FLORIDA, AMENDING CHAPTER 23A, TREE
PROTECTION, OF THE CODE OF ORDINANCES OF
THE CITY OF CLEARWATER, FLORIDA, 1962, TO
PROVIDE FOR APPLICATION PROCESS TO BE HANDLED
BY PUBLIC WORKS DIRECTOR OR HIS DESIGNEE; TO
PROVIDE NEW REPLACEMENT STANDARDS IN DIFFERENT
ZONES; TO PROVIDE STANDARD THAT TREE MUST EXIST
FOR ONE YEAR OR UNTIL ESTABLISHED; TO PROVIDE
FOR PUBLIC WORKS DIRECTOR TO PROCESS LAND
CLEARING AND GRUBBING PERMITS; TO PROVIDE
INFORMATION REQUIREMENTS FOR LAND CLEARING
AND GRUBBING; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; PROVIDING FOR THE

THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Section 23A-4, Application and Submission, of
Chapter 23A, Tree Protection, of the Code of Ordinances of the City of
Clearwater, Florida, 1962, be and the same is hereby amended to read
as £ollowa:
Section 23A-4. Application and submission.
Any person desiring a permit to remove a tree or
mangrove as required by this chapter shall make
written application to the plaaani'rrg-dire--tor uE blic
works director or his designee on application forms
to be provided by the plaa}rti?ditori-er 1}i?-design
Public Works Department, Environmental Management
Office. Such application when completed and signed by
the party to be held responsible for the ro osed tree
removals shall be returned to the p1,anrri-ng-dir-e-otor
ublic works director or his designee, together with a
filing fee a€-one- dellarr-41-e4&}-per44,- ?propesed-to-he
aremove4 as established by the City Commission for each
tree proposed for removal. In addition to completing the
application forms, the pbwmii g di-"odor public works
director or his designee may require the applicant to submit
any or all of the following additional documentation:
(a), A site plan showing the location of all trees and
mangroves, the tree or trees proposed to be removed,
existing and proposed structures, walks, driveways,
parking areas and other improvements. The site plan
shall specify the method or methods to be utilized to
preserve all remaining trees including their root systems,
and the means of providing water and nutrients to such
root systems.

(b) A site plan showing the proposed plan of
development of the tract, showing all existing
trees and mangroves by size and specie, and
those proposed to be removed.
(c) A topographical survey of the )and, if the change
in elevation of the level is greater than five (5) feet
or if the property is one acre or more in area.
(d) Where mangroves exist on the tract or lot, an
aerial photograph at a scale not smaller than one
inch equals fifty (50) feet may be required in lieu
of the submission requirements contained in sub-
paragraphs (a), (b) and (c).
(e) The applicant may authorize the City of Clearwater
to enter upon the property and remove a tree, or
mangrove at the city's expense prior to the owner's
proposed removal, if in the opinion of the parks and
recreation director or his designee such tree or
mangrove is of sufficient value to warrant relocation:
by the citf. The tree or mangrove's physical condition,
health, or other circumstances, such as potential
damage to utility lines, that may be anticipated to
occur during such relocation as well as the city's
needs will be considered by the parks and recreation
director or his designee in the decision to accept or
reject such a donation. Such donated trees or man-
groves will be utilized for landscaping on public lands
or utilized in the city's street tree program.
Following receipt of the application and a ro riate documentation,
the pl•aar}iTigdiree-bor Rublic works director or his designee shall
forward the same, together with his written recommendations,
to the City Manager.

Chapter 23A, Tree Protection, of the Code of Ordinances of the City of

(1) Characteristics The replacement „tree(s) shall
have at least a ual shade potential, screening properties,
an_dLor other characteristics comparable to that of the
tree(s) requested ' to be removed.

(2)Size: Replacement tree(s) are to be made, according
to a standard of one inch DBH total. replacement for
each one inch DBH removed,_ unless otherwise agreed
upon by both the City enforcement officials and applicant,
or atr provided in Section 23A-6_(b). Any number of_r
trees may be utilized to meet the inch for inch require-
ment, provided acceptable spacings and desian are
maintained.
(3) Species - The species of the replacement tree(s) may
be required to be the same as those being requested
for removal from the natural environment, or may be
required to be of a species native to the West Central
Florida area. Exotic; "naturalized" tree(s), or palms
may be used to meet replacement requirements only
through the consent of the City enforcement officials.

mental Management Office. -4 Minimum Standards - All re lacemenCtree s must
have a minimum overall height of eight (8) feet at the

5 Waivers of Replacement Trees Specifications - The
City enforcement officials may waive thess ecies,

a licant can demonstrate that the current market
conditions are such that re lacement•tree s meeting_

Substitute trees allowed under this waiver section
must have the a roval of the Public Works Director
or his designated agent..
(b) Replacement tree(s) - New Construction Minimums
1 Residential single family and du lex lots.
For all single-family and duplex lots a minimum
number of replacement trees will be required based
on the following square footage areas. Any removal
of tree(s) will require that up to this minimum number
be replaced. In no instance shall the tree or trees
required to be replaced exceed the number of trees
existing on the property at the time of granting the tree
removal permit.

