PROVIDING FOR ACCOUNTING, DEFINITIONS, RESPONSIBILITIES
FOR PAYMENT OF CHARGES, APPLICATIONS FOR SERVICE,
DEPOSITS, RATES AND CHARGES; AMENDING SECTION 50.05,
CODE OF ORDINANCES, TO INCLUDE THE CURRENT ADJUSTED
RATES FOR DOMESTIC WATER SERVICE, LAWN DATER METERS, AND
NATURAL GAS SERVICE, TO ESTABLISH NEW DEPOSITS FOR LAWN

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Chapter 50, Code of Ordinances, consisting of Sections 50.01
through 50.17, as amended by Ordinances 4957-90, 4993-90, 4994-90, 5015-90, and
505890, is further amended to read:
CHAPTER 50. IN GENERAL
Sec. 50.01. Utilities combined in one system.
All municipal utility properties real and personal of the city supplying
gas, water, wastewater, solid waste service and stormwater management in and to
the city and its citizens and inhabitants and users thereof, shall be accounted
for in accordance with generally accepted accounting principles, and shall be
controlled, operated, and maintained on a combined and consolidated basis as a
single utility system. Separate accounting records shall be maintained for each
of the foregoing services in order to determine revenues and operating expenses
for each service.
Sec. 50.02. Definitions.
For the purpose of this title, the words "shall" and "must" mean the

(a) Owner. The furnishing of water, gas, wastewater, solid waste, or
stormwater management services brings a substantial and valuable benef it to the
land and premises. The owner of any premises serviced with such services shall
be responsible for all utility charges due against the premises, except to the extent that such charges may be incurred by a tenant of the premises who is the 1-011

Sec. 50.04. Application for service.
(a) Establishing applicant status,
;,. (1) An applicant requesting utility service as an owner in possession
shall provide proof of ownership, in the form of a copy of the deed, title
r insurance policy or closing statement, with the application for service.
(2) An applicant requesting utility service as a tenant shall provide
proof of tenancy in the form of a receipt, lease or rental agreement, and the
name, address and telephone number of the owner or the owner's agent who is to
' be notified if the utility bill becomes delinquent, at the time of application
for service.
(3) Any owner or tenant who owns, rents, leases or operates developed
property within the City limits shall be considered a stormwater management
utility customer. Any applicant who is accepted subject to the conditions
specified in this section or any customer as defined by section 50.02 shall also
be considered a stormwater management utility customer.
(b) Reinstatement of utility services EKistinq seryiee re4nstat°d:
(1) Utility 6xisting services may be reinstated by the customer's
application for such service Lo thpough the utilitT-custamer support division
, and the payment of any appropriate fees,

or the tenant of the premises. Such application shall include, among other
things, the provisions of section 50.03.
(c) New service:
(1) Sewer`s. Any owner person who desires to have his or her premises

(d) Conditions precedent to final acceptance of application:
(1) No application for utility service shall be finally accepted from any

new, who has not received any utility service from the city for the previous
twelve (12) months, or any present customer who has been delinquent in payment
of a bill more than two (2) or Fnere times within the previous twelve (12) months,
unless the applicant pays, with the application, the applicable utility service
deposit as provided in section 50.05.

not more than seven consecutive days, upon application by property owner or the

L. Domestic water service, three day maximum. Domestic water service
for not more than three consecutive days, upon application by property owner or
the owner's agent. shall be secured by a deposit of fortv dollars ($140.00).
(2) Gas. Each meter service shall be secured by a minimum deposit of
twenty dollars (§20.00) or three (3) times the average monthly bill' for gas
service, whichever is greater.
(3) Solid waste S°?t4en. Each customer shall be secured by a minimum
ten-dollar ($10.00) deposit or three (3) times the average monthly bill for solid
waste collection service when t-he-eustemer is--net-en-the elty waters,,,
whichever is greater.
(4) Wastewater collection Sewer. Each customer shall be secured by a
minimum ten-dollar ($10.00) deposit or three (3) times the average monthly bill
for wastewater collection service when the eustemer in not -on the s4ty watelm
system, whichever is greater.
(5) Deposits of cash equivalents to guarantee payment of bills.
Commercial deposits in excess of one thousand dollars ($1,000,00) may be made by
a surety bond written by an insurance company authorized to do business in the
State of Florida, or through furnishing a letter of.credit from a bank, by making
an assignment to the city of a savings and loan investment certificate or
passbook, or a commercial bank savings or time deposit certificate, the form for

