FLORIDA, AMENDING TITLE II, ADMINISTRATION,
OF THE CODE OF ORDINANCES, CITY OF CLEARWATER,
FLORIDA,,, TO CREATE A CLEARWATER EXECUTIVE
AIRPORT AUTHORITY AS AUTHORIZED UNDER CHAPTER
166. 021, FLORIDA STATUTES; PROVIDING FOR ITS
MEMBERSHIP; DEFINING THE POWERS AND DUTIES OF
SAID AUTHORITY; ESTABLISHING PROCEDURES FOR
RECALL OF AUTHORITY MEMBERS; PROVIDING FOR
THE SEPARABILITY OF THE PROVISIONS HEREOF;
PROVIDING FOR PROPER NOTICE OF PROPOSED
ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, the City of Clearwater has continually experienced

claims and lawsuits relating to the operation and maintenance of Clearwater
Air Park posing questions relating to protection of the public interest; and
WHEREAS, the City of Clearwater, Florida, presently has no effective
manner to monitor the present operation ongoing at the airpark facility; and
WHEREAS, the creation of an Authority to act on behalf of the muni-
cipality as a monitor to provide' it with information and data such as will
enable it to better protect the public interest and reduce the claims and
problems arising at the airpark;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Title II, Administration, of the Code of Ordinances,
"i City of Clearwater, Florida, is hereby amended and supplemented by the
enactment of Article V, Airport Authority, of Chapter 22, Appointive Boards and
Committees, consisting of the following sections to read as follows:
f ARTICLE V. AIRPORT AUTHORITY
Section 22.80 . Authority and Purpose.
This ordinance is ndopted pursuant to the authority conferred
by Article VIII, Section _2 (b), Florida Constitution, as
implemented by Section 166. 021, Florida Statutes. It is
hereby found that the Clearwater Executive Airport as presently
cor,fi ured and o eratin is an asset to the Ci of Clearwater
and should be retained as such; operated and maintained in a safe
and professional manner; and improved for the benefit of the entire
community. Accordingly, it is declared:
(1) That for the health, safety and _welfare of the community
of Clearwater, an Airport Authority shall be establi3hed
to monitor the operation, maintenance and provide
recommendations for improvements to the Clearwater

serves all of the community and is operated in a safe
and efficient manner.
Section 22.81. Definitions.
1 AIRPORT - Clearwater Executive Airport which is
located at Latitude 27°58'3'4" N and Longitude 82°45132" W.
,(2) AIRPORT AUTHORITY - A board of five local citizens,
representing different interest groups, which is authorized
to insure that the air ort is Tanned and operated in a ?.
safe and efficient manner.
3 AIRPORT LESSEE - The designated representative of
Clearwater Air Park, Inc.. as provided for in the Lease
Agreement.-
4 RULES - All guidance, rocedures, instructions or
other materials pertaining to the operation of the
air ort and aircraft landing or taking off therefrom.
5) LEASE AGREEMENT - The Lease Agreement dated
&u gust 1 1970between Clearwater Air Park, Inc. (Lessee)
and Clearwater Golf Park, Inc. (Lessor), and consented to
by the Ci of Clearwater. The Ci of Clearwater subsequently
acquired all rights of Clearwater Golf Park, Inc. on October
3-,_- 1280, and thus assumes the position of Lessor in the
Lease Agreement.
Section 22. 82. Creation of an Air ort Authori .
la) The Airport Authority shall consist of five (5) members,
appointed b the City Commission. Nominations for
membershi will be resdnted to the Ci Commission
from each of the following interests:
1) Clearwater Chamber of Commerce
2 League of Women Voters
3 Clearwater Pilots Association
4) Residents living in proximity'to the Clearwate-r
Executive Airport or residents living-in the roximi
selected b the City Commission.
.(S)Member-at-large selected b the City Commission.
Each of the above rou s will forward three (3) nominations
to the Ci Commission fora ointment to the Authority, and
the nominees shall be members of the specific categories.
The City Commission will ascertain the qualifications of
each nominee to serve on the Authority and shall make the
ap ointment during the last City Commission meeting prior
to the expired term of the incumbent.

ib) The. normal term for each member of the Authority shall
be three {3} ears. Upon creation of the Authority, the
initial term in office shall be as follows:
1 Chamber of Commerce and local resident - one 1 ear.
2 Clearwater Pilots Association and League of Women
Voters - two 2 ears.
3 Member-at-large - three 3 ears.
c The Authority shall elect from its membershi at its first
_meeting after it i6 fully constituted and annually thereafter
a Chairman and a Vice-Chairman who shall act as Secretary
for the Authority.
Section 22. 83. Powers and Duties of the Airport Authority.
a The Air ort Authority shall have the power and du to
monitor the lease operation of the Clearwater Executive
Airport, on behalf of the City of Clearwater, to ensure
compliance with all terms of the lease.
b The Airport Authority shall be directl responsible to
the City Commission, particularly for recomrn_ endings
appropriate City action regarding the following paragraphs
of the Lease Agreement:
Paragraph 10 Additional Improvements
Paragraph 11 Maintenance
Paragraph 13 Use of Premises
Paragraph 14 Nondiscrimination Use
Para rah 15 Manner of O eration
Paragraph 16 Prices
Paragraph 20 Operation of Facilities
ic) In monitoring ,the Lessee's Air Park operation, the
Airport Authority shall:
(1) Ensure that the airport is operated and maintained
in a safe and professional manner that is consistent
with the needs of the entire communitX;
(2 Ensure that the Ci Commission and staff is current
on all matters pertaining to the airport's operation
and development;
(3) Ensure that reasonable rules pertaining to the operation
of the airport are developed, implemented and enforced;
(4) Hold public meetings between the aviation community
and the local residents in an effort to resolve matters
of mutual interest;'
(5) Hold Authority meetings, at least one per month, to
conduct Authority business. These meetings shall be
open to the public with a period of time at the end of
each meeting set aside for public input.
(6) Make requests to the City Commission for City assistanc
whe er financial, legal, or from other City DepartmentE
necessary to achieve a above described objectives.

Section 22.84. Procedures for Recall.
Members of the Airport Authority shall be subject to recall for
no_n_-performance of duty. Petitions for such recall shall be
submitted to the City Commission for review and action. Upon
,receipt of a valid request for recall of an Authority member, the'
City Commission will appoint a hearing officer to investigate the
allegation, determine findings of fact, and recommend appropriate
action. Recall of -an Air ort Authors member shall require a
4 to 1 vote of the City Commission_
Section 22. 85. Airport Authority/ City of Clearwater Relationship_
(a) The Airport Authority is herein created by the City Commission
of the Ci of Clearwater to monitor the Air ark on behalf of
the City of Clearwater and thereby provide for safe and pro-
fessional operation of the Clearwater Executive Airport.
b The Authors shall act on its own behalf ertainin to
airport matters.
(c) The Authority will be represented at City Commission
meetings by the Chairman/Vice-Chairman when requested.
Section 2. Should any part or provision of this ordinance be
declared by a court of competent jurisdiction to be invalid, the same shall
not affect the validity of the ordinance as a whole, or any part thereof
other than the part declared to be invalid.
Section 3. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
Section 4. This ordinance shall become effective immediately
upon its passage.
