AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO THE CLEARWATER CODE ENFORCEMENT BOARD;
AMENDING SECTIONS 22.61, 22.64, 22.65, 22,66, 22.67,
22,69 AND 22.70, CODE OF ORDINANCES; TO CHANGE THE
FUNCTION, APPOINTMENT AND TERM OF OFFICE OF BOARD
MEMBERS; TO PROVIDE A PROCEDURE TO INITIATE ENFORCEMENT
ACTION AGAINST REPEAT VIOLATIONS; TO PROVIDE FOR THE
RECORDATION OF A CERTIFIED COPY OF THE BOARD'S ORDER TO
BIND SUBSEQUENT PURCHASERS OF THE REAL PROPERTY WHERE
THE VIOLATION EXISTS; TO CLARIFY THE POWERS OF THE
BOARD; TO CHANGE THE PROCEDURE INVOLVING THE IMPOSITION
OF A FINE AND THE AMOUNT OF THE FINE FOR A REPEAT
VIOLATION; TO CREATE A PROCEDURE FOR THE ENFORCEMENT OF
THE FINE AGAINST THE VIOLATOR'S PROPERTY; TO PROVIDE FOR
THE ACCRUAL OF FINES, AND TO SHORTEN THE PERIOD FOR THE
FORECLOSURE OF LIENS; TO PROVIDE FOR THE METHOD OF
NOTIFYING AN ALLEGED VIOLATOR; AND TO CREATE A
DEFINITION FOR "REPEAT VIOLATION"; PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA;
Section 1. Subsections (a), (b) and (d) of Section 22.61, Code of
Ordinances, are amended to read:
Sec, 22,61. Function, appointment and term of office.
(a) The Clearwater Code Enforcement Board shall have the purpose of
conducting hearings relating to violations the enfe-neement of codes and
ordinances in force in Clearwater,
(b) Appointments to the code enforcement board shall be made by the city
commission on the b_asis• of experience or interest in the subject matter
Jurisdiction of the board. The membership, of each board shall whenever
ossible include an architect a businessman an engineer, a _general
contractor, a subcontractor, anda realtor. ,

(d) Thereafter, appointments shall be for a term of three (3) years.
Members may be reappointed for-nM sueeess4ye a upon the concurrence of the
city commission. Appointments to fill any vacancy on the board shall be for the
remainder of the unexpired term of office.
Section 2. Subsection (3) of Section 22.64, Code of Ordinances, is
renumbered as subsection (4), and a new subsection (3) is added to said section,

Sec. 22.64. Enforcement procedure.

Except where the inspector charged with enforcing a particular code or
ordinance identified herein has reason to believe that a code violation presents
a serious threat to the public health, safety and welfare, the code enforcement
procedure under this article shall be as follows:
L31 If a repeat violation is found the code inspector shall notify-the
violator, but is not reguired to give the violator a reasonable time-to correct
the violation, The code inspector, upon .notifying the violator of a repeat
violation shall notify the board and request a hearing. The board through its
clerical staff, shall schedule a hearing and shall provide -notice as rovided
by this article to said violator.. The case may be-presented-to the board even
if the repeat violation has been corrected prior to the board hearing, and the
notice shall so state.
Section 3. Subsection (g) is added to Section 22.65, Code of Ordinances,
to read:
Sec. 22.65. Hearing Procedures.
LI A certified co of such order may be recorded in the public records
of the count and shall constitute notice to an subsequent -purchasers,
successors in interest or assigns if the violation concerns real property, and
the findings therein shall be bindin upon the violator and, if the violation
concerns real property, any subseguent?purchasers, , successors in interest or
assigns., if an order is recorded in the public records pursuant to this
subsection and?the_order is complied with-by •the date specified in"the. order,.
the board shall issue an order acknowledging compliance which shall be recorded
in the public records. A hearino is not required to issue such an order
acknowledging--compliance.
Section 4. Subsection (3) of Section 22.66, Code of, Ordinances, is
amended to read:
Sec. 22.66. Powers of the code enforcement board.
The Clearwater Code Enforcement Board shall have the power to:
(3) Subpoena evidence to its hearings.
Section 5. Section 22.61, Code of Ordinances, is amended to read:
Sec. 22.67. Fine, lien and foreclosure.
(a) Upon being notified by the code inspector that an order issued by
the board has not been complied with within the time established in such order

A certified copy of an order imposing a fine may be recorded in
the public records of the county, and thereafter such order shall constitute a
lien against the land on which the violation exists and upon any other real or sf:°r,•

Section 7. Section 22.70, Code of Ordinances, is amended to read:
Sec. 22.70. Definitions.
+As used in this article, the terms enumerated below shall have the
meanings ascribed to them by this section, unless the context requires
otherwise:+
"Repeat violation:" A violation of a provision of a code or ordinance h
