AN ORDINANCE AMENDING THE ZONING ATLAS OF THE
CITY OF CLEARWATER, FLORIDA, 1980, AS AMENDED,
BY RECLASSIFYING AND ZONING CERTAIN PROPERTY
AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; '
PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED
ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on October 16, 1980, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning atlas of the City of Clearwater in accordance
with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to the
zoning atlas were approved by the City Commission after its evaluation of
all evidence presented at the said public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY ,
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA;
Section 1. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas
of the City of Clearwater, Florida of 1980", as amended, is amended to
indicate that fact as hereinafter set out:
Zoned as RPD-10 - Residential Planned Development with
Maximum of 10 Units Per Acre
A tract of land lying in Section 29, Township 28 South,
Rang; 16 East, Pinellas County, Florida, and being more
particularly described as follows: Commence at the NW
corner of said Section 29; thence N 89°45134" E along the
North line of said Section 29 for 208. 00 feet; thence
S 0.02106" W along the East line of a 208.00 feet wide
Florida Power Corporation right-of-way for 190. 06 feet;
thence S 89.57154" E for 625.00 feet, to the P. O. B. ;
thence continue S 89°57'54" E for 302. 87 feet, to the
intersection of the westerly right-of-way line of Countryside
Boulevard, said intersection being the intersection of a
curve concave to the NE, having a radial bearing of S 71'
5114511 W from the radius point, and along said westerly
right-of-way line for the following three (3) courses:
(1) thence southeasterly along the arc of said curve
having a radius of 1650.00 feet and a central angle of
20`51145", for 600.79 feet, to the point of reverse curvature
of a curve concave to the West; (2) thence southerly along the
arc of said curve having a radius of 1150. 00 feet. and a central
angle of 57.00100" for 1144.06 feet, to the point of tangency;
(3) thence S 18.00100" W, for 83.42 feet; thence N 72'00100" W
for 20.00 feet, to the point of curvature of a curve concave

to the South; thence westerly along the arc of said curve
having a radius of 1200.00 feet and a central angle of
21'34'33" for 451.88 feet, to the point of reverse curvature
of a curve concave to the North; thence westerly along the
arc of said curve having a radius of 1600. 00 feet and a
central angle of 10'43156" for 299.70 feet to the intersection
of said curve; thence N 0'02106" E for 1611.43 feet, to
the P. O. B.
Section Z. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 4. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166, 041, Florida Statutes.
Section 5. The Planning Director is directed to include and set out
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendments as hereinabove set out.
Section 6. The provisions of this ordinance shall take effect
immediately upon its passage.
