Sections 135.10001 through 135.1007, are created within a new Division 15A of Chapter 135, Code of Ordinances, to read: Division 15A. North Greenwood Commercial District (CNG) Section 135.1001. General Description. ! The North Greenwood Commercial (CNG) District is created pursuant to the North Greenwood Commercial District General Development Plan in order to stimulate reinvestment in and revitalization of an inner city commercial district. The preferred land uses are neighborhood-oriented r--tail, service and professional uses. It is intended that the district draw primarily from the encircling residential community, and building and parking standards are structured to create a pedestrian shopping environment. Adherence to sign and facade design criteria is encouraged for building permits for new buildings, building additions, and facade modifications pursuant to Sections 134.010 and Y 137.0235 of this code. Within the CNG District: (1) A convenience foodstore may include gasoline sales provided that gasoline dispensing units and islands are positioned at least fifteen (15) feet i t from all property lines, and provided that not more than eight (8) fueling spaces are provided, such fueling spaces to be outlined in paint. However, a • convenience foodstore with gasoline sales may provide more than eight (8) : fueling spaces with the approval of the planning and zoning board, which approval shall be obtained following the procedures for conditional uses. Three-family dwellings shall be governed by the dimensional and numerical development requirements of the Multiple-Family Residential "Twelve" District contained in Section 135.043. (5) Twa-family dwellings shall be governed by the dimensional and numerical development requirements of the Multiple-Family Residential "Twelve District contained in Section 135.043. (6) Detached single-family dwellings shall be governed by the dimensional and numerical development requirements of the Single-Family Residential "Eight" District contained in Section 135.029. (7) Accessory uses shall comply with the provisions of Section 136.008, (8). All uses, whether permitted, conditional or nonconforming, shall be conducted in compliance with the use standards contained in Section 136.005. Sec. 135.1006. Dimensional and numerical development requirements. The following dimensional and numerical requirements shall apply to development within the CNG District not expressly regulated elsewhere: (1) Maximum density: Sixteen (16) dwelling units per net acre. (2) Minimum setbacks: Structures shall be afforded setbacks which ! measure not less than hereinafter referenced nor less than any higher standard which may be applicable to a particular property in accord with the uniform development regulations contained in Chapter 136. (a) Principal and accessory structures: 1. From North Greenwood Avenue: Thirty (30) feet from the 3. centerline of North Greenwood Avenue. s 2. From all other streets: Ten (10) feet from the street right- of-way. 3. From a side property line: None required. 4. From a rear property line: Ten (10) feet. (b) Reserved. (3) Maximum freight: Twenty-five (25) feet (4) Minimum open space for the lot: Fifteen (15) percent of the lot ' area, ' (5) Maximum f loor area ratio: Six-tenths (0t6). R r' L t t • E . Sec. 135.1007. Optional parking reduction. Reduced parking standards shall apply to development within the CNG District for which building plans are approved by the North Greenwood design review committee consistent with the standards and procedures adopted by the city commission by resolution and in accordance with the following: (1) Commercial and office uses may reduce the otherwise required number of parking spaces by.not more than sixty (60) percent. (2) The owner of any parcel of land, including all adjoining lots nad plots under the same ownership, having an area of less than five thousand (5,000) square feet, shall be permitted a parking waiver for any nonresidential use, other than establishments serving alcohol beverages for consumption on the premises, in accordance with the following conditions and restrictions: (a) Buildings shall be provided with an additional front (street) setback of five (5) feet, and landscaping shall be provided within 'that additional setback. (b) A maximum floor area ratio of four-tenths (0.4) shall apply. 1 (c) A landscaped open space, at least two hundred (200) square feet in area, including at least one shade tree, shall be provided and maintained for the purposes of buffering, neighborhood beautification, and creation of attractive outdoor space. Storage or accumulation of materials, equipment, or debris in this open space is prohibited. (d) - The owner shall record a declaration of unity of title applicable to the entire parcel of land. (e) The parcel shall not have been created or split from a larger parent tract of land since December 1, 1988, according to the date of the deed or other instrument of conveyance or devise. Section 2. Subsection (4) is added to Section 134.010, Code of Ordinances, to read; Sec. 134.010. Signs requiring permits. Where more than one