BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Subsection (d) of Section 133.009, Code of Ordinances, is amended,
and Subsection (f) is added to said section, to reads
Section 133.004. Applicability and Scope.
(d) Whenever any subdivision of land Is proposed, and before any final site plan
approval or building permit for the development of or construction of any
improvement on stteh land proposed for subdivision is granted, the owner of the
property shall apply for and secure approval from the city of a preliminary plat In
accordance with the review procedures and standards delineated in this chapter.. and
the approved said preliminary plat shall be certified by the city clerk as constituting a
valid record of saeh approval. Followin certification of the ereliminary plat, and
following certification of the final site plan when required pursuant to Section
137.010, a building permit for one building may be Issued for the pro ert except that
no buiildin permit shall be issued for a townhouse development prior to the recordin
of the final plat. However, Rarthermere, no certificate of occupaney/use shall be
Issued by-the-eity for property proposed to be platted wail the final plat is recorded
at-4he-eff4ee-e£-4he-elark-o€-4he-eetircty-eadr4 in accordance with the terms
contained herein.
(f) The subdivider shall bear the expense of the improvements required b this
chapter in accordance with. city standards, specifications and policies an file In the
office of the city engineer.

Section 2. Subsection (b) of Section 133.004, Code of Ordinances, is amended to

Section 133.008. Subdivision construction plan review.
(b) Following certification of the preliminary plat, the applicant shall may
submit a written request to the city engineer eode-adtm'inifftrater for review and
approval of the subdivision construction plans according to the following:
(1) The applicant shall submit a minimum of seven (7) copies of the complete
subdivision construction plans for distribution by 4 -lire-code-adm4nig4raterwh"ha4
distri?t4e-these-te the city engineer to and other appropriate city departments for
review 4n-a44me4y4ash;.en.
(2) The city engineer shall supervise and coordinate the technical review by

a. Determine the completeness of the plans and compliance with the
approved preliminary plat for the subdivision.
b. Evaluate the degree of compliance with the technical requirements in
the design standards of this chapter, and other applicable city regulations.
C. Identify any deficiencies or issues which require further attention and
should be considered as conditions of approval.
(3) The city engineer eede-adtt4nfs4-rater shall, eeerdi-nate-4he-eempletien-e4
4his-rev4ew-wi4h-•the-city-enghneer-an4, upon completion of tha review, shall inform
the applicant that the plans have been either approved, approved subject to conditions,
or disapproved.
(4) The city engineer cede-admlttistrater shall require all technical design
details to be reviewed and authorized or conditioned by the department head
responsible for overseeing the respective design or improvement.
(5) If conditions have been placed upon approval of the subdivision
construction plans, such conditions shall be resolved to the satisfaction of the city
engineer before a final plat is can-be accepted for review.
Section 3. Section 133.0095, Code of Ordinances, is created to read:
Section 133.0095. Required improvements.
(a) Prior to the recording of a final plat, the applicant shall have completely
installed to the satisfaction of the city engineer all of the following improvements in
accordance with the standards set forth in this chapter and the approved subdivision
construction plans for the project:

(1) All utility facilities and storm water drainage facilities which are required
to be installed underground;
(2) All curbs, gutters and base materials for all streets, whether public or
private; and
(3) All excavations for detention ponds and necessary open ditches,

satisfactorily Installed prior to the recording of the final plat or secured by the
furnishing of an acceptable financial guarantee as described In Section 133.033(f)(3).
Section 4. Subsection (b) of Section 133.010, Code of Ordinances, is amended to
read:
Section 133.010. Final plat review.
(b) The final plat review and filing process shall be conducted according to the
f ollowing:
(1) Subsequent to submission and approval of the subdivision construction
plans, the applicant shall submit the original and one copy of the final plat and-one
eepy to the city engineer eerie-addrater.
(2) The city engineer eede-adm4nlst'rater shall circulate the copy of the final
plat -together-w'i'lls-a-final-*-t preeessing-sheet to appropriate city departments. A
representative of each city department to which the plat is forwarded the-plat'-and
aeeernpany4ng-preeess4ng- heet shall;-In-thek'-respeet#ve'-areas-ef-experti'se:
a. Determine the completeness of the final plat and compliance with
the certified preliminary plat.
b. Verify the accuracy of information provided.
C. Evaluate the degree of compliance with the technical requirements in
the design standards of this chapter and other applicable city and state requirements.

