Asa ¢ ,... .. ...a. ,.•u?.',7. ..: s?t? ..u ... .... ... ... .. 3-. ,# ., !:; ':.? r r ORDINANCE NO. 2308-81 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING SECTION 4-21, CONSUMPTION OF ALCOHOLIC BEVERAGES IN PUBLIC PROHIBITED, OF CHAPTER 4, ALCOHOLIC BEVERAGES, OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA, 1962, TO PROVIDE THAT POSSESSION OF OPENED OR UNSEALED CONTAINERS IN IDENTIFIED AREAS IS PROHIBITED; TO EXPAND THE AREAS COVERED TO INCLUDE EXTERIOR DOORWAY OR ENTRANCE TO ANY BUILDING OR DWELLING; PROVIDING FOR THE SEPARABILITY OF THE PRO- VISIONS HEREOF; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. It is found and determined that consumption of intoxicating liquors or beverages, beers or wines or possession of unsealed or unopened containers thereof on the public streets, sidewalks, rights-of-way, alleys, and the exterior doorways and entrances to buildings er-dwel-lingc, except on premises properly licensed therefor, is detrimental to the public health and welfare because such consumption or possession results in crime, unsightly and unsanitary conditions due to persons eliminating in public or exposing themselves, and debris. Section 2. That Section 4-21, Consumption ofalcoholic beverages in public prohibited, of Chapter 4, Alcoholic Beverages, of the Code of Ordinances of the City of Clearwater, Florida, 1962, be and the same is hereby amended to read as follows: Section 4-21. Consumption or possession of alcoholic beverages in public area prohibited. It shall be unlawful for any person to sell, service, dispense, use, consume or drink any beer, wine or other alcoholic beverages, or to possess an o ened or unsealed container containing beer, wine or other alcoholic beverage within the following places: (a) On or in any public beach; -I- SEE ORDINANCE A,...•...........••.•..... (c) On or in any street end fronting on the Gulf of Mexico in the City of Clearwater; or, (d) On or in any public park or minipark in the City of Clearwater. For the purposes of this section, the term "park" shall be construed to mean all dedicated parks and athletic fields, and all grounds used by the city for park or playground purposes, but exclusive of any permanent structures erected thereon at which alcoholic beverages are sold; or (e) On or in the exterior doorways and entrances to buildings. This prohibition shall not be construed to a 1 to that portion of any building or dwelling, licensed for the sale and consumption of beer, wine or other alcoholic beverages. A container shall be opened or unsealed if the seal has been broken or the pop top can or top has been opened. The restriction set forth herein relating 'go possession of an opened or unsealed container shall not a 1 to an opened or unsealed container located in the trunk of a motor vehicle. Section 33. Should any section, paragraph, sentence, phrase, clause, or other part'or provision of this ordinance be declared by any court to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof, other than the part declared to be invalid. Section 4. All ordinances or parts of ordinances in conflict herewith or inconsistent with the provisions of this ordinance are hereby repealed to the extent of their conflict. Section S. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166. 041, Florida Statutes. Section b. The provisions of this ordinance shall take effect immediately upon its passage.
