That Section 23A-4, Application and Submission, of Chapter 23A, Tree Protection, of the Code of Ordinances of the City of Clearwater, Florida, 1962, be and the same is hereby amended to read as £ollowa: Section 23A-4. Application and submission. Any person desiring a permit to remove a tree or mangrove as required by this chapter shall make written application to the plaaani'rrg-dire--tor uE blic works director or his designee on application forms to be provided by the plaa}rti?ditori-er 1}i?-design Public Works Department, Environmental Management Office. Such application when completed and signed by the party to be held responsible for the ro osed tree removals shall be returned to the p1,anrri-ng-dir-e-otor ublic works director or his designee, together with a filing fee a€-one- dellarr-41-e4&}-per44,- ?propesed-to-he aremove4 as established by the City Commission for each tree proposed for removal. In addition to completing the application forms, the pbwmii g di-"odor public works director or his designee may require the applicant to submit any or all of the following additional documentation: (a), A site plan showing the location of all trees and mangroves, the tree or trees proposed to be removed, existing and proposed structures, walks, driveways, parking areas and other improvements. The site plan shall specify the method or methods to be utilized to preserve all remaining trees including their root systems, and the means of providing water and nutrients to such root systems. (c) A topographical survey of the )and, if the change in elevation of the level is greater than five (5) feet or if the property is one acre or more in area. (d) Where mangroves exist on the tract or lot, an aerial photograph at a scale not smaller than one inch equals fifty (50) feet may be required in lieu of the submission requirements contained in sub- paragraphs (a), (b) and (c). (e) The applicant may authorize the City of Clearwater to enter upon the property and remove a tree, or mangrove at the city's expense prior to the owner's proposed removal, if in the opinion of the parks and recreation director or his designee such tree or mangrove is of sufficient value to warrant relocation: by the citf. The tree or mangrove's physical condition, health, or other circumstances, such as potential damage to utility lines, that may be anticipated to occur during such relocation as well as the city's needs will be considered by the parks and recreation director or his designee in the decision to accept or reject such a donation. Such donated trees or man- groves will be utilized for landscaping on public lands or utilized in the city's street tree program. Ord'.1230981 2/19J81 0 0 (1) Characteristics The replacement „tree(s) shall have at least a ual shade potential, screening properties, an_dLor other characteristics comparable to that of the tree(s) requested ' to be removed. 4 (2)Size: Replacement tree(s) are to be made, according to a standard of one inch DBH total. replacement for each one inch DBH removed,_ unless otherwise agreed upon by both the City enforcement officials and applicant, or atr provided in Section 23A-6_(b). Any number of_r trees may be utilized to meet the inch for inch require- ment, provided acceptable spacings and desian are maintained. Should any section, paragraph, sentence, phrase, clause, or other part or provision of this ordinance be declared by any court to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof, other than the part declared to be invalid. Section S. All ordinances or parts of ordinances in conflict herewith' or inconsistent with the provisions of this ordinance are hereby repealed to the extent of their conflict. Section 6. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166. 041, Florida Statutes. Section 7.
