ORDINANCE NO. 4961-90
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING THE ZONING ATLAS OF THE CITY BY REZONING
CERTAIN PROPERTY LOCATED ON THE NORTH SIDE OF CLEVELAND
STREET, APPROXIMATELY 120 FEET EAST OF NORTH GARDEN
AVENUE, AS DESCRIBED MORE PARTICULARLY HEREIN, FROM
URBAN CENTER-CORE DISTRICT (U/CC) TO OPEN
SPACE/RECREATION (OS/R); PROVIDING AN EFFECTIVE DATE.
WHEREAS, all applicable requirements of the Local Government Comprehonsive
Planning and Land Development Regulation Act have been complied with in
connection with the amendment set forth in this ordinance; and
WHEREAS, the amendment set forth in this ordinance is found to be
reasonable, proper and appropriate, and in the public interest; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater, Florida, is
hereby rezoned, and the zoning atlas of the City is amended as follows:

See Exhibit A attached hereto. From: Urban Center-Core District (U/CC)
(Z 9D-2)
To: Open Space/Recreation (OS/R)
Section 2. The City Commission does hereby certify that this ordinance
is consistent with the City's Comprehensive Plan.
Section 3. The Planning Director is directed to revise the zoning atlas
of the City in accordance with the foregoing amendment.
Section 4. This ordinance shall take effect immediately upon adoption,
subject to the approval of the land use category set forth in Ordinance No.
4966-90 by the Pinellas County Board of County Commissioners.

A portion of the former Seaboard Coastline Railroad Company's right-
of-way, lying in Section 16, Township 29 South, Range 15 East,
conveyed to the City of Clearwater in Official Records Book 3473,
Page 918 of the public records of Pinellas County, Florida, being
more particularly described as follows:
Commence at the Northeast corner of said Section 16; thence S
88°58'40" W along the North line of said Section 16 for 614.19 feet;
thence S 03°06'40" W along the Easterly line of said former railroad
right-of-way line for 692.31 feet to the POINT OF BEGINNING; thence
continue S 03°06'40" W along said Easterly line for 198.42 feet to
the Easterly prolongation of the Northerly right-of-way line of
Cleveland Street as established by the City of Clearwater resolution
as recorded in Deed Book 1188, Page 181, of the public records of
Pinellas County, Florida; thence S 88°47'08" W along said Northerly
right-of-way line for 86.14 feet; thence N 01°30'25" W for 169.78
feet; thence N 88°30'47" E for 29.29 feet; thence N 43°30'47" E for
