[..I,i ^ '1 t.... 4? .... ?!..?'.S+'? ??? , kSJS7.a:n suf. o ORDINANCE NO. 2332-81 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING SECTION 42.43, EXCEPTIONS TO THE BIDDING PROCEDURES OF ARTICLE IV, SALE OF SURPLUS PERSONAL PROPERTY, OF CHAPTER 42, PURCHASING, OF THE CODE OF ORDINANCES, CITY OF CLEARWATER, TO PROVIDE AN ENUMERATION OF THE INSTANCES WHERE BIDDING MAY BE DISPENSED WITH IN THE DISPOSAL OF PERSONAL PROPERTY; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PRO- VIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, it is necessary to clarify the circumstances under which surplus property may be disposed of without the use of a bidding procedure; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That Section 42.43, Exceptions to the bidding procedures, of Article IV, Sale of Surplus Personal Property, of Chapter 42, Purchasing, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended to read as follows: "Section 42.43 Exceptions to the bidding procedures. Lb It is to the advantagtof the City to sell the items to, or otherwise dispose of them in cooperation with, another governmental entitv. (c) The sur2lus sales officer determines that the items can be sold, or otherwise disposed of through only one source. d Local State or Federal law requires that the items be disposed of via public auction. (e) Thd surplus sales officer determines that the nature of the. items are such that disposition under biddinj procedures is impractical, impossible or otherwise not in the best interest of.the.City. f Ord. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 4. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes.
