ORDINANCES, RELATING TO THE EXPOSURE OF CERTAIN ANATOMICAL AREAS BY.CERTAIN PERSONS, AND CREATING NEW SECTIONS 82.01 THROUGH 82.06, CODE OF ORDINANCES; PROHIBITING THE EXPOSURE OR SIMULATION OF CERTAIN ANATOMICAL AREAS AND PROHIBITING CERTAIN SPECIFIED CONDUCT BY PERSONS IN ESTABLISHMENTS LICENSED BY THE STATE OF FLORIDA TO SELL ANY ALCOHOLIC BEVERAGE FOR CONSUMPTION ON THE PREMISES; PROHIBITING THE CONSTRUCTION AND USE OF AREAS PARTITIONED, CURTAINED OR SCREENED FROM PUBLIC VIEW THAT ARE PERMITTED TO BE USED FOR CERTAIN PROSCRIBED CONDUCT; PROVIDING DEFINITIONS; PROVIDING PENALTIES; PROVIDING FOR REVOCATION OF OCCUPATIONAL. LICENSES; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Clearwater, Florida, finds that there is presently in the City of Clearwater an increasing trend toward the commercial exploitation of partially nude acts, exhibitions and entertainment in connection with or for the promotion of the sale of alcoholic beverages, and the receipt of money by the person engaging in the partially nude entertainment in exchange for or as consideration for a partially nude performance by such individual; and WHEREAS, the City Commission of the City of Clearwater, Florida, finds that there is presently in the City of Clearwater an increasing trend toward exotic dancing, whereby the dancer sits upon, straddles, or rubs against the body of a customer in exchange for the payment of money and in connection with or for the promotion of the sale of alcoholic beverages; and WHEREAS, there is a direct relationship between the consumption of alcoholic beverages and the activities mentioned in the paragraphs above, prohibited hereunder, and more fully described hereinafter, and an increase in 'criminal activities, disturbances of the peace and good order of the community, and the concurrence of these activities is adverse to the health, safety and welfare of the community and citizens thereof, and places a strain on law enforcement resources; and t h, 1 ??M. ??+ r•x ?.?• •?f? rTt ,.t?:`.?'.?.... ,.. ..?:?.+%..?c?.•:a...u.. ?.-?...w:x.,'r'- 7:: ='+rat'??o"'?`r!F'4"..?.?"??Fwr}FS.t'+e,..r:w.r._Ri,:<,:.?.'...K? ?N° '1+•• 'J.r•'? E• • . 1 Y-s?? .?. _,?., .?.?5... ._.. cal ?'?.,. -._ •r?e, . _''°>^'y'',? _ _ ,.,.. :.c% :.-Eat's..._.t_?-'%r.'?„?e?.".t:u.'?.r... «t'3a•s...E2 c• i= •kT f =fin: E. :i 'k {.J µ ? • .S r: • ' A r 4 WHEREAS, in order to preserve the public peace and good order, to prevent blight and the deterioration of the City's neighborhoods and business community, and to safeguard the health, safety and welfare of the community and citizens thereof, it is necessary and advisable to prohibit nude and partially nude acts, exhibitions and entertainment in establishments licensed by the State of Florida to sell any alcoholic beverage for consumption on the premises, and to prohibit certain physical contact occurring during activities commonly referred to as "lap dancing" or "private tableside dancing" in such establishments; and WHEREAS, in order to prevent the activities as described in Section 796.07, Florida Statutes (1987), from occurring in establishments licensed by the State of Florida to sell any alcoholic beverage for consumption on the premises, it is necessary to prevent the construction of and use of areas partitioned, curtained or screened from public view that are permitted to be used by persons on the premises of such establishments for private dancing performances; and WHEREAS, in order to preserve the public peace and good order, to decrease the incidence of crime and to safeguard the health, safety and welfare of the community and citizens thereof, it is necessary and advisable to regulate and restrict the conduct of any person owning, maintaining, operating or leasing any establishment licensed by the State of Florida to sell any alcoholic beverage for consumption on the premises, as provided for in this ordinance; and WHEREAS, to preserve the public peace and good order, to decrease the incidence of crime and to safeguard the health, safety and welfare of the community and citizens thereof, it is necessary and advisable to regulate and restrict the conduct of persons on the premises of an establishment licensed by the State of Florida to sell any alcoholic beverage for consumption on the premises, as provided in this ordinance; now therefore BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER,FLORIDA- Section 1. Existing Sections 82.01 through 82.05, Code of Ordinances are repealed in their entirety and new Sections 82.01 through 82.06, Code of Ordinances, are created to read; Sec. 82.01. (c) It shall be unlawful for any person owning, maintaining, operating or leasing an alcoholic beverage establishment or his or her employee, agent, servant or any entertainer employed at the licensed premises or employed on a contractual basis, to engage in any activity commonly referred to as "lap dancing" or "private tableside dancing" whereby the person intentionally sits upon or rubs against the clothed or unclothed genitals, vulva, anus or buttock of any patron, customer or spectator therein in exchange for receiving a tip, donation, gratuity or anything of value, including but not limited to money. It shall be unlawful as well for the patron, customer or spectator upon whose body the "lap dancer" or "private tablesiJe dancer" is committing the above proscribed activity, to permit the activity to occur. However, this subsection does not apply to acts done for bona fide medical purposes. (d) It shall be unlawful for any person owning, maintaining, operating or leasing an alcoholic beverage establishment, to permit any violation of subsection (c) of this section. (e) It shall be unlawful for any person owning, maintaining, operating or leasing an alcoholic beverage establishment, to permit the construction, maintenance or use of areas completely or partially partitioned, curtained or screened from public view that are permitted to be used for the activities proscribed in subsection (c) of this section. Sec. 82.04. Penalties. Any person who violates any provision of this chapter shall be punished by a fine not exceeding five hundred dollars (#500), or imprisonment for a term not exceeding sixty (60) days, or by both a fine and imprisonment. Sec. 82.05. Revocation of License. If the person owning, maintaining, operating or leasing an alcoholic beverage establishment, shall enter a plea of guilty or nolo contendere to or be found guilty of any of the offenses designated in Section 82.03(b), (d) or (e), then the City shall have Just cause to revoke the City Occupational License for such establishments. Revocation shall be by the City Commission pursuant to the procedure set forth in Section 71.12. Sec, 82.06. Severability of Parts of Code. If any section, sentence, clause, phrase or word is held invalid or unconstitutional, it shall be severed from the remaining parts of the ordinance, 4 i :Ev • 1 ? , Fy M and shall not affect the validity or constitutionality of said remaining parts.