2 Residential Multi- Family Tracts
On residential multi-family development projects
a minimum of one tree must be replaced for each
tree permitted removal in excess of fifty (50) per
cent of those protected trees. which exist naturally
on the site.-

Non-residential Tracts
On commercial, commercial tourist facility,
industrial, semi-public, professional, or related
non-residential zoned.property?to be developed,a
minimum of one tree must be re laced for each tree
ermitted removal in excess of twenty-five (25) per
cent of those protected trees which exist naturally
on the site.
4 Mixed-use Zoned Properties
Properties zoned for mixed land usages shall require
replacements according to the intended use per a site
plan approved by the City Commission, or the replace-
ments requirement Paragraph requiring the largest
number of replacement trees. -
5 Location and Design
The specific location(s) and design of tree(s) required
to be replaced must be in accordance with proper
urban forestr ractices and approved b the Public
Works Director or his designated agent.
(c) Credit €or stilt-tre?s{$) Toward Meeting Tree
Replacement Requirements
Any tree(s) left in a good and healthy growing condition
as determined by the ?k?r?rx?iellr?o-tar public works
director or his designee shall be counted toward meeting
the minimum replacement number requirements as #eklvws -
provided in this, section.
(1) Residential Single Family or Duplex Lots
Existing tree(s) four (4) inches to ten (10) inches
DBH will each count as one tree toward meeting the
minimum replacement requirements in (b).
(-X)-Existing tree(s) greater than ten (10) inches DBH to
twenty (20) inches DBH will each count as two (2) trees
toward meeting the minimum replacement requirements
in (b).
P-)-Existing tree(s) greater than twenty (20) inches will
each count as four (4) trees toward meeting the
minimum replacement requirements in subsection (b)
above.
12) Multi-family and Non-residential Developments
Trees planted in compliance with the requirements of
Section 33.09 regarding -the landscaping of vehicle
parking areas associated with new development projects
may also be credited towards meeting the tree replacement
requirements of this section.

2) Comniiance - Replacement trees not in compliance
with the establishment provisions of Section 23A-6 (d) (1)
are to be referred to the Municipal Code Enforcement
Board. Failure to comply with all other provisions of
this section will result in a withholding of a certificate of
occupancy b the Building Director for structures located

Section 3. That Section 23A-13, Land clearing or grubbing--Applications
and procedures, of Chapter 23A, Tree Protection, of the Code of Ordinances
of the City of Clearwater, Florida, 1962, be and the same is hereby amended
to read as follows:
Section 23A-13. Land Clearing or Grubbing - Applications
. and Procedures.
Any person desiring a permit to clear or grub property
within the city limits of Clearwater shall make written
application to the bxrlckng-diT-ec-tear public works director
or his designee on proper forms provided by the building
depa3rtme*t Public Works Department, Environmental
Manavement Office. The application fore: must be accuratel
completed, signed, and notarized by the applicant who acknow-
ledges his awareness and understanding of the requirements in
Section Z3A-16 of this code, relating to the protection o_f trees
during land preparation for construction and construction
activities. The completed application shall be submitted with
a filing fee as established by the City Commission. Such
application must be reviewed and signed by the 'planni'ng'direet'ax-
er-leis-desit-r:ee Land Resources Specialist, the Water Resources
Specialism and the Public Works Director or his designee and-
with their recommendations, , prior -te i-ts-
submi4m4en and forwarded to the City Manager for approval,
approval with modifications, or denial based on the pertinent

Section4:. Should any section, paragraph, sentence, phrase, clause,
or other part or provision of this ordinance be declared by any court to be
invalid, the same shall not affect the validity of the ordinance as a whole,
or any part thereof, other than the part declared to be invalid.
Section S. All ordinances or parts of ordinances in conflict herewith'
or inconsistent with the provisions of this ordinance are hereby repealed to
the extent of their conflict.
Section 6. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166. 041, Florida Statutes.
Section 7. The provisions of this ordinance shall take effect
immediately upon its passage.