occupancy exists or is proposed on a property, the scope of the committee's review shall be limited to the occupancy or occupancies to which the plans pertain. (c) Composition, appointment and term. 1. The committee shall consist of seven (7) members who shall be residents of the city. The city commission shall appoint the members of the committee, four (4) of whom shall be property owners or merchants within the district, one (1) of whom shall be a design professional (an architect, landscape architect, engineer or urban planner), one (1) of whom shall be a representative of the Clearwater Neighborhood Housing Services, and one (1) of whom shall be an at-large member. In addition, two (2) at-large alternate members shall be appointed to sit as voting members in the absence of regular - committee members. All appointments shall serve at the pleasure of the city commission. 2. Appointments shall be for three (3) year terms, except that shorter initial terms shall be established by the city commission to provide staggered expiration dates. A member may be appointed for not more than two (2) consecutive terms. (d) Officers. The committee shall elect a chairman, vice-chairman and secretary from among its members as well as any other officers determined necessary for its functions. All officers shall be elected for one year terms and shall be eligible for reelection. (e) Rules and regulations. The committee may establish such rules and regulations not inconsistent with the ordinances of the city as the committee may determine necessary to carry out its duties. The chairman of the committee may call special meetings as may be necessary. All meetings of the committee shall be open to the public. (f) Powers and duties. The board shall have the following powers and duties: (1) To r,aview, evaluate and score building plans and sign plans in the CNG District according to the North Greenwood Commercial District design standards established by resolution. (g) North Greenwood design standards, Design standards for the North Greenwood Commercial District, including the method for committee action on and scoring of plans, shall be established by resolution of the city commission. (h) Failure of the committee to act on plans in a timely manner. In the event the committee fails to act on plans, without the concurrence of the property owner or the owner's designated representative, within thirty (30) days from the submission of such plans to the building official, the plans shall be considered approved, (i) Coordination of building construction and sign placement. In the event a new sign is proposed in conjunction with a request for a building permit, and the committee's approval of building plans is contingent upon placement of the sign, the committee shall specify the timing for placement of the sign. (j) Records. Upon review and evaluation of any set of building plans, the secretary of the committee shall record the scoring of each member and such scoring shall be maintained as a public record accompanying the building plans kept on file in the office of the building official. (k) Parking standards. Parking standards may be reduced for development in compliance with building plans approved by the board, as provided in Section 135.1007. The reduction of parking standards shall not be available for compliance with approved sign plans as to any property for which building plans are not also approved by the committee. (3) Action by committee. a. Five (5) members shall constitute a quorum. b. At the conclusion of each hearing item, based upon the material presented to the committee at the hearing and the design standards set forth above, the committee members shall individually score the plans. In order to act on plans, at least four (4) members of the committee shall record scores. Building plans shall be evaluated in three (3) categories: architecture, signage, and landscaping and other amenities. Sign plans shall be evaluated solely on the signage design standards. A maximum score of one hundred (100) points shall be available for building plans, or twenty (20) pints for sign plans. c. After the committee members have scored the plans, the secretary shall total the scores and divide by the.number of scoring members in order to determine an average score. An average score of seventy-five (75) points shall be required in order to determine an average score. An average score of seventy-five (75) points shall be required in order to obtain a building permit, or fifteen (15) for a sign permit. In the event a new building is proposed and the signage cannot be determined at the time of building plan review, the plan review may be staged whereby signage is postponed form review until such time as sign permit applications are filed. In such case, the building plan review shall be limited to architecture and landscaping and other materials. Accordingly, the maximum score shall be adjusted to eighty (80) points and an average core of sixty (60) points shall be required in order to obtain a building permit. Section 5. This ordinance shall take effect immediately upon adoption.
