RELATING TO BEACHES AND WATERWAYS; AMENDING SECTIONS
114.72, 114.75, 114.76, 114.77, 114.78 AND 114.79, CODE
OF ORDINANCES, RELATING TO THE RESTRICTED AREA AT
CLEARWATER BEACH; PROVIDING DEFINITIONS; REQUIRING THAT
WAIVER APPLICATIONS BE FILED BY UPLAND OWNERS HAVING
RIPARIAN RIGHTS, AND ESTABLISHING REQUIREMENTS FOR THE
SUBMISSION AND APPROVAL OF SUCH APPLICATIONS; CREATING
SECTION 114.765, CODE OF ORDINANCES, TO ESTABLISH
SPECIAL OPERATING CONDITIONS FOR THE OPERATION OF ;
VESSELS UNDER APPROVED WAIVERS AND TO IMPOSE PENALTIES
FOR VIOLATING THE CONDITIONS; PROVIDING CONDITIONS FOR
THE DENIAL OF A WAIVER APPLICATION AND FOR THE
REVOCATION OF A WAIVER; PERMITTING ONLY ONE CORRIDOR FOR
EACH UPLAND PROPERTY; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Sections 114.72, 114.75, and 114.76, Code of Ordinances, are
amended to read:
Sec. 114.72. Definitions.
As used in this article:
is "Business operator" means a lessee, licensee, franchisee,or other
person expressly- authorized b the owner to en a e in the business of rentin
watercraft on or seaward of the owner's upland beachfront property.-
(2) "Chase or emergency watercraft" means a watercraft available solely
for the purpose of effecting a sea rescue in an emergency or for the purpose of
ensuring that rental watercraft are operated in compliance with federal or state
law or with city or county ordinances. The term does not include watercraft
used for rental.
"Corridor" or "marked corridor" means a defined area.'within the
restricted area leading from the shoreline to the western- boundary of the
restricted area established in conjunction with the a roval'of a waiver from
the provisions of section 114.71 pursuant to this article in which watercraft
may be operated subject to the conditions of this article and the terms of the
waiver approval.
j4 , "Customer" means a person- renting watercraft to be operated in a
corridor or using watercraft o erated in a corridor whether or not
consideration has-been aid for such use. The term does not mean an-owner, a
business operator or an employee of either.
,(5) "Manually powered watercraft" means watercraft which- uses human
physical effort as its primary source of motive propulsion. The term does not

"Mechanically powered- watercraft" means watercraft which uses an
internal combustion en ine or an electric motor as its rimar source of motive
propulsion.
(7) "Owner" means the owner of upland beachfrogtrpronrty having
riparian rights.
M "Personal watercraft" means a Class A under 16 feet inboard vessel
which uses an internal combustion engine owerin a water 'et um as its
rimar source of motive propulsion, desi ned to he aerated - by --a. person
sittin_g,_standin or kneeling on or-being towed behind, the vessel rather than
in the conventional manner of sitting or standing inside the vessel.
M "Restricted area" means the area defined in section 114.71.
N "Watercraft" The words "watereraf " and 44reraftur-c" as used het e4R
shall include, but not be limited to, any boat, vessel, barge, personal
watercraft, surfboard, skimboard, water ski, windsurfer, 'et sM, wet ,
r a4plane, seaplane, hel4eeptep, ultral4gkr
or any other similar contrivance or
device used or capable of being used as a means of transportation on the water.
11 "Watercraft operator" means a person who is in actual physical
control of or steering a watercraft or who is exercising control over or
steering an device being towed by a watercraft.
Sec, 114.75. Exceptions.
Exceptions to the provisions of section 114.71 above shall be limited to
the following:
(1) Special events of short-term duration such as regattas, tournaments
and events of a similar nature where, in the opinion of the city manager
, such events can be safely conducted at eegin
specifically defined and designated locations within the aforesaid restricted
area. Applications for such special events shall be submitted, preeessed,
reviewed and acted upon as provided under article III of chapter 116 seet;on
116T39 -ef the GUy cede.
(2) The operation through a corridor of watercraft belonging to an owner
or business operator after the owner has obtained a waiver for such watercraft

conducted under the waiver.
(0+4 The name, address and telephone number of any business
operator who will be
responsible for any activity conducted under the waiver and the signature of the
business operator-or person representing the business operator.

revocation of the waiver pursuant to the procedure contained in sec. 114.78.

marking system.
.C-{* A complete description of all activities proposed to be
conducted under the waiver, including a description of the type, size and
numbers of watercraft or irepa f to be operated and a statement of provisions
to be made for the safety of the public during operations under the waiver. The
maximum number of watercraft allowed to be operated from the owner's ro ert
shall be set Proportionate to the front footage of real property along the
shoreline with a ratio of one watercraft per five feet of frontage, up-to a
maximum of 20 watercraft per property.- of--which no more than 40% shall be
mechanical) powered. If less than all of an owner's property is leased to a
business operator, the maximum number _of watercraft allowed to be operated by
the business o erator shall be no more than 20, in proportion that the front
footage of the leased property bears to the front footage of the owner's
property. The number of watercraft allowed to be operated from an owner's
property shall not be transferable to another owner's ro ert direct) or
indirectly, by sale or by lease, except as the result of the sale of the fee
title interest of an owner to another owner having riparian rights. For the
ur oses of this subsection the chase or emergency watercraft required to be
available by this section shall not be counted. -
M A statement that the, owner or business operator shall provide
watercraft operators renting watercraft a written form notifying the watercraft
operators of the special operating conditions set forth in Section 114.765 and
of the applicable fine for violating any of the conditions. Before permitting
rental watercraft to be operated within the corridor, the owner or business
operator shall have the watercraft operator sin the form acknowledging that
the operator has read the form and will comply with the special- operating
conditions.

such a roval has been ranted b the planning and zoning board rior to the
submission of the waiver application.

safety watch in the water, whenever any rental watercraft is in operation within
the corridor, and shall warn all swimmers to stay out of the corridor until the
watercraft has cleared the corridor. For limited purposes of this paragraph,
- "watercraft" shall not include manually powered watercraft.

Section 2. Section 114.765, Code of Ordinances, is created to read:
Sec. 114.765• Same--Special operating conditions: penalties.
ja A watercraft operator who is operating watercraft for which the
owner has been ranted a waiver shall comply with the following conditions:
(a), A watercraft o erator shall not operate any watercraft within the
area described in section 114.71 except within the boundaries of the corridor.
A watercraft operator shall not operate an watercraft within the
corridor until all other watercraft being operated in the corridor have cleared
the corridor. As an exce tion to the foregoing, "watercraft" shall not include
manual) powered watercraft or the chase or emergency watercraft required to be
available b this article and the owner or business operator and their

(1) The application is incomplete in a material respect.
(2) The application has been fraudulently completed.

customers of an owner or business operator have been_issued -six citations within

subsection,-only those citations resulting in a_f_inding of ?quilt by a court of
law, or for which a plea of guilty or nolo contendere is entered, regardless of
