ORDINANCE NO. 2294-81
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING CHAPTER 14, OFFENSES AND MISCELLANEOUS
PROVISIONS, OF THE CODE OF ORDINANCES OF THE CITY
OF CLEARWATER, FLORIDA, 1962, TO ENACT A SECTION
RELATING TO DISORDERLY CONDUCT AND LOITERING IN
CONNECTION WITH THE POSSESSION OF CONTROLLED
SUBSTANCES; PROVIDING FOR THE SEPARABILITY OF
THE PROVISIONS HEREOF; PROVIDING FOR THE REPEAL
OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR PROPER NOTICE OF PRO-
POSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
]DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Section 14-49, Loitering in, sleeping in, obstructing,
etc.', streets, public places, etc., of Chapter 14, Offenses and Miscellaneous
Provisions, of the Code of Ordinances of the City of Clearwater, Florida,
1962, be and the same is hereby amended to read as follows:

Section 14-49. Disorderly conduct.
a} Whoever commits such acts as are of a nature to
corrupt-the public morals, or outrage the sense of
public decency, or affect the peace and quiet of
persons who may witness them, or engages in brawling
or fighting, or engages in such conduct as to constitute
a breach of the peace or disorderly conduct, shall be
guilty of a breach of city ordinance, punishable as
provided in Section 1-8 of the Clearwater City Code.
In addition to the acts enumerated in subsection (a)
any person who shall commit any of the following acts
shall be uilt of the offense of disorderl conduct:
W-Solicits anyone to engage in, or who engages in,
lewd or dissolute conduct in any public elace?or in__
an lace o en to the public or exposed to public vew.
(2) Solicits or who engages in any act of prostitution. As
.used-in this paragraph "Prostitution" includes any
lewd act between persons of the same or opposite sex
for money, or other consideration.
3 Loiters in or. about an toilet open to the public for
the purpose of engaging in or soliciting an lewd,
lascivious or any unlawful act.
4 Damages, befouls, uses or disturbs public r02erty or
- rivate property of another so as to create an unsafe,
unhealthy,, unsanitary or physically offensive condition.
5 Lies down to rest or to sleep in a public park, public
street or public property between the hours of 11:00
m and 8:00a. m, under circumstances that warrant
a 'ustifiable and reasonable alarm or immediate concern
for the safe or well-being of persons or property in
thevicinity.

intoxicating liquor, beer or wine as defined in section 4-1,
Clearwater City Code, is being «unlawfull used or possessed
said person or persons. It shall be unlawful to commit

Section 2. That Chapter 14, Offenses and Miscellaneous Provisions,
of the Code of Ordinances of the City of Clearwater, Florida, 1962, is supplemented
by the enactment of Section 14-50 to read as follows:

Section 14-50. Loitering in connection with unlawful use,
possession of controlled substances;-in-
toxicating liquor, beverages, beer, wine;

b "Public place" means an area, other than the interior
_po.rtion of a private building, generally- visible from
public streets or public sidewalks and includes streets,
sidewalks, bridges, alleys, plazas, parks, driveways
parking lots automobiles whether moving or not and
the exterior doorways and entrances to buildings or
dwellings and the rounds enclosing them.
Section 3. Should any section, paragraph, sentence, phrase, clause,
or other part or provision of this ordinance be declared by any court to be
invalid, the same shall not affect the validity of the ordinance as a whole,
or any part thereof, other than the part declared to be invalid.
Section 4. All ordinances or parts of ordinances in conflict herewith
or inconsistent with the provisions of this ordinance are hereby repealed to
the extent of their conflict.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166. 041, Florida Statutes.
Section 6. The provisions of this ordinance shall take effect
immediately upon its passage.
