FLORIDA, AMENDING CHAPTER 140, MOBILE HOMES
AND TRAILERS, OF THE CODE OF ORDINANCES, CITY
OF CLEARWATER, FLORIDA, PROVIDING FOR
CLARIFICATION OF DEFINITIONS; PROVIDING FOR
CLARIFICATION OF MOBILE HOME OWNERS' RIGHTS
TO ORGANIZE AND RIGHTS TO REPRESENTATION;
PROVIDING FOR RESTRICTION OF INDIVIDUAL
NEGOTIATIONS WITH MANAGEMENT; PROVIDING
FOR REPRESENTATION BY NEGOTIATING UNITS AND
AGENTS; PROVIDING GUIDELINES FOR NEGOTIATING
UNITS AND AGENTS; PROVIDING GUIDELINES FOR
THE ELECTION OF NEGOTIATING UNITS AND AGENTS;
PROVIDING REVISED GUIDELINES ON IMPASSE-
HEARING BEFORE THE BOARD AND APPEAL TO
HEARING OFFICER; PROVIDING FOR THE
SEPARABILITY OF THE PROVISIONS HEREOF;
PROVIDING FOR THE REPEAL OF ALL ORDINANCES

DATE OF THIS ORDINANCE.
WHEREAS, the Florida Supreme Court has ruled that Rent Control
and the Florida Mobile Home Tenant-Landlord Commission are unconstitutional;
and
WI-EREAS, revised guidelines for mediation and arbitration
procedures are needed; and
WHEREAS, guidelines need to be given for individual negotiations
with management and provisions made for representation by negotiating agents
and negotiating units and for their election;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER,
FLORIDA:
Section I. Section 140.21, Definitions, of Chapter 140, Mobile
Homes and-TToHem, of the Code of Ordinances, City of Clearwater, Florida, is
hereby amended as follows:
Section 140.21. Definitions. Unless a different meaning
clearly appears in the context, the following terms shall
have the following meanings* respectively ascribed to
them:
(a) Mobile Home Park. Any area, tract, site, or plat
of land whereupon ten (10) or more mobile
1are placed, located, or
homesi as herein defined
maintained solely for residential purposes, or
intended to be placed, located or maintained,
and shall include all accessory buildings used or
intended to be used as part of the equipment
thereof.

(b) Mobile Home Park Resident. The person or
persons owning a mobile home unit occupying a
mobile home lot within a Mobile Home Park er-
eFee where *RR (10) OF mer-e rnebiie home bn4a
are 4eeated and paying rent or other
consideration to the mobile home park owner(s).
(c) Mobile Home Lot or Space. A plot of ground
within a mobile home park which is designed for
and designated as the location of one mobile
home and Its appurtenances and not used for uny
other purpose whatsoever other than the
customary accessory use thereof.
(d) Mobile Home. Park Owner. As owner, lessor,
sub-lessor, assignee or other person receiving or
entitled to receive rent or other consideration
for the use and occupancy of any mobile home
lot, or an agent of any of the foregoing.
(e) City. The City of Clearwater, Florida.
(f) Negotiating Units. A group of residents within
any individual mobile home park who has voted
that the mobile home park desires to be
represented by a negoting agents and who has
filed the statements required under Section 3 A-
S Q 140.24(b).
(g) Mobile Home. Mobile home means a movable or
portable structure, exclusive of recreational
vehicles,' travel trailers, motor homes, vans,
campers or any type of vehicle designed to be
self contained, comprised of one or more
components manufactured as a complete living
unit , to be transported to a permanent
foundation, necessitating connection to mobile
home park utilities.
(h) Negotiating Agent. A resident of a mobile home
park who has been selected by the other
members of the negotiating unit to represent the
negotiating unit to represent all park residents in
negotiations with the mobile home park owner.
(i) Board. The Mobile Home Park -Board created
hereunder to administer the terms of this
Ordinance.
Section 2. Subsection (d) Purposes, Duties and Responsibilities, of
'Section 140.22 Mobile Home Park Board, of Chapter 140, Mobile Homes a"
of the Code of Ordinances, City of Clearwater, Florida, is hereby

