AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, RELATING TO
SIGN REGULATIONS; A14ENDING SECTION 134.015, CODE OF
' ORDINANCES, TO DELETE THE SPECIAL PROTECTION FROM REMOVAL
FOR CERTAIN NON-CONFORMING SIGNS (COMMONLY CALLED
?. BILLBOARDS) LOCATED ON GULF-TO-BAY EAST OF HIGHLAND AVENUE
AND TO ESTABLISH A SEVEN YEAR TIME PERIOD WITHIN WHICH SAID
SIGNS MUST BE MADE TO COMPLY WITH CURRENT STANDARDS OR BE
REMOVED, AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, the sign regulations set forth in Section
134.015(c)(2) Code of ordinances, provide a special privilege
category for billboards on Gulf-to-Bay Boulevard east of Highland
Avenue. This special provision means those billboards are exempt
i from the removal requirements contained in the City Code. All
other city controlled billboards must be'removed by October 13,
1992. (Billboards along Highway 19 are governed by State and
4 Federal regulations and thus are not subject to removal in 1992.)
WHEREAS, Billboards along Gulf-to-Bay are discordant
elements, create visual chaos and pollution, are inconsistent
with the overall objectives of improved community appearance and
Clearwater's professed sparkling image and are offensive to
citizens that use this principal traffic artery.
WHEREAS, utilization of the visual exposure to the public
right of way for advertising purposes is inconsistent with the
purposes of maintaining and improving said right of way for safe
transportation purposes.
WHEREAS, Gulf-to-Bay is the major entry roadway intti our
city for vacation visitors traveling to Clearwater Beach.
Tourists are influenced by the aesthetic appearance of their
vacation destinations in deciding to return to the area. The
economy of Clearwater is dependent on the health of the tourist
industry and thus billboards are counterproductive to the overall
well-being of the local economy.
WHEREAS, the City has both expended money and adopted
regulatory provisions to make the city attractive to the tourist
industry and such existing special, privilege for billboards is
counterproductive to this effort.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA (OR BY REFERENDUM OF THE
VOTERS):
Section 1. Section 134.015(c)(2) shall be repealed and
replaced with the following:
(2) Any nonconforming sign located on Gulf-to-Bay
Boulevard east of Highland Avenue which, if said
Boulevard was classified a federal aid primary highway,
would be protected from removal by the Federal Highway
Beautification Act or Ch. 479, F.S., shall be made to
comply with the terms contained herein or shall be
removed within s4e753 (7) years from the enactment of
Ordinance No. .......,.-880

Section 2. This ordinance shall take effect immediately
upon adoption by the City Commission. If the City Commission
fails to adopt this ordinance without any substantive changes
within sixty (60)'•-days after the initiative petition was finally
determined sufficient, this ordinance shall take effect upon
approval of a majority of the electors voting at a referendum
held at a municipal election. The referendum shall be held at
the next general municipal election, provided that if -no such
election is scheduled more than ninety (90) days and less than
one hundred-twenty (120) days from the date the petition is
determined sufficient, a special, election shall be held.
The question to appear on the referendum ballot shall,be as
follows:
Removal of Billboards on
Gulf-To-Bay Boulevard
East of Highland Avenue
Shall the code of ordinances of the City of Clearwater be
amended. to require that any billboard located on Gulf-To-Bay
Boulevard east of Highland Avenue comply with the present City
sign regulations or be removed within seven. years of this
election?
