ORDINANCE NO. 64-8
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO14TAXICAB, RATES';'AMENDING SECTION 61.50, CODE
OF ORDINANCES, TO DELETE THE SCHEDULE OF RATES, AND TO
PROVIDE THAT A TAXICAB COMPANY MAY AMEND ITS SCHEDULE
OF RATES SUBJECT TO CERTAIN FILING AND NOTICE
REQUIREMENTS; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Clearwater has received a request from Pinellas County
Yellow Cab to increase the minimum insurance requirements for bodily and property
damage; and
WHEREAS, Pinellas County Yellow Cab has also requested that the City
"deregulate" taxicab rates; and
WHEREAS, the City Commission finds that the amendments to Section 61.50,
Code of Ordinances, are proper and in the public interest; now therefore
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY'OF
CLEARWATER, FLORIDA:
Section 1. Section 61.50, Code of Ordinances, is amended to read:
Sec. 61.50. Schedule of rates: rate amendments.
(a) No taxicab company or taxicab operator which regularly does business
in the city or picks up passengers in the city shall charge a greater sum for
the use of a taxicab than in accordance with the rates established b the taxicab'
company and in effect at the time of the use of the taxicab. For the purposes
of this section the rates in effect on February 17, 1989, as set forth in
Ordinance 4773-89 of the city, shall be deemed to be "established b the taxicab
company." Amendments to such rates shall be established in accordance with the
following procedures and limitations:
1 The amended rate schedule clearly-showing the existing rates the
proposed new rates and the proposed effective date shall be filed with the cit
clerk not less than twenty 20 days prior to the effective date.
2 The taxicab company shall publish a notice of intent to amend its
rates in a newspaper of general aid circulation in the city which meets the
requirements of Section 50.031 Florida Statutes not less than twenty 20 days
prior to the effective date. The notice shall clearly show the existing-rates,
the ro osed'new rates the-proposed effective date and the name address and
telephone number of an officer or employee of the taxicab company designated to
respond-to questions from the public regarding the proposed rate change. The

h eafte" The number of passengers being transported shall not affect the
rate, although no operator transporting a passenger for hire shall permit any
other person to occupy or ride in said taxicab unless the person or persons first
employing the taxicab shall consent to the acceptance of an additional passenger
or passengers.
{--} The schedule of rates shall include a rate for waiting time.
Waiting time. Twenty eents ($9,20) per m4 nute 9P twelye dollars ($12-00) per
houp. The taximeter clocking device shall be so regulated as to activate the
waiting rate when the taxicab is operated at speeds of twelve (12) miles per hour
or less.

(b) It shall be unlawful for any driver, operator or chauffeur of any
meter-equipped taxicab to charge a fare either greater or less than the fare as
registered on the taximeter.