(5) Housing authorities, [Hemmer Wes A housing authority
created pursuant to Chapter 421, Florida Statutes, may fulfill deposit
requirements for the agency or tenants of the agency by letter of agreement to
be financially responsible for the required deposit or portion thereof.
Determination of average monthly bill. For the u ose of
deter-mining the amount of a deposit based upon the aver-one monthly b 11 the
average monthly bill shall be determined according to actual consumption at the
premises, regardless _of changes in ownership or occugancytfthe premises-, during
the preceding-twelve (12) months of actual-consumption.
Recalculation of deposits.
a. The amount of a required deposit may be reviewed and adjusted based
upon actual consumption during the customer's initial six months of'service, upon
request of the customer,
b. The city may-increase the deposit regu i rement_on -any account to three
f31 times the current monthly average bill at any time should that account be in
arrears or if the customer has resented a subse uentl dishonored check for
pa, eym nt or has had more than two (2) past due reminders in any consecutive twelve
12 month period.
,(9) Refund of deposits. The deposit for a residential or community
service organization account with an individual meter shall be returned after two
continuous ears of good account experience. For the purpose of this ara ra h
and for paragraph 10 below, " "good account experience" means not more than two
past-due reminders in any twelve-month period, no disconnection of service for
nonpayment, no dishonored checks, no evidence of meter tampering, and no evidence
of fraudulent use of the utilities system..
IO Deposit requirement exemption. Except for temporary- services an
applicant-for, service to a residential or community service organization account
with an individual meter shall be exempt from the deposit requirement if the
applicant presents written verification from a public utility that the applicant
has had good account experience during the most recent twelve-month Period, or
the last twelve-month period of service b the public utility if occurring within
the preceding twenty-four months. However, if the account should at any time be
in arrears, or if_the_customer should receive more than two--past-due reminders

limits of the city shall be subject to a surcharge equal to twenty-five (25) per
cent of the monthly charges.
e. A charge of the "monthly minimum" for a one-and-one-half (1 1/2) inch
water meter is required for a "deduct" meter for air conditioning cooling water
and similar purposes-but not for lawn irrigation purposes. This charge ehange

shall be required only where a separate irrigation meter cannot be set in the
right-of-way or easement and the meter reader must physically read and deduct

Sec. 50.06. Accounts due; method of bill and
billing when delinquent.
(a) All meters shall be read and bills for all charges shall be rendered '' OP

appeals the decision to terminate the service to the city manager. An appeal to
the city manager shall be commenced by the customer's filing a written request
with the utility customer support manager
within five (5) days of the date the notice was rendered. No agreement for
payment of delinquent charges shall operate to forgive or discharge such
delinquency until the charges are paid in full, and a breach of such agreement
shall give the city the right to terminate service immediately and without
further notice to the customer.
(c) Complaints relating to bills shall be made before the past due date
shown on the bill. Where the customer has not been billed for services rendered,
the city shall have the right to back-bill for any such services.
(d) Any bill in an amount greater than three dollars 3.00 which is not
paid within twenty-cne (21) days of the date the bill was rendered shall be
subject to a monthly penalty of two (2) per cent of the unpaid balance or three
dollars ($3.00), whichever is larger. However, such penalty shall not exceed two
hundred fifty dollars ($250.00) per month.
Sec. 50.065. Proration of Char es. Utility system charges for less than
a complete billing cycle ma be rorated as follows:
a Non-metered service. The prorated charge shall be the monthly fixed
fee divided b the number of days-in the billing cycle, multi lied b the number
of days of service availability.
b Metered service. For metered service-
(1) If the consumption was zero the monthly minimum fee shall be divided
b the number of days in the billing cycle, multiplied-by the number of days of
service availability.
1) If there was consumption, but less than the monthly minimum
consumption, the charge shall be either the charge for actual consumption or a
prorated fee determined as in paragraph 1 above whichever is greater.
3 If there was consumption equal to or greater than the monthly minfinum
consumption, the charge shall not be prorated.
Sec. 50.07. City to have lien for charges, assessments; when same
effective; exception.
The city shall have, as security for the collection of any utility rates,

