WHEREAS, Chapter 75, Code of Ordinances, which relates to massage parlors
and bathhouses, is derived from Ordinance 1588-75, which was adopted on October

2, 1975; and
WHEREAS, at the time of adoption of said ordinance, the practice of massage
in the State of Florida was not effectively regulated, and "massage parlor"
became a euphemism for an establishment engaged in illicit practices; and
WHEREAS, the Florida Legislature enacted Chapter 480, Florida Statutes,
in 1978 in order to create the Board of Massage within the Department of
Professional Regulation and to establish requirements for the licensure of
masseurs (now "licensed massage therapists") and massage establishments; and
WHEREAS, although Section 480.052, Florida Statutes, permits counties and
municipalities to regulate persons and establishments licensed under Chapter 480,
Florida Statutes, the City of Clearwater's regulations as set forth in its Code
of Ordinances have not been comprehensively reviewed since the adoption and
implementation of the general law and administrative rules of the State of
Florida relating to the practice of massage; and
WHEREAS, the City Commission finds and declares that the amendments to
Chapter 71 and 75 of the Code of Ordinances as set forth herein are reasonable
and reflect the fact that the practice of massage in the State of Florida has
become a well-regulated industry; now therefore

(1) The premises shall have adequate equipment for disinfecting and
sterilizing nondisposable instruments and materials used in administering
massages-ev% baths. Such nondisposable instruments and materials shall be
( disinfected and sterilized after use on each patron.
(2) Closed cabinets shall be provided and used for the storage of clean
ft linen, towels and other materials used in connection with administering massages
1 o-P baths. All soiled linens, towels and other materials shall be kept in
}
properly covered containers or cabinets, which containers or cabinets shall be
kept separate from the clean storage areas.
(3) Clean linen and towels shall be provided for each patron. No common
use of towels or linens shall be permitted.
(4) All massage par!or or bathhouse tables, bathtubs, shower stalls,
steam or bath areas and floors shall have surfaces which may be readily
disinfected.
(5) Adequate bathing, dressing, locker and toilet facilities shall be
provided for the number of patrons to be served at any given time. In the event
male and female patrons are to be served simultaneously, separate bathing,
dressing, locker, nd toilet and massage -ran facilities shall be provided.
Separate toilet and lavatory facilities shall be maintained for personnel. Doors
to all dressing rooms shall be self'-closing.
(5) All walls, ceilings, floors, pools, showers, bathtubs, steam rooms
and all other physical facilities shall be in good repair and maintained in a
clean and sanitary condition. Wet and dry heat rooms, steam or vapor rooms, sf%
steam or vapor cabinets, shower compartments and toilet rooms shall be thoroughly
cleaned each day the business is in operation. Bathtubs and showers shall be
thoroughly cleaned after each use. When carpeting is used on the floors, it
shall be kept dry.
(7) The premises shall be equipped with a service tank for custodial,
services.
(8) The eating of food or the consuming of alcoholic beverages in the
bath work areas shall not be permitted.
(9) Animals, except Seeing Eye dogs, shall not be permitted in the
massage oi- bath work areas.

Sec. 75.07. Unlawful yea conduct.
It shall be unlawful for any massage-ep bath technician, employee,
patron or other person in a massage -papaf-er bathhouse, to place his or her hand
' or hands upon, to touch with any part of his or her body, to fondle in any
manner, or to massage or bathe, a sexual or genital part of any massage-ep bath
technician, employee, patron or other person.
s^ -} It shall be unlawful for any massage or bath technician, employee,
patron or other person in a bathhouse, to expose his or her
sexual or genital parts, or any portion thereof, to any other massage or bath
technician, employee, patron or other person. It shall also be unlawful for any
massage-ep bath technician, employee, patron or other person in a massage Pa
ers bathhouse, to expose the sexual or genital parts, or any portion thereof, of
any other massage or bath technician, employee, patron or other person.

patron or other person while in the presence of any massageor bath technician,
employee, patron or other person in a bathhouse, to fail to
conceal with a fully opaque covering, the sexual or genital parts of his or her

his control or supervision to perform such acts as are prohibited in subsections

Sec. 75.20. Required.
(a) It shall be unlawful for any person to estab s o ^n+? .h,
maintai* operate epeendmet-a a bathhouse within the
Gepperate limits ef the city without a valid, current nensuspend permit issued
to smeh person pursuant to the terms and send ;ensof this article, in addition
to the occupational license required by chapter 71.
(b) It shall be unlawful for any person to perform the services of a
massage ep bath technician within the eepperate limits of city without:
(1) A valid, current nonsuspen public health card issued to that
person; and
(2) A valid, current weeded permit issued to such person pursuant
to the terms and eendit4ens of this article A -k-s e+f.
Sec. 75.21. Application for permit: fee
Any person desiring a permit to establish or operate
a bathhouse within the eaerperate limits of V .
city, shall make application therefor to the city's occupational license
inspector on forms provided for that purpose presef4hed by that .
Each massage pap4or--si- bathhouse shall require a separate applicat4on ter
permit. Each massage parlor or bathhouse permit application shall be
accompanied by a nonrefundable fee of ten dollars ($10.00) plus an additional
twenty-five dollars ($25.00) for each as applicable. , payable in cash or by

