RELATING TO THE LAND DEVELOPMENT CODE; AMENDING SECTIONS
136.022 AND 136.025, CODE OF ORDINANCES, TO ESTABLISH
STANDARDS FOR NONCOMMERCIAL PARKING AS A CONDITIONAL USE
ON RESIDENTIALLY-ZONED PROPERTY OR IN THE LIMITED OFFICE.
DISTRICT TO PROVIDE ACCESSORY PARKING FOR ADJOINING
NONRESIDENTIAL PROPERTY; PROVIDING AN EFFECTIVE DATE.

Section 1. Paragraph (1) of Subsection (f) of Section 136.022, Code of '

Sec. 136.022. Parking standards.
(f) Off-street parking spaces.
(1) Location.
a. All required off-street parking spaces shall be provided on the same
parcel of land occupied by the use to which the spaces are appurtenant, or in >`.

residential or limited office uses if where such parking is not required by this
development code to serve another use and is guaranteed to remain available

•Sec. 136.025. Conditional use standards.
(c) Supplementary standards, by category of use. The following standards
(which apply to the identified category of use) shall supplement the general
standards of use identified above and no conditional use shall be authorized
unless determined to meet all of the standards applicable thereto.
(19) Noncommercial parking lots may be permitted on property zoned
residential or "
p „ "Twenty," " 77 " 04striets and the Limited aRd Office District upon determination that:
a. Single-family residential property may be used for noncommercial
firkin only-when such parking is accessory to a primary use in an adjoining
public/semipublic district. However, such parking on single-family residential
property shall not be used for any portion of the off-street parking required
by-this code; such parking shall be provided only for excess or overflow parking:
the narking lot shall not be surfaced; access. directly from the street or from
adjoining residential Property shall not be provided to a parking lot located
gn single-family residential?property; the area, lot width and lot, depth of
sin le-famil residential property used for noncommercial arkin shall not be
considered in determining whether the afloining public/semipublic property meets
the applicable dimensional and numerical -development requirements. and a
conditional use for-parking on single-family residential property shall not run
with the land but shall expire upon a change of use of the adjoining
Public/semipublic property.
b. The parking lot shall be designed, surfaced and landscaped in accord
with all applicable requirements contained in this development code: however,
surfacing shall be prohibited on sin le-famil residential property.
c.l?-r Access to the parking lot shall not be provided directly from the

street or from any residentially zoned property adjoining the property, which is
the subject of the conditional use application, unless specifically authorized
by the planning and zoning board` however, access directly from the street or
from ad'oin'in residential Property shall not be provided to a arkin lot
located on-single-family residential -property.
d.p-r The use shall comply with all of the general standards contained in
preceding paragraph (b).