(d) Purposes, Duties and Responsibilities. The Board Is
charged with the responsibility for the administration
of the terms of this Chapter and such other duties as
are outlined therein to include, but not be limited to,
the determination of negotiating units and reciprocal
rights, the development of parallel responsibilities
between Mobile Home Park Residents and Mobile
Home Park Owners, the registration and certification
of negotiating agents, the development of uniform
rental and general service standards, which shall
include among other standards, a requirement that
each lease or rental agreement offered shall be
subject to inspection and revision prior to execution
with such requirement to apply to each provision of
the lease or rental agreement; exeep# 4he pr-evk en

requirement that each lease or rental agreement is to
include a provision requiring twelve (12) months
notice prior to any eviction where a change in the use
of the land comprising the mobile home park from
mobile home lot rentals to some other use is
contemplated and a requirement that sixty (60) days
notice be provided to all mobile home park residents
where any change in park rules or regulations is
contemplated; the settlement of disputes concerning
the appropriateness of negotiating units or
negotiating agents; the keeping of all records
required to be kept under this Chapter; the conduct
of such inquiries and investigations regarding
conditions existing in mobile home parks in the City
of Clearwater and such other duties and
responsibilities as may be required of it by the City
Commission. In addition to the duties set forth
abovey the Board shall additionally have the following
duties in the appropriate circumstances:
(1) To accept written complaints relating to the
terms of park rules and regulations, park
maintenance standards and the terms and
conditions of park leases; exeep#' gents be+Rg

allegations contained in said complaints, to
request the attendance of park owners and
residents in order to fully investigate and
explore the allegations contained in the said
complaint, to make recommendations to park
owners and residents concerning the resolution
of, matters contained in these complaints, to
make findings of fact concerning undesirable
conditions existing In parks or to make findings
' that the complaint so filed is unwarranted and
unreasonable, to make public reports concerning
its recommendations and findings and to monitor
corrective actions or remedial procedures.
(2) To' conduct an ongoing review of conditions in
the mobile home parks in the City of Clearwater
regarding (a) availability of rental spaces, (b)
the effect of changes in park ownership on park
' conditions, (c) the existence or non-existence of
resident hardship due to park conditions, (d) any
evidence of the existence or the non-existence
of emergency conditions within the various
mobile home parks, (e) the availability of spaces
or lots for mobile homes and appurtenances, eRd
:. (f) costs associated with removal of mobile
homes to alternative park areas, and O current
market conditions pertaining to sales of new an

(3) To review upon request the annual leases offered
to tenants by mobile home park owners as to the
reasonableness of the terms of such leases and to
determine the availability to the individual
residents of an opportunity to bargain with the
park owner regarding the resident's desires and
the presence or absence of meaningful
negotiations between park owners and park

Section 3. Section 140.23, Mobile Home Residents--Organization
and Representation, of Chapter 140 Mobile Homes -and-Treiiers, of the Code of
Ordinances, City of Clearwater, Florida, is hereby amended to read as follows:
Section 140.23. Mobile Home Residents--Organization and
Representation.
(a) Right to Organize. Mobile home owners residing in
mobile home parks located within the City of
Clearwater shall have the right to form, join and
participate in collective negotiating organizations.
(b) Right to Representation. Mobile home park residents
shall have the right to be represented by a
negotiating agent and negotiate collectively with
their mobile home park owner in the determination of
the terms and conditions that will exist within the
mobile home park relating to park rules, park
maintenance standards, and the terms of park leasev
except that rents and service charges shall not be
subiect to mandatory collective negotiations as
provided for in Section 140.25 through Section
140.28. Mobile home owners shall also have the right
to refrain from exercising the right to be represented

from presenting, at any time, his own grievance in
person or by legal counsel or from negotiating