Sec. 75.22. Investigation of premises and issuance of permit: expiration.
The license inspector of the city, before issuing any permit, shall
investigate or cause an investigation to be made of the premises named and
described in the application for permit under this article for the purpose of
determining whether the massage parlor or bathhouse complies with the provisions
' of this chapter. If the license inspector is 4)e fully satisfied from such
investigation that the atassage pa l,,er er bathhouse is in conformity with the
provisions of this chapter, he shall, unless otherwise prohibited by section
75.26, issuer with4n thirty (39) days of the date of applieat4en , a

a physical examination for contagious and communicable diseases, which shall
include a, recognized blood tests test for syphilis and acquired immune
deficient syndrome,, a culture for gonorrhea, a chest x-ray which is to be made
and interpreted by a trained radiologist acceptable to the county health
department, and such other laboratory tests, done in a laboratory acceptable to

the county health department, as may be necessitated by the above examination,
and shall, iR aeeafdanee-with this seet-ien; furnish to the city licensing
department a certificate based upon and issued within thirty (30) days of such
examination, signed by a physician duly licensed by the state and stating that
the person examined is either free from any contagious or communicable disease
or incapable of communicating any of such diseases to others.
(3) If the licensing inspector is 4e fully satisfied that the massage
op bath technician application is in conformity with the provisions of this
chapter, he shall, unless prohibited by section 76.26, issue, within thirty (30)
days ef the date of appileation thereferT a permit authorizing the practice, by
the massageor bath technician, of his or her services within the eapperate
limit.. of the city. Each permit issued pursuant to this article shall expire
on the next succeeding September •_,30, terminate, -;i*- the ma*4UM, upon the

Sec. 75.25. Transfers of permits prohibited.
No massage-pae bathhouse, sae or bath technician permit shall be

Sec. 75.26. Denial upon certain findings..
_.? ?Fa} The license inspector shall not issue a
bathhouse, massage or bath technician permit if he finds that:
i ia,44 The correct permit fee has not been tendered to the city, or in
the case of a check or money order, honored with payment upon presentation; or
Lbb,),k24 Regarding a massage -p,ar-ler-er bathhouse permit, the operation, as
proposed by the applicant, if permitted, would not comply with the provisions
of this chapter; or
.Lcl?-4 The applicant, if an individual, or any of the co-owners if the
applicant is not an individual, has:
l.a,- Been convicted of any felony involving fraud, deceit, or an offense
involving moral turpitude, unless such conviction occurred at least three (3)
years prior to the date of the application, or-r has been convicted of any
offense involving sexual misconduct with minors, keeping or residing in a house
of ill fame, solicitation of a lewd or unlawful act, prostitution or pandering,
unless such conviction has occurred at least three (3) years prior to
application for permit and the applicant has had no subsequent convictions;•or
2.4)v- Been convicted of any offense involving the use of or threat to use'
force or violen.e upon the person of another.
For the purposes of this section "conviction" shall not include but not
be 14mite? ?- "withheld adjudication."
id 1-(-' } The applicant has knowingly made any false, misleading, or
fraudulent statement of fact in the permit application or in any document
required by the city in conjunction herewith; or
_LeJ{-4 The applicant has had a Foassage-er bath business, massage ep bath
technician, or other similar permit or license denied, revoked or suspended for
any of the above causes by the city or any other state or local agency within
five (5) years prior to the date of application; or

by filing with the city clerk, within ten (10) days after the decision woe

city cleric shall forthwith notify the city manager who shall schedule a public
hearing and shall give notice of such hearing to the appellant.
L21444 The decision and order of the city manager shall be final and
conclusive, unless the appellant, within ten (10) days following notification
of the decision and order of the city manager, files a written statement setting
forth the grounds of appeal from the decision or order of the city manager with
the city clerk. Upon the filing of such written statement, the city clerk shall
ferthwith notify the city managerT-Ao and shall schedule a public hearing
before the city commission and shall give notice of such hearing to the
appellant. At such hearing the city commission shall be entitled to consider
any exhibits and any minutes or a transcript of the hearing held before the city
manager in addition to any other matter appellant may wish to present relating
to the grounds of appeal. The decision and order of the city commission on such
further appeal shall be final and conclusive.

Sec. 75.29. Miscellaneous provisions relating to licensing.
Except as otherwise provided in this article, the rest of the provisions
of chapter 71, relating to occupational licenses, shall apply to massage
establishments fps, bathhouses, licensed massage therapists, massage
a rentices and sr- bath technicians and .
Section 8. This ordinance shall take effect immediately upon adoption.
