A ORDINANCE.NO. 4895-8 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, PROHIBITING CERTAIN CONDUCT IN ANY PUBLIC PLACE IN SUCH A MANNER AS TO DEMONSTRATE THE SPECIFIC PURPOSE OF INVITING, ENTICING OR SOLICITING ANOTHER TO ENGAGE, AGREE TO ENGAGE OR OFFER TO ENGAGE IN PROSTITUTION OR OTHER SEXUAL ACTIVITY IN VIOLATION OF FLORIDA LAW; CREATING SECTION 150.15, CODE OF ORDINANCES; PROVIDING AN EFFECTIVE DATE. Wk?•?ij` i. ordinance serves a proper public purpose and is necessary to the public health, safety and welfare; now, therefore, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Section 150.15, Code of Ordinances, is created to read: Sec. 150.15. Loitering for prostitution or other unlawful sexual activities. =}rr (a) This section may be referred to as the "loitering for prostitution" . I A t ordinance of the City of Clearwater, but nothing herein shall be construed as n . prohibiting mere loitering in any public place. ? `I o 1 WHEREAS, prostitution and certain other sexual activities as specified in this ordinance are criminal in nature and endanger the public health, safety and welfare by facilitating the spread of certain communicable diseases including but not limited to Acquired Immunity Deficiency Syndrome (AIDS); and WHEREAS, the practice of engaging in certain conduct as described herein in a public place in such manner as to demonstrate the specific purpose of inviting, enticing or soliciting another person to engage, agree to engage, or offer to engage in prostitution or any of the other sexual activities specified herein is also contrary to the public health, safety and welfare because of the tendency of persons engaging in such conduct to congregate in commercial and A residential neighborhoods of the City with detrimental effects on such neighborhoods arising from the conduct of such persons and their "customers," including the sale and possession of controlled substances and other illicit activities; and WHEREAS, municipal ordinances prohibiting such conduct have been upheld against challenges on constitutional grounds in ten states and the District of Columbia, including a decision in which the U. S. 'vim"? .."?«r• ? ?'.. .?? ?r.L?• (b) As used in this section: (1) "Prostitution" shall have the meaning set forth in Section 796.07(1), Florida Statutes (1987), as the same may be amended from time to time, t.f t (2) "Public place" means any street, sidewalk, bridge, alley, park, driveway, or parking lot, whether publicly owned or open to public access. (3) "Sexual activity" shall have the meaning set forth in Section 796.07 (1) , Florida Statutes (1987), as the same may be amended from time to and shall also include any act of lewdness or assignation as those terms time , are defined in said section. (c) It shall be unlawful for any person to engage in any of the following b..:,.: conduct while in a public place with the specific intent to invite, entice or solicit another person to engage, agree to engage, or offer to engage in klfll?` prostitution or other sexual activity in violation of Florida Law: . f ?:_• (1) Repeatedly beckoning to, repeatedly stopping, or repeatedly ' is#y# . :F attempting to stop passersby, or repeatedly attempting to engage passersby in ' _. conversation; or F (2) Repeatedly stopping or attempting to stop motor vehicle ; _o operators. y= (d) After the arresting officer has made a determination of probable ' s{-•?.y,,,. i• ?`. of cause that a person has violated this section, and prior to arresting the person, '•+kj A the officer shall afford the person an opportunity to explain his or her conduct. Refusal by the person to explain his or her conduct to the arresting officer k1::: . ?'! yr shall not be deemed an element of the offense or evidence establishing probable .'r'af5 tifr S }`= cause that the person has violated this section, nor shall such refusal be admissible against the person in a trial of the offense. No person shall be rry Z*SS :s convicted for violating this section if it appears at trial that the explanation t''S r given was true and disclosed a lawful purpose. r} ; ;?.?. (e) No police officer shall arrest an individual for a violation of this section based on facts and circumstances creating only-a well-founded suspicion rr. that the section is being violated and thus justifying only a temporary detention t of the individual by a police officer. (f) No police officer shall arrest an individual for a violation of this section for the mere act of loitering, or soliciting a ride from a motor vehicle operator, or entering a motor vehicle, or waving at passing motor vehicles. (g) The prior criminal record of a person shall be admissible to the extent authorized by Section 90.404(2), Florida Statutes, to prove motive or intent, but shall not constitute the sole evidence of specific intent under this section. (h) "Specific intent," as used in this section, may be inferred from repeated invitations or suggestions to passersby which a cautious person would believe constitute invitations or suggestions to engage, agree to engage, or offer to engage in prostitution or other sexual activity in violation of Florida law, or from hand gestures by the individual to the breast, groin or buttocks of the individual or of passersby, or from the intentional exposure to passersby of a sexual organ in violation of Section 800.03, Florida Statutes. "Specific intent" shall not be inferred from conduct under circumstances indicating that an individual is seeking assistance in an emergency situation, or is conducting an opinion poll or otherwise seeking information from passersby, or is otherwise engaged in lawful, innocent conduct.
