as a "code enforcement officer." may issue a citation to a person to appear in
county court when the code enforcement officer upon LrsoLl investigation-has
reasonable cause to believe that the person has committed a civil infraction.
Employees who may be designated as code enforcement officers may include, but
are not limited to, code inspectors, law enforcement officers, or fire safety
ins ectors.
2. Prior to issuing a citation, the code enforcement officer shall
provide notice to the person that the person has committed a violation of a city
ordinance and -shall _establish a reasonable time period, not to exceed thirty
(30) days, within which the person must correct the violation. -if, upon
arsenal investi ation the code enforcement officer finds that the person has
not corrected the violation within the time period, the code enforcement officer
may issue a citation to the person who has committed the violation. The code
enforcement officer does of have to provide the person with a reasonable time
period-to ?correct the violation prior to issuing a citation and may immediately
issue a citation if the code enforcement officer has reason to believe that the
violation presents a serious threat to the public health, safety, or welfare,
or if the violation is irreparable or irreversible.
3. The form of the citation shall contain the following:
a. The date and time issued.
b. The name and address of the-gerson to whom the citation is issued.
C. The date and time the civil infraction was committed.
J. The facts constituting reasonable cause.
e. The number or section of the code or ordinance violated.
f. The name and authority of the code enforcement officer.
g. The procedure for the person to follow in order to pay the civil
enalt or to contest the citation.
h. The applicable civil penalty if a person elects to contest the
citation.
i. The applicable civil enact if a erson elects not to contest the
citation.

A.per3on who receives a citation-from a code enforcement office for
the violation of a city ordinance and who elects not to contest the citation
shall be sub ect to a c vil enalt in acco dance with the following-schedule:
a. For a Class I violation b a fine of one hundred thirty-five
dollars. ($135.04) plus court costs.
b. For a Class II violation, b a fine of sixty dollars 60.00 plus
court costs.
C. For a Class III violation, by a fine of thirty dollars ($39.00) plus_
court costs.
5. An Person who fails to a the appropriate civil enalt within the
time allowed, or who fails to appear in county court to contest the citation,
shall be deemed to have waived his right to contest the citation, and "iudgmut
may be entered against the person for an amount not to exceed five hundred
dollars 500.00. ,
6. The provisions of this subsection shall not apply to the enforcement
pursuant to sections 553.79 and 553.80„ Florida Statutes of building codes
adopted pursuant to section 553.73 Florida Statutes as the apply to
construction, provided that a building permit is either not required-or has been
issued b the city. For the purposes of this paragraph- "building codes" means
only those codes adopted pursuant to section 553.73, Florida Statutes.
T. The provisions of this subsection are an additional and supplemental
means of enforcing city codes or ordinances. Nothing contained in this
subsection shall prohibit the city from enforcing its codes or ordinances by any
other means.
(d) +4 In addition to the penalties hereinabove provided, any condition
caused or permitted to exist in violation of any of the provisions of this Code
or any ordinance shall be deemed a public nuisance and may be, by the city,
abated as provided by law, and each day that such condition continues shall be
regarded as a new and separate offense.
Section 2. Section 71.36, Code of Ordinances, is created to read:
Sec. 71.36. Penalty.
Any person who violates any of the terms of this chapter may be ordered
to pay a fine by the municipal code enforcement. board in accordance with chapter

subject to the imposition of a civil penalty! in-accordance with section 1.08(c),
Code of Ordinances, An violation of this chapter-which is subject to a civil
penalty as set forth in section 1.08(c) shall be a Class III violation.
Section 3. Sections 95.06, 95.07, and 95.13, Code of Ordinances, are
amended to read:
Sec. 95.06. Designation of investigating and enforcement authority;
authority of code enforcement officers .
The code enforcement officers of the lannin and -development department,
and other emplo rL_e_es -duly authorized by the city manager as _code enforcement
officers, are hereby
designated as the investigating and enforcing authorities authar4ty pursuant to
the prey4s4ens this chapter. The code enforcement officers are S°R?n
diyic;iAA 4s hereby authorized and directed to receive all complaints of a
violation of this chapter, make inspections to determine if a violation of this
chapter exists, gather all relevant information concerning such complaints,
conduct field investigations and inspections of real property, and to enter upon
real property, with or without a warrant as required by lawn in the conduct of
-ids' official business pursuant to this chapter. The code enforcement officers
shall provide all notices to affected property owners
required by this chapter and shall to take such other action as may be as.
reasonably necessary to accomplish the purpose of this chapter.
Sec. 95.07. Notice of violation and hearing.
(a) Upon receipt of a complaint that property is in violation of this
chapter and upon completion of the field investigation by the code enforcement
officer rani tat4en MY449n and` determination that a violation exists, the
property shall w4-4 be posted with a notice advising of the existence and nature
of the violation and requesting compliance on or before a date certain, which
shall be the day before the date of a regularly scheduled meeting of the code
enforcement board but which shall be not less than twenty-one (21) days after
the date of posting. A copy of the notice shall w444- be sent to the property
owner by mail on or before the date of posting, or by personal service within
fourteen (14) days after the date of posting.
Sec. 95.13. Grace period prior to establishment of liens.
Prior to the assessment of liens by the city commission in accordance with

foreclosure of liens and providing for appeals set forth in sections 22.67 and
22.68 of the Code of Ordinances of the city shall be fully applicable to a
finding of violation of the article by the board.

Section 6. Section 137.034, Code of Ordinances, is amended to read:
Sec. 137.034. Violations.
(a) Generally Violations of this development
code shall include, but are not limited to, the following:
(1) The use, alteration or construction of buildings or signs or the use
or improvement of land not in accordance with the provisions of this development
code or with approvals given or permits issued pursuant to this development
code.
(2) The Fa4lure to obtain permits as required by this
development code.
(3) The failure Faili, to comply with the terms, conditions or
restrictions of a conditional use, variance, site plan or subdivision plat
authorized pursuant to this development code.
(b) Remedy. Upon determination by the development code administrator
that any provision of this development code is being violated, the code
administrator shall proceed to correct the violation by action authorized by law
which may include the issuance of a citation for hearing before the municipal
code enforcement board in accordance with the procedures contained in chapter
22 of the Code of Ordinances or the issuance of a citation or notice to appear
and f4l4ng of-same in Pinellas County Court. In addition, where the city
commission further finds and declares that any violation of the provisions of
this development code constitutes an irreparable injury to the citizens of
Clearwater, the city attorney aet4ng-a;-behalf- -{ the c?tren's' shall have

authority to seek injunctive relief to terminate or prevent such violation.