Section 4. Paragraphs (a) and (b) of Section 140.24, Selection of
Negotiating Agent, of Chapter 140 Mobile Homes end Trc ler-s? of the Code of
Ordinances, City of Clearwater, Florida, are amended and new paragraphs (g)
and (h) added thereto as follows:
(a) Determination of Unit. Each mobile home park shall,
by vote of all lot residents in the park (I vote per
lot), determine whether or not the mobile home park
desires to be represented by a negotiating agent in
negotiations with the mobile home park owner. Upon
request of residents occupying twenty per cent (20%)
of all lots in the mobile home park, an election shall
be held within the park in accordance with the
procedure established by the Mobile Home Park
Board for the conduct of such elections. The
election shall be supervised by the Board and shall be
by secret ballot. An election to determine whether
or not the mobile home park desires to be
represented by negotiating agents shall be conducted
not more often than annually and in the event that
the vote of the majority of the lots voting is to the
effect that the park does not desire to be
represented, another election shall not be held until
at least one year from the date of the first election.
In the event an election determines the resident
voting majority desires to be represented, subsequent
elections must be held at least every two years to
determine if a majority of current residents still
desire to be represented under this Ordinance.
(b) Selection of Negotiating Agents. Upon the
determination that a park desires to be represented
by a negotiating agent in negotiation with the mobile
home park owner, all persons desiring to participate
in the selection of a negotiating agent shall sign a
statement to that effect and file it with the Mobile
Home Park Board and that group shall be identified
as the negotiating unit for that park. The Board shall
determine appropriate procedures for the execution
and filing of the said statements. The negotiating
unit shall select by secret ballot three (3) persons to
act as negotiating agents for the residents of the
park concerned, each person to be selected by a
majority of the negotiating unit. Neqotlating Agents
are to be elected to serve a two 2 year term, with
no limit as to reelection. In case of incapacity to
serve, due to health, absence, or by personal choice,
the negotiatinq unit will select a replacement aaent

Section 5. Subparagraph (a) of Section 140.25, Collective
Negotiations, of Chapter 140 Mobile Homes and-Trai` ers, of the Code of
Ordinances, City of Clearwater, Florida, .is amended as follows:
(a) Negotiations. After negotiating agents have been
certified by the Board, pursuant to the provisions of
this Chapter, the negotiating agents and the mobile
home park owner or his agent jointly shall negotiate
collectively, upon the written request of either party,
in the determination of the matters set forth in
Section 3A-5W 140.23(b) of this Chapter.
Negotiations concerning leases shall, at a minimum,
concern all provisions concerning any financial
obligations of the mobile home owner and at least
those provisions required by Florida Statute. No
party shall be required or expected to negotiate the
same issue or substantially the same issue unless a
change in circumstances has occurred or unless a new
lease is being considered or has been offered to the
park, mobile home owners. N otiations should
commence within Forty-Five (5 days of written
requests.
Section 6. Subparagraphs (a) and (b) of Section 140.26, Emergency--
Collective Negotiation of Chapter 140 Mobile Homes and Zrei-lemn of the Code
of Ordinances, City of Clearwater, Florida, is hereby amended to read as
follows:
(a) Finding by Board. If, during the process of its
continuous review of mobile home park conditions,
the Board determines that in its opinion a condition
exists regarding (1) park rules and regulations, (2)
park maintenance standards or (3) the terms and
conditions of the lease, excluding rent, and the
duration of the term of the rental agreement or lease
agreement, and that the condition cannot be dealt
with effectively by the ordinary operations of the
private mobile home housing market, voluntary
collective and negotiation or through enforcement of
the provisions and remedies contained In Part III of
Chapter 83 of the Florida Statutes, the Florida
Mobile Home Landlord and Tenant Act, and that the
existing condition will produce a serious threat to the
public health, safety and general welfare of the
citizens of Clearwater, Florida, the Board may find
that a severe emergency condition exists excluding
rent or other considerations in the mobile home
market generally or within any named park or parks
warranting the institution of emergency collective
negotiating rights as set forth in this ordinance. In
making its determination that an emergency
condition exists, the Board shall consider the
following:

