"Li r ON RDINANCE NO. 4803-89 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, RELATING TO PURCHASES BY THE CITY; AMENDING SECTIONS 42.20 AND 42.21, CODE OF ORDINANCES, TO INCREASE THE LIMITATION UPON THE PURCHASES OF COMMODITIES WITHOUT FORMAL COMPETITIVE BIDDING FROM $7,500.00 TO $10,000.00; AMENDING SECTION 42.23, CODE OF ORDINANCES, TO INCREASE THE LIMITATION UPON PURCHASES OF COMMODITIES WITHOUT CITY COMMISSION APPROVAL IN CERTAIN CIRCUMSTANCES FROM ' $7,500.00 TO $10,000.00; AMENDING SECTIONS 42.30 AND 42.31, CODE OF ORDINANCES, TO INCREASE THE LIMITATION ON PUBLIC WORKS CONTRACTS WITHOUT FORMAL COMPETITIVE BIDDING FROM $7,500.00 TO $10,000.00; PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 2.01(d), City Charter, was amended by Ordinance 4768-89 to increase the limitation on purchases without formal competitive bidding from $7,500.00 to $10,000.00; and WHEREAS, Ordinance 4768-89 was approved by the voters of the City of Clearwater on March 14, 1989, and the amendments took effect on March 24, 1989, when ordinance 4768-89 was filed with the Florida Department of State; and WHEREAS, the amendments set forth in this ordinance are intended to eliminate the inconsistencies between Articles II and III of Chapter 42, Code of Ordinances, with respect to the purchase of commodities and public works contracts without formal competitive bidding; now, therefore, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Sections 42.20, 42.21, 42.23, 42.30, and 42.31, Code of Ordinances, are amended to read: Sec. 42.20. Purchases over ten thousand seventy five-hundi-ed dollars. Except as otherwise provided in this chapter, the purchase of commodities of an estimated value in excess of ten thousand dollars ($10,000.00) enty- fiye hundped de''°r° ($7,600.00) ^rT^r° shall be by written contract with the lowest responsible bidder whose bid has been solicited, received and approved, pursuant to the following procedures: Sec. 42.21. Purchases for ten thousand under seventy five hundred dollars or less. Exceptions to bidding procedures. The bidding requirements set forth in this article may be waived ti, ?'?' w444 when one of the following conditions exists: (1) A department director certifies in writing to the purchasing agent that an emergency exists in regard to the purchase of any commodity so that the.n:; tab f delay incident to giving an opportunity for competitive bidding would be detrimental to the interest of the city. The responsible department director r yw9.a t ,t• r shall provide a detailed summary outlining the facts demonstrating the existence of an emergency. Upon determining that an emergency exists the purchasing agent may authorize the purchase subject to approval b the city commission at its L earliest regular public meeting thereafter.^ yy (2) Commodities are available only from a single source, after r'7 y Al determination by the purchasing agent upon review of written summary of facts`` from the department director requesting the purchase. ' (3) The amount of the purchase involved is estimated to be five hundred Ea.r z;. dollars ($500.00) or less.`' s. r ?;.. Any change in the contract price, scope of work or time for completion of any project following the award of a contract shall be by a written change order, approved by the city commission and executed with the same formalities as the contract. However, the city manager may approve and execute change orders without city commission approval subject to the following limitations: a. Contract price increases shall not exceed ten thousand dollar- ($10,9901.00) over the original contract price, in any one change or cumulatively for the same contract. No contract price increase shall be approved unless there are sufficient unappropriated funds available for such purpose. b. Contract price decreases may be approved without limitation. C. The time for completion may not be extended by more than thirty (30) days, in any one change or cumulatively for the same project. d. No change order shall change the scope of the work unless approved - by the city commission. Sec. 42.31. Contracts for ten thousand undo ^ seventy five hundped dollars or less. Except as otherwise provided in this chapter, contracts for the completion of projects estimated to cost ten thousand dollars 310,00Q.00)_or less 4es-& may he executed after bids have been obtained in the open market, pursuant to the following procedure, without observing the procedure prescribed above in section 42.30: Section 2.
