AN ORDINANCE AMENDING THE ZONING ATLAS OF THE
CITY OF CLEAR WA TER, FLORIDA, 1980, AS AMENDED,
TO FURTHER ZONE BY OVERLAYING A NEW CLASSI-
FICATION ON CERTAIN PROPERTY AS DESCRIBED
HEREIN; PROVIDING FOR REPEAL OF ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH
TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR
THE SEPARABILITY OF THE PROVISIONS HEREOF;
PROVIDING FOR PROPER NOTICE OF PROPOSED
ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on October 2, 1980, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning atlas of the City of Clearwater in accordance
with procedure as established; and
WHEREAS, certain of the proposed changes to the zoning atlas
were approved by the City Commission after its evaluation of all evidence
presented at the said public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section-I. The following described property in Clearwater, Florida,
which contains zoning classifications CTF-28, P, CG, ISP and PS is hereby
further zoned by overlaying the enumerated zoning classifications identified
herein with a new classification Downtown Development District (DD), and
"The Zoning Atlas of the City of Clearwater, Florida of 198011, as amended,
is amended to indicate the fact of such overlay zoning as set out herein:
Beginning where Jones Street ends at Clearwater Bay,
running East on Jones Street to Osceola Avenue; then
South on Osceola Avenue to Court Street; then West on
Court Street to Oak Avenue; then South on Oak Avenue to
Chestnut Street; West on what would be Chestnut Street if
extended to Clearwater Bay.
AND
Lots 1 thru 4, inclusive, Block 7 and Lots 1 thru 4, inclusive,
Block 8, of A. C. Turner's Subdivision 1st Addition as
recorded in Deed K-475 of the Public Records of Hillsborough
County, Florida, of which Pinellas County was formerly a part.
AND
Lots 1 thru 4, inclusive and abutting vacated alleys, and Lots
11 thru 14, inclusive and - butting vacated alleys, of Markley's
Addition, according to the map or plat thereof as recorded in
Plat Book 1, page 97 of the Public Records of Hillsborough
County, Florida, of which Pinellas County was formerly a part.

Section 2. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the came shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 4. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166, 041, Florida Statutes.
Section 5. The Pianning Director is directed to include and set out
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendments as hereinabove set out.
Section 6. The provisions of this ordinance shall take effect
immediately upon its passage.