(b) Resolution Considered by City Commission. Upon
transmittal of a report provided to the City
Commission containing a finding that an emergency
condition exists regarding mobile home parks within
the City of Clearwater, Florida, or within an named
park or parks and detailing the extent and the
conditions of such emergency, the consideration of a
resolution Implementing the provisions of this

chapter shall be scheduled as an agenda item for the
next regular meeting of the City Commission. At the
meeting at which the resolution is to be considered, a
public hearing shall be conducted by the City
Commission concerning the existence of, emergency
conditions. The City Clerk shall cause the notice of
the consideration of such resolution to be placed in a
newspaper of general circulation within the City of
Clearwater at least three (3) days before the meeting
at which the public hearing is to be held and at which
the resolution is to be considered. Following the
pubiic hearing, the City Commission shall consider
the resolution, which resolution shall contain a
finding that an emergency condition exists, and if
such resolution shall be passed by the City
Commission, Sections 3A-9 140.27 and 3A40 140.28
of this Chapter shall become initially available,
effective and operative upon stipulation of issue(s),

has passed, when said resolution is automatically
rescinded, or earlier, upon agreement by the City
Commission with a Resolution of the Mobile Home
card that an emergency condition no longer exists.
Section 7. Section 140.27, Impasse Resolution by Mediation, of
Chapter 140, Mobile Homes ,and-Trei4ers, of the Code of Ordinances, City of
Clearwater, Florida, is hereby repealed in its entirety and a new Section 140.27
Impasse-Hearing Before the Board is hereby enacted to read as follows:
(a) Impasse. If the parties are unable to negotiate the
terms of the lease, park rules and regulations, or park
maintenance standards forty-five. (45) days after
commencement of negotiations, or if an emergency
condition has been determined by the City
Commission to exist, an impasse shall be deemed to
have occurred. Prior to submission of an impasse to
a hearing before the Board, the parties should meet
together for the purpose of stipulating issues.
Disputed issues shall be filed, in writing, with the
Board.
(b) Hearing by Mobile Home Park' Board. Upon
submission of the stipulation concerning an impasse
being submitted to the Board, the Board shall
forthwith notify the parties of the time and place of
the hearing to consider the impasse issue(s). All
hearings before the Board shall be public and it shall
be the function of the Board to bring the parties
together as will tend to effectuate the settlement of
the dispute. Nothing in this section shall prevent the
parties from mutually selecting their own
representative. The hearing will be conducted on an
informal basis and under such rules of procedures are
deemed desirable by the Board.
(c) Issues for Consideration. The Board shall limit its
deliberations to the issues submitted by the parties.
No finding of the Board shall prevent the park owner
from receiving a fair rate of return on investment or
preclude the park owner from passing increased costs
such as taxes, utilities, and governmental services
directly to the park tenants. No finding or
recommendation of the Board shall conflict with or

prohibit the park owner from making reasonable
managerial decisions consistent with the recognized
standard practices for the administration of the
mobile home parks.

