"t'" ? ar •'k:',::' ? g; .?'::?k' ? i•r ? .t''r. .'t. 1 ti. °. .. .. s ORDINANCE NQ. 4826-89 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, RELATING TO THE LAND DEVELOPMENT CODE; AMENDING SECTION 136.024(d), CODE OF ORDINANCES, RELATING TO ALCOHOLIC BEVERAGE SALES, TO ESTABLISH A MINIMUM DISTANCE OF 200 FEET BETWEEN ALCOHOLIC BEVERAGE ESTABLISHMENTS LICENSED BY THE STATE OF FLORIDA FOR "PACKAGE" SALES (OFF- PREMISES CONSUMPTION) ONLY; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Paragraph (1) of Subsection (d) of Section 136.024, Code of Ordinances, is amended to read: (d) Separation requirements: (1) No alcoholic beverage establishment shall be permitted within three hundred (300) feet of any church, school or residential zone, except as provided in paragraph (2) of this subsection. No alcoholic beverage establishment licensed by the state for on-premises consumption or package sales (1-COP, 2- COP or 4-COP) shall be permitted within two hundred (200) feet of another alcoholic beverage establishment similarly licensed (1-COP, 2-COP or 4-COP). No alcoholic beverage establishment licensed b the state for package sales only 1-APS 2-AP or -P shall be emitted within two hundred (200) feet of another alcoholic beve a e establ s ent similarly licensed 1-APS 2-APS or 3- PS). For purposes of this subsection, "residential zone" includes but is not limited to the resort commercial districts. Section 2, This ordinance shall take effect immediately upon adoption.
