AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, RELATING TO THE LAND DEVELOPMENT CODE; AMENDING SECTION 137.016, CODE OF ORDINANCES, RELATING TO LAND USE PLAN AMENDMENTS, TO EXCLUDE FROM THE IMPACT ASSESSMENT REQUIREMENT ANY LAND USE PLAN AMENDMENT FOR WHICH A CERTIFICATE OF CAPACITY HAS BEEN APPLIED FOR; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Paragraph (2) of Subsection (f) of Section 137.016(f), Code of ordinances, is amended to read: Sac. 137.016. Land use plan amendments. (f) Impact assessments, (2) Applicability.' Impact assessments shall be required in conjunction with any application for a land use plan amendment except land use amendment applications for which a certificate of ca acit has been a lied for pursuant to Section 137-062, where the land use plan amendment involves i"Yelying an area of five (5) acres or more and where the requested reclassification is from: a. Low density residential to medium density residential, high density residential, residential/office, commercial /tourist facilities, urban center or and/ep industrial; b. Medium density residential to high density 'residential, commercial/tourist facilities, urban center or aver industrial; C. High density residential to commercial/tourist facilities, urban center or anE#iep industrial; d. Residential/office to high density residential, commercial/tourist facilities, urban center or ante industrial; e. Commercial /tourist facilities to urban center or andier industrial; f. Public/semipublic to low density residential, medium density residential, high density residential, 'residential/off ice, commercial /tourist facilities, urban center or and/or industrial; g. Recreation/open space to any other plan classification or combination of classifications; or h.