(d) Decision of the Board. Following the close of the
hearing, the Board shall review and consider all of
the relevant evidence which has been presented and
any oral or written argument provided by the parties.
The Board shall expeditiously prepare a decision
containing its findings and conclusions and shall
forward a copy of such decision to both parties and
shall file a copy with the Mobile Home Park Board
and with the City Clerk. The Board's decision shall
be binding on all parties. The parties shall forthwith
undertake any necessary action to implement the
decision of "the Board and failure to do so shall be
deemed a violation of this Chapter which shall result
in revocation of the mobile home park owner's license
to operate a mobile home .)ark in the City of
Clearwater or removal of the mobile home resident
from, the mobile home park.
(e) Records-Public. All records of the Board, including
the reports of its recommendations, shall be open for
inspection by the public.
'Section 8. Section 140.28 Arbitration by Impasse Issues of Chapter
140 Mobile Homes anef-TraHem, of the Code of Ordinances, City of Clearwater,
Florida, is hereby repealed in its entirety and a new Section 140.28 Appeal to
Hearing Officer is hereby enacted to read as follows:
Section 140.28 Appeal to Hearing Officer.
(A) Procedure for Appeal.
(1) Either party in interest may appeal the decision
of the Board to a Hearing Officer.
(2) Appeals to the Hearing Officer shall be
commenced through the filing of a notice of
appeal with the City Clerk within fifteen (15)
days of the decision of the Board.
(3) The notice of appeal shall set forth in detail the
Issues to be presented and the facts which
demonstrate -that the Board's recommendation is
fallacious.
{4) The City Clerk sholl, in concert with the Hearing
Officer, establish the date and time for hearing
the appeal which date shall not be less than
fifteen (N days or ' more than forty-five (45)
days from the date of notice of appeal, unless
otherwise requested by the appellant. Should the
Hearing Officer occasion a conflict in his
schedule he'shall be empowered to change the
:t date established herein.
' (5) The City Clerk shall tape record and prepare the,
"
written findings and decision of the Hearing
Officer.

(6) Fees for appeal to the Hearing Officer shall be
established by resolution of the City
Commission.
(B) Conduct of Public Hearing before the Hearing Officer shall be as
set forth following the procedure set out below.
(1) The Hearing Officer shall set forth at the outset
of the hearing the order of the proceedings and
the rules under which the hearing will be
conducted.
(2) The recommended decision of the Board will not
be overturned unless the Hearing Officer finds
that evidence is clear and convincing that the
Board's decision is in error.
(3) The Hearing Officer shall have the authority to
determine the applicability and relevance of all
materials, exhibits and testimony and to exclude
such irrelevant, Immaterial or repetitious matter
as he may deem appropriate.
(4) The Hearing Officer is authorized to administer
oaths, where in his judgment testimony under
oath is deemed essential to the proceeding.
(5) The Hearing Officer is required to establish the
time for presentation of appeals.
(6) The Hearing Officer will conclude the hearing
and advise the parties of interest that his
written decision will be available within thirty
(30) days.
(7) The decision of the Hearing Officer shall be final
and binding on all parties, except for judicial
review as provided by general law.
(C) Issues for Consideration. The hearing officer shall limit its

of the Hearing Officer shall prevent the park owner from
receiving a fair rate of return on investment or preclude the

decisions consistent with the recognized standard practices for

(D) Hearing Officer. The appointment, term of duty, qualifications,
conduct and removal of the Hearing Officer shall be as follows:

(1) The City Commission shall contract with the
State of Florida, Department of Administrative
Hearings to provide a hearing officer to conduct
the appeal hearing provided herein.

(2) In the event that the City of Clearwater is
unable to contract with'the State for a Hearing
Officer, the appeal shall be to the City
Commission, whose powers, duties, and
jurisdiction shall in such case be the some as
that set out for the Hearing Officer,
Section 9. Any person, organization, society, association or
corporation, or any agent or representative thereof, who shall violate the
provisions of this ordinance shall be subject, upon conviction, to a fine not
exceeding the sum of Five Hundred Dollars ($500.00),,or imprisonment for not
exceeding sixty (60) days, or by both such fine and imprisonment in the discretion
of the Judge.
Section 10. Should any section, paragraph, sentence or word of this
ordinance be declared for any reason to be invalid, the some shall not affect the
validity of the ordinance as a whole, or any part thereof other than the part
declared to be invalid.
Section II. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.
Section 12. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
Section 13. This ordinance shall became effective immediately upon
its passage.
