foliage screening, or shall be a combined masonry or wooden fence and shrubbery screen; (4) Vehicle site requirements. (a) The minimum vehicle site area shall be two thousand (2, 000) square feet to serve for transient and/or destination parker. (b) For the purpose of determining vehicle site width and depth, the width of a vehicle site shall be measured at right angles to and between the designated side boundary lines. The depth of a vehicle site shall be measured at right angles to and between the designated front and rear boundary lines. (c) The minimum vehicle site width shall be twenty- five (z5) feet. (d) The vehicle site depth shall be sufficient to accommodate- any vehicle or vehicles (including both the towed vehicles and the towing vehicles) on each site, but in no case shall be less than forty (40) feet. (e) The maximum site density shall be t•er* 41 O9 twelve (12)_sites per gross net acre. (f) The minimum distance between recreational vehicles and any other structure shall be ten (10) feet between trailers or other structures or temporary accessory structures. Any temporary accessory structures such as attached awnings or other fabric enclosures shall, for the purpose of this separation requirement, be considered to be a part of the recreational vehicle ' or other structure. (g) Each vehicle site shall be clearly defined by a permanent marker, such as masonry or metal, placed at all corners. (5) . Recreational and open space requirements. There'shall be provided within a travel park at least y one area designed for recreational and open space use ".. which is easily accessible from all vehicle sites. (a) General--All vehicular sites shall be provided with safe and convenient vehicular access from abutting public streets and roads. Alignment and gradient of roads shall be properly adapted to natural site characteristics such as topography, plants, and trees. Gridiron pattern will not be acceptable due to the environment requirements of this type of development. Surfacing and maintenance shall provide a smooth, hard and dense surface which shall be well drained. (b)Access--Access to a travel park from a public street or road shall be designed to minimize congestion and hazards at their entrance and exit and allow free movement of traffic on adjacent streets. All traffic into or out of the parking areas shall be through such entrances and exits. No parking shall be permitted on the street. Visitor parking shall be in a centrally located parking area in the ratio of one off-street parking space for each ten (10) vehicle sites. Section 131.212. Plan submittal and permit procedure. Such filing shall authorize the building official to receive applications and plans for building permits. (3) Before issuing a building permit for the construction, alteration or extension of a travel park, the building division shall determine that all applicable review procedures and standards called for under these regulations have been satisfactorily complied with, (Applicant shall have received plan approvals by the Pinellas County Health Department and the Florida State Health Department. ) Section 6. The City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in conformance with the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. Section 7. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 8. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 9. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166. 041, Florida Statutes. Section 10. The Planning Director is directed to include and set out and show upon the official zoning atlas of the City of Clearwater the foregoing amendments as hereinabov,e set out. • Section 11. The provisions of this ordinance shall take effect immediately upon its passage.
