of Clearwater, Case Numbers 88-7284-14 and 89-10982-88 and 40.
WHEREAS, an order was entered in Case Number 89-10982-BB on September
22, 1989, staying the effective date of Ordinance 4614-88 until the dispute is

both of such civil actions, a copy of which is attached hereto as Exhibit B and
the original of which has been filed in the Circuit Court, and one of the

annexation shall be changed from June 15, 1989, to November 15, 1991, as provided

Section 2. It is the specific intent of the City Commission that:
(1) This ordinance shall be applied retroactively to the date of
adoption of Ordinance 4614-88, such that the property described herein shall be
deemed annexed into the City of Clearwater effective as of November 15, 1991;
(2) The property described herein shall not be deemed to-have been
included within the corporate limits of the City between June 15, 1989, and the
date of adoption of this ordinance; and
(3) This ordinance shall not be deemed a contraction of the corporate
limits of the City.
Section 3. This ordinance shall take effect immediately upon adoption,
subject to and contingent upon the full and complete execution of the settlement
agreement by all parties, including all owners of all lots in Elysium Phase I
Subdivision, a copy of which settlement agreement is attached hereto as Exhibit
B, and the entry of final judgment in each of the above-described civil actions
in full accordance with the settlement agreement.
