2314-81 ORDINANCE NO. 2314-81 AN ORDINANCE AMENDING ORDINANCE NO. 2279 WHICH AMENDED THE ZONING ATLAS OF THE CITY OF CLEN R- WATER, FLORIDA, 1980, AS AMENDED, BY ZONING CERTAIN PROPERTY RECENTLY ANNEXED INTO THE CITY AS DESCRIBED THEREIN, TO CORRECT THE LEGAL DESCRIPTION AS TO THE ABUTTING'PORTION OF UNION STREET BEING-ALSO ANNEXED; PROVIDING FOR REPFAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO- VIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, on January 22, 1981, the City Commission of the City of Clearwater, Florida, passed Ordinance No, 2279, after proper public notice and public hearing, to zone certain property recently annexed into the City of Clearwater; and WHEREAS, it has been ascertained that an incorrect legal description was used for the abutting portion of Union Street being also annexed, and Ordinance No. 2279 should be amended to reflect this correction; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That Section 1 of Ordinance No. 2279, passed by the City Commission of the City of Clearwater, Florida, on January 22, 1981, is hereby amended to read as follows: "Section 1. The following described property in Clearwater, Florida, is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas of the City of Clearwater, Florida of 198011, as amended, is amended to indicate that fact as hereinafter set out: Zoned as RS-60 - Single Family Residential District Lot 9, Block A, Cleardun, according to the map or plat thereof as recorded in Plat Buok 13, page 47 of the Public Records of Pinellas County, Florida, together with that abutting portion of Union Street lying within the NE 1/4 of Section 2.3 3-29-15. Section _2. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. SEE O MINANCE v) ; -1- Ord. 02314-81 JSJ81 Section 3. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 4. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 5. The Planning Director is directed to include and set out and show upon the official zoning atlas of the City of Clearwater the foregoing amendments as hereinabove set out. Section 6. The provisions of this ordinance shall, take effect immediately upon its passage.