improvements has been satisfactorily completed by the applicant in accordance with
city specifications, the city en neer cede-adminWrater shall forward the final plat
tracing to the city manager for h4s signature.
(4) Following signature by the city manager, the city engineer eerie
adm4nis4rater shell coordinate recording of the final plat at the office of the clerk of
the circuit eeunty court.
(5) Any amendment of a final plat other than those required by-erig hating
4€ em the office of the clerk of the circuit county court shall require a revised or
amended final plat to be prepared and reviewed consistent with the terms contained in
this section for final plat review.
Section 5. Subsection (g) of Section 133.015, Code of Ordinances, Is amended to
read:
Section 133.015. Street Intersection and alignment.
(g) The design of streets shall be In accordance with city standards established
Readway-grades-shal•1-be-as-approved by the city engineer.
Section 6. Subsections (b), (c) and (f) of Section 133.025, Code of Ordinances,
are amended to read:
Section 133.025. Site work.
(b) No financial guarantee for required site improvements pwermanee-bend
shall be released, nor shall the er dedication of public Improvements be accepted, until
grading has been completed and stabilized, where required applicable, by sodding or
planting in accordance with the approved subdivision constructions plans.
(c) The financial guarantee per'fermanee-bend shall Include an amount to insure
guaranAee completion of all required improvements as shown requirements eerAafned
in the approved subdivision construction plans; neluding,, but-net4taiRed-te,-t'ree-

(f) No cut trees, timber, debris, junk, rubbish, or other waste materials of any

c. A surety bond issued by a surety company authorized to do business in
the State of Florida. The surety bond shall include, as a minimum the provisions
required above for letters of credit.
Section 8. Paragraph (9) of Subsection (d) of Section 136.022, Code of
Ordinances, is amended to read:
Section 136.022, Parking standards.
(d) Design standards. All parking lots shall be designed to meet the following

(3) Financial guarantee.
Unless all required improvements have been satisfactorily completed, an
acne table financial guarantee for required Improvements shall accompany ever lat
which is to be recorded to insure the actual satisfactory completion of construction of
all required improvements within not more than two (2) years following the date of
recording, or one (1) year if sidewalks are the only required Improvement to be
completed followin the date of recording. An acceptable financial arantee for
required Improvements shall be in an amount not less than the estimated cost of the
Improvements, as approved b the city engineer, but may be reduced from time to
time In proportion to the work completed, and may take one of the following forms,
subject to the approval of the city engineer and the city attorney:
a. Cash, to be held in escrow by the city,- or
b. An irrevocable letter of credit written b a bank chartered b the State
of Florida, or the United States government, or any other state of the United States if
the bank is authorized to do business in the State of Florida and acce table to the
finance director. The letter of credit shall include, among other things, an expiration
date not earlier than one year from the date of issuance; a provision requiring the

Section 9. Paragraphs (1) and (4) of Subsection (g) and Subsection {?) of Section
137.010, Code of Ordin ances, are amended to read:
Section 137.010. Site plans.
(g) Design guidelines for site plan review. It is the purpose and intent of these
design guidelines to supplement the standard requirements of the individual land use
plan and zoning atlas classifications in a manner that recognizes the need to tailor the
land planning process to the unique features of each site, while preserving the right of
reasonable use of private property based upon the uses permitted under the land use
plan and zoning atlas classifications assigned to the property. The following items
shall be given full consideration in the preparation and review of site plans required
under this section. Furthermore, before any final site plan is granted approval
(whether conditionally or unconditionally), it shall first be established that such plan is
consistent with the design guidelines of this section. When it is determined that a
final site plan does not satisfactorily comport with one or more, in whole or in part, of
any of the deign criteria contained herein, the city shall have the authority to deny the
site plan. Design guidelines to be considered shall include, but are not limited to, the
following:
(1) Plan and code requirements. Site plans shall be consistent and in
conformity with all applicable rules and regulations of the city, county, and the state,
including but not limited to the following:
a. City Charter.
b. ' City Code of Ordinances, titles I to XH.
c. City comprehensive plan and its constituent elements.
d. Other A44seeRaneeus city ordinances, resolutions, policies and
administrative directives.
e. County planning council plans and regulations.
f. Applicable provisions of Florida Statutes and the Administrative
Code.
It shall be the objective of this guideline to assure compliance with all applicable
city, county and state requirements as a minimum criterion for further consideration
of a site plan.
(4) Streets, drainage Bra4nage 'and utilities. Site plans shall be so designed as
to provide for streets, water supply, sewage disposal, refuse collection and surface
water retention. Those specific factors to be evaluated in determining that these
measures have been adequately addressed include the following:

All of the above factors shall be determined consistent with the objectives of the
utility plan and current development standards and design specifications of the city
engineer and-u ies-di?eeten It shall be the objective of this guideline to assure
that adequate service capacity is available and that utility, street and drainage
systems are appropriately designed for en the proposed development site in
relationship to the larger systems entering and leaving the site.
(j) Content. Preliminary and final site plans shall be drawn to a minimum
scale of one inch equals fifty (50) ene-hundred496) feet on an overall sheet size not
to exceed twenty-four (24) by thirty-six (36) inches. When more than one sheet is
required, an index sheet of the same size shall be included showing the entire parcel
with individual sheet numbers referenced thereon. The following information is
required on or in an acceptable form so as to accompany the preliminary and final site
plans respectively:
(1) Preliminary site plan.
a. Site plan name.
b. The property owner's name, address and telephone number, and the
designated project applicant or representative and authorization for such
representation if other than the property owner.
C. The architect, landscape architect or engineer's name, address and
telephone number.
d. North arrow, scale and date prepared.
e. Legal description.
