2223 ORDINANCE NO. 2223 9 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING CHAPTER 4, ALCOHOLIC BEVERAGES, OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA, 1962, TO PROVIDE AN EXCEPTION FROM THE ZONING RESTRICTIONS FOR MUNICIPAL GOLF COURSES; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, it is necessay to amend the current alcoholic beverage code to provide an exception for municipal golf courses; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That subparagraph (a) of Section 4-19, Zoning Regulations— Exceptions, of Chapter 4, Alcoholic Beverages, of the Code of Ordinances of the City of Clearwater,. Florida, 1962, be and the same is hereby amended to read as follows: Sec. 4-19. Zoning Regulations--Exceptions. (a) No zoning restrictions hereunder shall apply to any wdsting chartered or incorporated club, social club or golf club, as defined in Section 4.?1. In addition to the exception provided herein, the zoning restrictions contained in this Cha ter shall not apply to an municipal golf course. Section 2. 'All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 3. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 4. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes.