assessments or charges due or to become due, for the use or consumption of
utilities supplied any premises, a lien upon the premises to which such utilities
are supplied. Such lien shall become effective immediately upon the distribution
of the utilities to the premises, except to the extent prohibited by Section
180.135, Florida Statutes, as amended from time to time, relating to unpaid
utility charges by former tenants.
Sec. 50.08. Resolutions making lien final and notice of lien.
Every six (6) months or less the city manager shall present to the city
commission a list of properties with unpaid utility charges setting forth the
owner's name, location of the property and amount of unpaid utility charges. The
city commission after notice to each property owner named on the list shall,
following any public hearing, consider the adoption of a resolution making the
lien described in section 50.07 final. Upon the adoption of such a resolution,
a the utility lien for the amounts contained in such resolution shall be and
constitute a lien superior in dignity to all other liens and encumbrances of
whatever kind and character save and except ad valorem taxes levied and assessed
by the state, county or city, and shall remain a lien against each such property
t.
Y; until paid. Following adoption of the utility lien resolution, the city manager
shall immediately cause such resolution to be filed with the city clerk. The city
'j manager may file and record, in the office of the clerk of the eounty circuit
court, notice of the utility liens against each such property, showing thereon
the amount of the lien and a legal description of the property.

Sec. 50.09. Termination of service; suit for collection of charges,

The city, by and through its officers, agents or employees, may, subject
to the notice and appeal process provided in section 50.06, terminate utility
w; service to any premises upon which any utility rates, assessments or charges
shall be accrued, or may institute suit for collection of such utility rates,
t assessments or charges in any court of competent jurisdiction, except to the
extent prohibited by Section 180.135, Florida Statutes, as amended from time to
time, relating to unpaid utility charges by former tenants.
Sec. 50.10. Foreclosure of lien.

At any time after the expiration of thirty '(30) days from the date of
adoption of the resolution provided for in section 50.08, the city may proceed
to foreclose such lien or liens in the same manner as provided for the

complying with the provisions of this Code.
Sec. 50.16. Inspection of premises; discontinuance of service.
As a condition of receiving or continuing to receive utilities service from
the city, the duly authorized representatives of the city shall be permitted at
reasonable times to make necessary inspections of utilities facilities on private
premises where such inspections are reasonably necessary to insure the compliance
with the ordinances of the city relating to such services. If for any reason
access is denied, a written notice will be delivered or mailed to the premises
and to the owner, if not owner occupied, stating a reasonable time in which such
inspection is needed to be made, the reasons therefor, and the effect of failure
to allow such inspection. If the city's duly authorized representative is then
denied access to the premises for such inspection, the city may then discontinue
all utilities services to such premises until such inspection is permitted.
Sec. 50.17. Information to customers.
Upon request of any customer of the utility system, it shall be the duty
of the utility providing service to provide the customer a copy or explanation
of the utility's rates applicable to the service furnished or to be furnished
such customer.

Section 2. Sections 50.13 and 50.14, Code of Ordinances, are repealed.
Section 3. This ordinance shall take effect immediately upon adoption;
however, the provisions of Section 50.05(b)(9), relating to refunds of deposits,
shall take effect July 1, 1991.
